AN ORDINANCE creating and defining a certain Main Sewer District in the City of Salina,
designating as Dain Sewer District "X"= providing for the construction of a Main Sewer in
said district; providing for the payment of the cost thereof and forthe buying of special
assessments against the property in such district for the payment of such cost, and for the
issuing of bonds therefor.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas.
SECTION 1. Dain Sewer District "X". That there be and there is hereby created,
a Main Sewer District in the City of Salina, Kansas, which shall be designated as Main
Sewer District "X", which shall include all of the following described property in said
city, to -wit:

Lots 5 to 42, inclusive, in Block 2 and all of Block 3, in VanTrine
Addition, BlockS4 and 5, 4'Jood's Replat of Blocks4 and 5, 9onds Addi-
tion, Block 6, Bonds Addition, Block 1, Surveyors Plat "F", Blocks
1, 2, S, 4, 5 and 6 Gb1lege View Addition, -locks 3,4,5 and 6, Hutch-
insoHs Addition, Blockd 6 and 7, Sunnyside Addition, Renlat of Blojoks
4 and 5 Sunnyside Addition, all of Morningside Addition, and the
Northwest Quarter (RTWq) of the Northeast Quarter (REQ) of Section
24-14-3, all said additions plats and land being to andin the City
of Salina, Saline Qn=ty, Kansas.
SECTION 2. That it is necessary and it is hereby ordered that a Mdn Sewer District
together with all necessary connections, manholes and other appurtenances, be constructed
and built as Main Sewer District "X", along the following described course within said dis
trict, as follows:
An 18inch clay pipe sewer be,, -inning at a manhole to be constructed
at the i*ersection of Prescott Avenue and Second Stre::t; thence
east to the intersection of Prescott Avenue find Front Street; thence
south easterly in the center line of Front Street to the i6ersection
of the Center line r of Crawford Avenue end Front street; thence west
in the center line of Crawford Avenue to the c:intersection of the center line
of Crawford =venue and the center line extended north of the alley next east
of Second Street; thence south in the center line of said alley_ to the
center line of Bond Street; where a manhole will be constructed at
which place sai& main will branch into Line "A", proceeding west, and into
Line "B" proceeding east. Said Line "err will be a 15 inch Olay nipe sewer t
beginning at said manhole in Bond Street a,-oresaid; thence west 830
feet, rAore or less, to a point :-hich is20 feet west of the east line
of Fourth Street; thence south in said fourth Street as a 12 inch clay
pipe sewer 1940 feet, more or less, to the center lineof alley next
north of Beloit Avenue where a manhole will be constructed, being
terminus of said Line "A. Said Line "B" will begin ati he said manhole
to he constructed in the center line of Bond Street and the extended
centerline of alley next east of Second Street; thence east 160 feet,
more or less, to the center line of Front Street; thence south in the
centerline of FroY✓Street 1580 feet to a manhole to be constructed which
willbe the terminus of said Lire "-"%
SECTION 3. That the Cit- Engineer shall on or before the 15th day of-_
August , 1949, prepare and file in the office of the City Clerk plans and specifica-
tions for the construction of the 'd L +e n in

section of this ordinance, which shall be of the proper character and along the proper
course and at t, -e nroner grade to serve the nroer--y lying within the district within
which such sewer is to be constructed, and shall on or before said date, prepare and
submit to the Hca rd of "ommissioners detailed estimates, under oath, of the cost thereof,
that thereafter the City Clerk shall advertise for three conseeutve days in the city
paper for sealed prorasals, for the building and construction of such sewer according to
such plans and specifications, which proposal sh:3,ll be filed with t^e City Clerk on or
before the time fixed in, such notice at which time the =ord of Commissioners may let a

contract for the building and construction of such sewer to the lowest responsible bidder

of bidders t'ierefor; provided that the cost th reof shall not exceed the estimated cost
thereof and proviabd that said Board shall reserve the right to refuse any and all such
proposals; and that if no responsible bids sh-11 be received within said estimated cost,
said Board may proceed and build such sewer within such estimated cost.
SECTION 4. That for the cost of building and constructing such a sewer, special

assessments shall be made for the full cost ther®of, on all lots or pieces of land within

the Main Sewer District within the which such main sewer shall be built, according to the
appraised value thereof, without regard to the improvements or buildings thereon.
SECTION 5. After the passage and publication of this ordinance, the .Board
of Commissioners shall appoint three desinterested appraisers who after having taken an
oath to make a true and i.upart kl appraisement of all lots or pieces of land lia-%,le to
taxation for the cost of such improvements, shall within five da --s aft;r having been
notified of their appointment proceed to appraise all of the lots or pieces of land with-
in such district, liable to assessment and taxation as aforesaid, without rego.rd to the b
buildings or improvement's thereon, and after makein said appraisements shall return the
same to thj Board of Commissioners of said city andssaid Board shall designate a time for
holding a special meeting Of said Board for the purpose of hearing any complaints that
may be made as to the ttlue of any lot or piece of land appraised as aforesaid, or which
Special session due notine shall be given in the official city paper, and at which special
session said Board may alter any $aluation of any lot or piece oflsnd, if, in, their opinion
the same had been appraised too high,too low.
`ECTION 6. The special assessments herein provided for may be paid by the person
gents that are to be collected from the speciflic property dhargeable with said improvement,

liable therefor in four approximately equal annual installments but the owner of any prop-
erty liable to such assessment may within thirty days from the date of detarming the
amount assessed against his property pay the same in full and his property shall not be

liable for any assessment for the cost of such improvements and -ponds as herein after pro-
vided for shall ,)e issued for the amount of the cost of such improvements remaining unpaid
at the end of thirty days from the time such assessment is fixad.
SSCTION 7. For the purpose of paying for the stork and improvements in this
ordinance provided for, the board of Commissioners are hereby authorized and directed to
issue im:,rovement bonds of the 6ity of Salina in an asrount not to exceed the cost of such
improvement, and to run for a pefLbd of four years _.nd be 'payable in four approximately
equal amnual installments, tpgether with interest not to exceed five per cent per annum ,
which bonds shall be issued and payable according to law; and for the purpose of >a ying

to each tract, niece or parcel of land within the taxing district and ftll state a e the number
of annual installments in which such tax to be collected; and thereafter the City Clerk
shall annually, at the same time other taxies are certified, certify to the Countv Clerk
of Saline County, Kansas, R full list of all property liable for such work and improvements,
to,o�ether with the respective amounts due on each said tracts, piece or 13arceLi of land, Which
amounts shall include the annual installments and interest on all unpaid balances for the
one year at the rate of not to exceed five percent per annum, on such amounts so
certified, which shall be collected as other taxes are collected.
SECTION 8. This ordinance shall take effect and be in fullforce from and after
its publication in the official city paper.
