5288 Confirm Utility Improvementsr 1 ORDINANCE NO, 5288 (First published in the Salina Journal — ---1948 ) AN ORDINANCE ratifying and confirming a contract with the H. J. Taylor Construction Company for the construction of certain lateral sanitary sewers in the City of Salina, heretofore designated as Lateral Sanitary Sewers Districts No. 220 and 221, and providing for the issuance of temporary notes to pay the cost thereof pending issuance and sale of bonds. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the acceptance by the City of Salina of the proposal of i H. J. Taylor Construction Company, hereinafter referred to as the "contractor", as submitted to the Board of Commissioners on karch 22, 1948, which is hereby found to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of said city to said contractor and signed on behalf of the city by its Mayor on March 22, 1948, for the construction of certain public improvements in the City of Sal ina, to -wit: (1) Construction of an 8" V. C. P. lateral sanitary sewer, with all necessary connections, manholes, flush tanks and other appurtenances, beginning at an existing manhole in Elm Street on the east alley line, extended south, of a certain north and south public alley lying between Penn Avenue and Columbia Avenue, thence north as an 8" V. C. P. sewer in said alley 910 feet, more or less, to a manhole to be constructed in said alley on the south line of Lot 35, extended east, Block 2, Riverside Park Addition to the City of Salina, Kansas, being the terminus. (2) Construction of an 8" V. C. P. lateral sanitary sewer, with all necessary connections, manholes, flush tanks and other appurtenances, beginning at an existing manhole in Quincy Street at the center of an east and west public alley, next north of Claflin Avenue; thence east in said alley and terminat- ing at a manhole to be constructed in said alley 40 feet west of the west line of Roach Street, at and for the unit prices for said work contained in said proposal, which proposal and contract are hereby referred to and made parts of this ordinance, be and the same is hereby ratified and confirmed, said proposal being within the estimated cost of said improvements as shown by the sworn estimates of the City Engineer on file in the office of the City Clerk, which estimates are hereby referred to and made a part of this ordinance. Section 2. Said improvements shall be built and constructed in accordance with the plans and specifications therefore prepared by the City r'ngineer on file in the office of the City Clerk and in accordance with the proposal of said contractor and under the terms of said contract, all of which are hereby referred to and made parts of this ordinance. Section 3. That temporary notes signed by the jAayor and attested by the City Clerk be issued from time to time as the work progresses in the manner and form as requ red by law, the total amount thereof not to exceed the contract price for such work, such notes to bear interest at not to exceed 4 1/2 per cent per annum and to mature not later than March 15th , 19_49 , andd to be issued in such amounts and at such time as money for the payment of the cost of such notes to be issued to said contractor and to be redeemed and cancelled at the time that per- manent bonds are issued in lieu therof. 1 Section 4.
