AN 0RDI,,A1dCE providing for the curbing, guttering and grading of each the north side
of Cloud Street from the west line of Quincy Street to the center line of Roach
Street; the west side of Roach Street from the north line of Cloud Street to the
south line of Claflin Avenue; Norton Street fron the north line of Cloud Street
to the north line of Claflin Avenue; Quincy Street from the north line of Cloud
Street to the north line of Claflin Avenue; Russell Avenue from: the west line
of Quincy Street to the center line of Roach Street;—Claflin Avenue (Street)
from the west line of Quincy Street to the center line of Roach SFreetl Wilson
Street from the west line of Custer Street to the east lLie of 0heridan Street;
Montrose Street from the center 1L_e of Charles Street to the center line of
Prescott Avenue; Kirwin Avenue from the west line of Quincy Street to the center
line of Roach Street; providing for the paycent of ttie cost thereof, ::ow the same
shall be assessed, the manner of the pa;nnent thereof and the issuance of lIonds
thereon:
WHEREAS, by Resolution No. 1027, 1028, 1029, 1030, 1031, 1032, 1033, 1035 and 1037 duly
adopted I aarc# 1, 1948, March 1, 1948, March 1, 1948, Llarch 1, 1948, March 1 1948
Larch 1, 1948, March 8, 1948, March 15, 1948 and March 29, 1948, respectively, the
Board of Commissioners of the City of Salir;a have declared that they deem it necessary
to curb, gutter and grade each — the north side of Cloud Street from the west line of
Quincy Street to the center line of Roach Street; the west side of Roach Street from
the north line of Cloud Street to the south line of Claflin Avenue; Norton Street from
the north line of Cloud Street to the north line of Claflin Avenue; :uincy Street from
the north line of Cloud Street to the north lane of Claflin A;,enue; Russell Avenue from
the west line of Quincy Street to the center line of Roach Street; Claflin Avenue (Street)
from the west line of Quincy Street to the center line of Roach Street; Wilson Street
from the west line of Custer Street to the east lixze of Sh-•idan Street; Montrose Street
from the center line of Charles Street to the center lime of Prescott Avenue; Kirwin
Avenue from the west line of xincy Street to the center 1L,e of Roach Street.
EEREAS, each of said resolutions were duly published for six days in the ialLia Journal,
daily newspaper published in said city, and being the official city paper, and the
majority of the resident property owners owning a majority in square feet of the lots
or real estate liable to taxation for the cost of said improvements did riot within
twenty days from the date of the last publication thereof file with the city clerk a
sufficient protest, in writing, against the -making of said improvements, no protests of
any kind 'Iaaving been filed; NO16 THEREFORE,
BE IT ORDAINED by the Board of Conuaissioners of the City of Salina, Kansas:
Section 1. That it is necessary and it is hereby ord red that t -,e north side of
Cloud Street from the west line of t4uincy Street to the ee cline of Roach Street in
said city be curbed and guttered with excavation necessary therefor and graded to the
established paving ,rade to the center line of said street as may be necess€yry for
the completion of said work.
Section 2. That it is necessary and it is hereby ordered that the west side
of Roach Street from the north line of Cloud Street to the south line of Claflin Avenue
in said city ;e curbed and guttered with excavation necessary therefor and graded to
the established paving grade to the center lire of said street as nay be necessary for
the completion of said work.
Section 3. That it is necessary and it is hereby ordered that Norton Street from
the north line of Cloud Street to thenorth line of Claflin Avenue in said city be
curbed and guttered with excavation necessary therefor and graded to the established
paving grade to each side thereof, as may be necessary for the coLipletion of said work.
Section 4. That it is necessary and it is n.ereby ordered that .uincy Street
from the north line of Cloud Street to the nortft line of Claflin Avenue in said city
be curbed and guttered with excavation necessary therefor and graded to the established
p<�-ving grade to each side thereof, as may be necessary for the cor:pletion of said work.
Sect_Lon 5. 'that it is necessary and it is hereby ordered that Russell Avenue
from the west line of Quincy Street to the center line of Roach Street in said city
be curbed and guttered with excavation necessary therefor and graded -to the established
paving grade to each side thereof, as may be necessary for the completion of said work.
Section 6. That it is necessary and it is hereby ordered that Claflin A enue
(also referred to as "street" and being one and the same) from the west line of '�uincy
Street to the center line of Roach Street in said city be curbed and guttered vrith
excavation necessary therefor and graded to the established paving grade to each side
thereof, as may be necessary for the completion of said work.
Section 7. That it is necessary and it is hereby ordered that Wilson Street from
the west lire of Custer Street to the east line of Sheridan Street ".n said city be
curbed and guttered w th excavation necessary therefor and graded to the established
paving grade to each side thereof, as may be necessary for the completion of said work.
Section 8. That it is necessary and it is hereby ordered that Montrose Street
from the center line of Charles Street to the center line of Prescott Avenue in said
city be curbed and buttered with excavation necessary therefor and graded to the
established paving grade to each side thereof, as may be necessary for the coapletien
of said work.
Section 9. That it is necessary and it is hereby ordered that Kirwin Avenue
from the west lire of Quincy Street to the center line of Roach Street in said city
be curbed and guttered with excavation necessary therefor and graded to the established
paving grade to each side tnereof, as may be necessary for the co.rripletion of said work.
Section 10. For the work and inLprovements herein crovided for, the City 4ngineer
shall make and file with the City Clerk on or before the 17th day of May
1948, complete plans and specifications for the curbing, guttering and grading with
excavation necessary therefor) of each of the streets or ,ortions thereof described in
Sections 1 to 9, both inclusive, of this ordinance, with the following type of ii,prove-
ment:
Concrete combined curb
and ,utter on each side thereof
(except the street described in Sections 1 and 2 of
this ordinance which are to be curbed and guttered on
only one side) 30 inches wide from back d;f curb to
paving line, curb 12 inches deep at back; gutter 6
inches deep; and the necessary grading of eacr. to the
established paving grade between the curb and gutter
lines on each side thereof (except the street des-
cribed in Sections 1 and 2 hereof are to be graded
to o-ily the center line thereof) and within the limits
of said streets hereinbefore described;
and said Engineer shall on or before the same date, submit to the Board of Corraaissi.oners
under oath, detailed estimates of tste cost of such work for such improvements.
Section 11. 'That after such plans and specifications stall iia -;e been made and
prepared by pie City h„nCineer and filed with the City Clerk as aforesaid, the Board of
Commissioners may advertise by advertisement published in tine official city paper of the
City of aalina, &ansas, for three consecutive days for the receipt of sealed proposals
for the improving of said streets with the kind 'of material named and specified in the
preceding sections hereof, and for the excavating and grading necessary for the co_-
pletion of such work, and after the receipt of such propo:;als the said Board of Cora-
n.issioners may and are hereby authorized to let contracts for the :improving of said
streets with the Liaaerial selected by them to the lowest responsible bidder or bidders
therefor, as determined by said Board of Conuaissioners, and for such excavating, and
grading. Said Board of Cor:Lnissioners reserve the right to reject any and all bids.
Section 12. That for the improving of the a_ove mentioned streets such assess-
! ments shall be made for tiie full costs tnereof according to law, ori all lots and pieces
of land to the center of the block on either or both side of the streets to be Liproved
according to the appraisers' valuation thereof without regard to tie buildings or improve-
ments thereon for the distance to be improved.
Section 13. lifter the passa`,e and publication of this ordinance, the Board of
Cormnissioners shall appoint three disinterested appraisers, householders, who after
having taken an oath to snake a true and impartial appraisement for all lots and pieces
of land liable to assessment and taxation for the cost of the improvements herein pro-
vided for, shall within five days after navi-aL b^en ;:otified of their appointment,
proceed to appraise said lots and pieces aT' land- liable to assessment and taxation
as aforesaid, as may be designed by the Board. of Co -a, ssioners of said city, 1�rithout
regard to the buildings or L,.provements thereon and after r_iaking said annraisement small
return, the sarue to the Board of Coluaissioners of said city and said Board of Cmmiissioners
shall designate a tilie and place for the hearing of any complaints that may be made as
to the value of any lots or pieces of land appraised as -

shall be given in the official city paper, at which hearing the Board of Commissioners
may alter any valuation of any lot or piece of land, if, in their opinion, the same has
been appraised too nigh or too low.
Section.14. That for the purpose of paying the cost of the work and improvements
i.n this ordinance provided for, the loard of Comm issioners are .'ricreby autrorized and
directed to issue internal improve_nent bonds of the City of Sal is^a in an aLL�ount not to
exceed the contract price or cost of such L. provements and to run for a period of four
years and be payable in four equal installments, together with .'.iterest _.ot to dxceed
5J per annuli, which bonds shall be grade payaule at the Fiscal Agency oft e State of
Kansas; and for the purpose ofaying principal and interest on said bonds as they
severally becei:e due and payable, t-tl
e Board of CoiLLissioners shall apportion and assess
against the lots and pieces of land within the taxing district of such improvements,
special assessments covering the cost of such i_aprovements and the apportionment herein
contained shall hold good for all ttje installments that are to be collected from the
