ORDINANCE NUMBER 91-9449
AN ORDINANCE PROVIDING FOR THE VACATION OF CERTAIN
STREET RIGHT-OF-WAY ON CHEROKEE DRIVE, ADJACENT TO A PORTION OF
BLOCK ONE (1), BANKER ADDITION TO THE CITY OF SALINA, SALINE
COUNTY, KANSAS.
Kansas:
BE IT ORDAINED by the Governing Body of the City of Salina,
Section 1. That a portion of street right-of-way of CHEROKEE
DRIVE, adjacent to Block One (1) , Banker Addition to the City of Salina, Saline
County, Kansas, and more partidularly described as follows:
A tract of land beginning at the platted intersection of the
South right-of-way line of Crawford Street and the East
right-of-way line of Cherokee Drive;
Thence on an assumed bearing of North ninety degrees zero
minutes zero seconds West (N9000010011W) a distance of one
hundred and seventy-one hundredths feet (100.711), said
bearing being an extension of the South right-of-way line of
Crawford Street;
Thence South zero degrees zero minutes zero seconds West
(S0010010011W) a distance of ten and twelve hundredths feet
(10.12');
Thence along a curve with a chord bearing of South
twenty-seven degrees thirty-nine minutes twenty-four
seconds West (S27039124"W) a radius of one hundred nine
and sixty hundredths feet (109.601), and a central angle of
fifty-two degrees six minutes sixteen seconds (52006116"), a
distance of ninety-nine and sixty-seven hundredths feet
(99.671) to a point on the East right-of-way line of Cherokee
Drive;
Thence along a curve with a chord bearing of North fifty-six
degrees forty-three minutes fifty-three seconds East
(N56143'53"E), a radius of one thousand ninety feet (1,0901)
and a central angle of five degrees sixteen minutes
twenty-four seconds (5016124"), said curve being the East
right-of-way line of Cherokee Drive, a distance of one
hundred seventy-three and ninety-five hundredths feet
(173.951) to the point of beginning, said tract contains
3,622.86 square feet, more or less.
is hereby vacated.
Section 2. That the above described portion of street right-of-way on
CHEROKEE DRIVE which is vacated by this ordinance, shall be retained as a
utility easement.
Section 3. That the above described portion of street right-of-way on
CHEROKEE DRIVE which is vacated by this ordinance, shall revert to the
adjacent property owners in accordance with K.S.A. 13-443.
