5292 Levy AssessmentsI A 1 ti ow [7 �J ORDIN"CE NUIC6ER 5292 AN ORDINANCE relating to and apportionirg and levying special assessments on certain lots and pieces of ground in the City of Salina, Kansas to pay the cost of grading and paving of North Street from the east line of Fourth Street to the east line of Arthur Street; and relating to and providing for the collection and payment of such assessments, and providing for the repeal of Section seven (7) of Ordinance Number 5290. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. For the purpose of paying for that part of the cost of improvement of certaion portions of a certain street as hereinafter set forth in the following section of tris cr dinance which is chargeable to the private property in the assess- ment districts for such improvement, as set forth In the following section of this ordinance with respect to such improvement there are hereby levied and assessed on the property liable therefor, being all the lots and pieces of ground lyin° on either side of said street so improved, to the middle of the block for the distance improved, with respect to the improvement mentioned in Section two (2) of this ordinance, accord- ing to the appraised value of such lots and pieces of ground with respect to such improvement, without regard to the buildings or improvements thereon, special assess- ments covering the cost of such work and improvement, said special assessments being based on the special valuation and appraisement of said lots and pieces of ground heretofore made by three disinterested appraisers appointed by the Board of Commission- ers of the City of Salina, i�ansas, with respect to such improvement, which said appraise- i ments are hereby referred to and made parts of this ordinance, and the several amounts levied, apportioned and assessed against the lots and pieces of ground for each such improvements, respectively, for the purpose aforesaid, are hereby found and determined to be the amounts set forth in the following section of this ordinance with respect to said improvement. Said amounts levied, apportioned and assessed aforesaid mil be due and collectible in ten equal installments, the first becoming due with the taxes for the year 1948 and one of said installments falling due each and every year thereafter until all are paid, and all to be collected with interest as is in this ordinance provided, PROVIDED, hW VER, that the owner of any piece of property liabl e for any such assessment may redeem his propert. from such liability by paying into the City Treasury t e entire amount chargeable against the same,as in this ordinance designated, at any time within thirty days after the publication of this ordinance and before the -issuance of bonds of said C-ty in payment of the balance of the cost of said improvements, and the propert so paid on shall not tr�ereafter be liable for any further assessments for the cost of said improvements nor for any part of said bonds. Section 4. There is hereby further levied and assessed against each lot and �Ip a e annum as shall his ordinance interest at such rate r piece of round described in t , p a be borne by the bonds hereafter to be issued for the payment of the remaining unpaid cost of such improvements, to e hereafter determined and fixed by ordinance when such bonds are issued, on all of said installments mentioned and provided for in this ordinance, from the date of the bonds which may be issued at the end of thirty days as specified .in the preceding section hereof, as b, law provided, to the time of the collection of the last installment as provided by law, which said interest shall be colleted annually at the same time and in the same manrier as said installments are collected, and after the taking effect of this ordinance and the fixing of said interest rate when such bonds are authorized and issued, it shall be the duty of the City Clerk of said City to annually at the same time other taxes are certified and until all of said assessments so apportioned and levied have been certified to the Co my Clerk of Saline Count.,, Kansas, a full list of all property liable to assess- ment and taxation for such work and improvement, except such property on which the special assessments aforesaid have been paid in full as hereinbefore provided, together with the respective amounts due on each of such lots and pieces of ground, which amounts shall include the annual installments of such special assessments together with the interest for one year at the rate tone fixed as provided for in this ordinance, on all unpaid balances of such assessments, and such amounts so certified as herein provided for shall be placed upon the tax roll b, the County clerk of Saline County, Kansas, and collected as other taxes are collected. Section J. ,That Section Seven (7) of Ordinance No. 5290 be and it is hereby repealed. Section. This ordinance shalltake effect and be in force from and after its publication in the official City paper.
