That the acceptance by tI_.e City of Salina, of the proposal of Brown and Brown Construction Ce-ipr::y, Inc., hereinafter referred to -as the "contractor" as submitted to the Board of Commissioners on July llth,1949, which is hereby found to he the lowest and best bid for such work, and the contract awarded by the Board of 'ommis- sioners of said citsr to saidcontractor and signed on behalf of the cit,, by its Mayor on i July 18, 1949, for the construction of certain public improvements in the City of Salina, to -wit: (1) Pavirg and gradinrr of a certain north and south public alley betw=en Twelfth Street and Thirteenth Street from the south line of "ishop S+reet south to the south line of Lot 6, ext::nded west, on Twelfth Street, in 'cleavers .Addition, as provided :�y Ordinance Number 5388. (2) Paving and grading of a certain public alley lying between `tenth Street and Eleventh Street, from the south lin-,, of V+oodland Av.nue, thence south 2�,U feet, as provided by Ordinance Number 5388. at and for the unit prices for said ,%ork contained in said proposal, which proposal and contract are hereby referred to and made parts of this ordinance, be and the same is hereby ratified and confirmad, said proposal being within the estL'a ted cost of said im- provements as shmvn by tha sworn es-limates of the City Engineer on file in the office of tha City Cler]; which estimates are hereby referred to and made a part of this ordinance. SECTION 2. Said improvements shall be built and constructed in accordance with the plans and specifications therefor prepared by the City Engineer on file in the office Of the Cittr Clerk andin accordance with the pronoaal of said contractor and under the terms of said contract, all of which are hereby referred to and made parts of this Ordinance. UNCTION 3. That temporary notes sinned by the Mayor andattested by the City Clerk be issued from time to time as the a,ork promresses in the manner and form as required by law, the total mount thereof not to exceed the contract price for such work, such notes to bear interest not to exceed 4-,21-- per cent per annum and to mature not later than ovember lst, 1950, and to be issued in such amountsa nd at such time as money for the payment of the cost of such work ma•.- be required, such nates to b e iwsued to s aid contractor and to be re- deemed and cancelled at the time thattperm>nent bondsare issued in lieu thereof. SECTION 4. This Ordinance shall take effect and be in force from and afterits publication in the official city paper.
