5272 Construct Swimming Pool- - - _ ORDl I'AI CE id0. 5272 (Published in the Salina Journal 1948) AN ORDI (A10E ratifying and confirming a contract with Brown and .Brown Construction Company, Inc., for the construction and installation of a swimming pool and appurtenances with a Chem -co Chlorinator asprovided by Resolution No. 984, and providing for the issuance of tempoeary notes to pay the cost thereof pending the issuance and sale of bonds. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:. Section 1. That the acceptance by the City of Salina, of the proposal of Brown and Brown Construction Company, Inc., hereinafter referred to as the "contractor" as submitted to the Board. of ConLmissioners onJanuary nth 1948, vmich is hereby Found to be the lowest and best bid for such work, and the contract awarded by the Board of Cormaissioners of said city to said contractor and signed on behalf of the i city by its T,?ayor on January 12th 1.048, for the construction of certain public ir-iprovements in the City of Salina, to -wit: Construction of a swimming pool in the County Park of said city and installation of all appurtenances as provided by Resolution No. 984, at and for the unit prices for said work contained in :raid proposal, which proposal and contract are hereby referred to and made parts of this ordinance, be and the same i is hereby ratified and confirmed, said proposal being within the estimated cost of said improvements as shown by the sworn estimates of the City EnLineer on file in the office of the City Clerk, which estimates are hereby referred to and made a part of this ordinance. Sedtion 2. Said improvements shall be built and constructed in accordance with the plans and specifications therefor prepared by the City Engineer on file in the office of the City Clerk and in accordance with the proposal of said contractor and under the terms of said contract, all of which are hereby referred to and i.ade parts of this ordinance. Section 3. That temporary notes signed by the r.a7,•or and attested by the City Clerk be issued from tii.e to time as the work progresses in -the manner and form as rec+uired by law, the total amount thereof not to exceed the contract price for such work, such notes to bear interest not to exceed 41 per cent per annum and to mature not later than January 15th 1950 , and to be issued in such amounts and at such title as money for the payment of the cost of such work may be required, such notes to be issued to said contractor and to be redeemed and cancelled at the time that permanent bonds are issued in lieu thereof. Section 4. This ordinance shall take effect and be in force from and after sr — its publication in the official city paper.
