5302 Fireworks License_--------- ORDINANCE NO. 5302 __ -- -- (First published in the Salina Journal 2? 3 - -_ -- -- _ 1948 1 1 1 AN ORDINANCE providing for a license as a condition precedent to the sale and pre- scribing the time of sale of fireworks, blank cartridges, pistols and other devices, or other devices and providing for the repeal of Section 2 and 3 of Ordinance No. 4950 and Section -2 of said ordinance as amended by Ordinance No. 5202 and ordaining a new section 2 and section 3 in lieu thereof. BE IT ORDAL\TED by the Board of Conlaissioners of the City of Salina, Kansas: Section 1. That Section 2 of Ordinance No. 4950, as amended by Ordinance No. 5202, being an ordinance relating to "regulating the possession, offering for sale, sale, giving away, and/or use of fireworks, blank cartridges, pistols or other devices, jor other devices from v -rich blank cartridges may be fired, and/or other pyrotechnics, providing for a license for persons, firms, or corporations, engaging in the sale of i fireworks or pyrotechnics not prohibited by the terms of this ordinance alid providing penalties for the violation of the terms hereof; defining certain nuisances and pro- viding for the abatement thereof", be and it is hereby amended to read as follows: "Section 2. It shall be unlawful for any such person, firm, or corporation to display for sale, sell, or offer for sale, any fireworks and/or pyrotechnics, including sparklers, Which are not prohibited to be sold under Section 1 of this ordinance, with- out first having obtained a license from the City Clerk. Before any such license is issued said applicant for such license shall pay to the City Clerk a license fee of Twenty -rive Dollars ($25.00). Such license fee shall be due and payable le on or b efog ethe 20th day of June of each year, and no license shall issued after said date. A separate license shall be required for each and every place from ivrich the ap plicant for a license desires to sell fireworks andXor pyrotechnics, which license shall be displayed in a conspicuous place in the place of business in which such fireworks and j or pyrotechnics are to be sold." Section 2. That Section 3 of said Ordinance No. 4950, being the ordinance re- ferred to in the preliminary portions of Section 1 hereof be and it is hereby amended to read as follows: "Section 3. No fireworks and/or pyrotechnics, the sale of which is not prohibited under the provisions of this ordinance shall be sold or offered for sale, except during the 4th of July and the business days immediately precedin.: said date, from and after June 20th. It shall be unlawful for any person, firm or corporation to sell or offer for sale, any fireworks and/or pyrotechnics on tae first day of the week col-snonly called "Sunday". 'here the 4th of July falls upon 6unday, then such fireworks and/or pyro- technics may be sold upon the 5th day of July". Section 3. That Section 2 of Ordinance No. 4950 as amended by Ordinance No. 5202 and Section 3 of Ordinance No. 4950 be and they are hereby repealed. Section 4.
