AN ORDINANCE providing for the curbing, ;uttering and grading of Fifth_ Street from the
north line of Antrim Avenue to the cener li-e of Otis Avenue; for the curbing, guttering

in the Citz7 of Salina, being approximately 453 feet north and south; and providing for the
payment of t h cost thereof, and how the same shall be assessed and the aAnner ofpayment
thereof.
WH_�=,AS, by Resol.:tions Number 1091, 1089, 1088, 1103. 1090, and 1092, duly adopted on
March 28, 1949; 3da.rch 28, 1949; hiarch 28, 1� 49; Aprill 11, 1949; march 28, 1949; and
March 28, 1949, respectively, the Board of Commissioners of the City of Sali_A have declared
that they deem it necessary to durb, gutter, and grade each;- Fifth Street from the north
line of Antrim Avenue to the center line of Otis Avenue; Grar:d Avenue from thewest line
of Tenth Street to the west line of Eleventh Street; Illimmis Street from thewest line
of Sheridan Street to the el,st line of Merrill S+reet and for Illinois Straet from the
west ling of Merrill Street to the east lineof Hancock Street; Kirwin Avenue from the west
line of Pershing Street to the center line of Lincoln Street to the center line of
Broadway boulevard; Third Street from thenorth line of Republic Avenue to tine so,th line
of Lot 13, projected west, Blx k 5 in Hutchinson's Addition to t^e City of Salina, being
approximately 453 feet north and south.
WHEREAS, each of said resolutions were duly published for as days in the Salina Journal,
a daily newspaper published in said cit;, and being the official city paper, and the majority
of the resident property owners owning a majority in square feet of the lots or real estate
liable to taxi&ion for the cost of said improve ents did not within twenty days from the
date of the last publication thereof file with th:City Clerk a sufficient protest, in
writing, against the making of said improvements, no protests of any kind having been
filed;

B_? IT ORDAINED by the Board of Com.issioners of the City of Salina, Kansas:
Section 1. That it is necessary and it is hereb,.T ordered that Fifth Street from
the north line of Antrim Avenue to the canter line of Otis Avenue, in said city be curbed
and guttered with excavation necessary therefor and graded and to t_he established paving
grade to each side thereof, as may be necessar, for the completion of said work.
Section 2. That it is neeessary and it is here y ordered that Grand Avenue from the
west line of Tenth Street to the west line of Eleventh Street, in said city be curbed and
guttered with thaexcavation necessary therefor and graded to the established paving ;rade
to each side thereof, as may be necess-r y for the completion of said work.
Section 3. That it is necessary andit is hereby ordered th t Illinois Street from

the west line of Sheridan Street to the east line of Merrill Street and Illinois Street
from the west line of kerrill Street to the east line of Ha_rcock Street, in said city be
curbed and guttered with excavation therefor, and graded to the established paving grade
to each side thereof, as may be necessary for t h-- completion of said work.
Section 4. That it is necessary and it is hereby ordered that Kirwin Avenue from
the west line of Pershing Street to the center line of Funston Street, in said city, be
curbed and guttered with the excavation necessary therefor, and g-aded to theestablished

paving grade to each sii thereof, as may be necessar-,r for the completion of said work.
Section 5. That it is necessary and it is hereby ordered that Reynolds Street from
the center line of Lincoln Street to the center line of Broadway Boulevard, in said city,
be curbedend guttered with excavation necessary threfor, and graded to the established
paving grade to each side thereof, as may be necessary "or the completion of sad work.
Section 6. That it is necessary end it is hereby ordered th>t Third Street from
the north line of Republic Avenue to the south line of Lot 13, projected west, Block 5
in Hutchinson's Addition to the ''it_r of Salina, being approximately 453 feet noth and south
in said city be curbed and guttered with excavation therefor and graded to the established
paving grade to each side thereof, asmay be necessary for the completion fo said work.
Section 7. For the work improvements herein provided for the City Engineer shall
make and file with the City Clerk on or before the 20th day of June 1949,
complete plans and specifications for the curbing, guttering and grading(with excavation
necessary therefor) of each of thestre;ts or portions thereof described in S-ctions lto 6,
both incl?.sive of this ordinance, with the following type of improvements:
Concrete combined curb and gutter on each side
thereof 30 inches wide 'rom back of curb to paving
line, curb 12 inches deep at back, gutter 6 inches
deep; and the necessary grading of each to the
established paving grade between the cur's and gutter
lines on each side thereof and within the limits of
said streets hereinbefore described.
and said Engineer shall on or before the same date, submit to the Board of Commissioners
under oath, ddailed estimates of the coat of such work for such improvements.
Section 8. That aftersuch plans and specifications shall have been made and prepared
by the City Engineer and filed with the City Clerk as aforesaid, the Board of Commissioners
may advertise by advertisement published in the official city paper of the amity of Salina

Kansas, for three consecutive da-rs for the receipt of sealed proposals forthe improving
of said streets with the knid of material named and specified in thepreceding sections
hereof, and for the excavation and grading necessary for the completion of such work, and
after the receipt of such proposals the said Board of Commissioners may[ and are hereby
authorized to let contracts for the improving of said streets with the material selected
by them to the lowest respphsible bidd r or bidders therefor, as determined by said
Board of C mmissioners and for such excavation and grading. Said Board of Commissioners
reserve the right to reject any and all rids.
Section 9. That for the improving of the above mentioned streets such assessments
shall be made for the full costs thereof according to law, on all lots and pieces of
landto the center of the block on either or both sides of the streets to be impro ed ac-
cording to the appraisers' valiation thereof witholit regard to the buildings or improve-
ments thereon for he distance to be improved.
Sect:_on 10. After the passage of and publication of this ordinance, the board of
Commissioners shall appoint three disinterested appraisers, householders, who after

having taken an oath to made a true and impartial appraisement for all lots and nieces of
land liable to assessments and taxation for the cost of the improvements herein pro-
vided for, shall within five days from hav-i.-g been notified of their appointment, proceed
to appra.i.se said lots and pieces of land liable to assessment and taxation as aforesaid,
as may be desiCna.ted by the Joard of Commissioners of said city and said Board of
Cormmission.ers shall designate a time and a place for the hearing of ani• complaints th t
may be made as to the value of any lots or pieces of land appraised as aforesaid, of

which due notice shall be gaven in the official city paper, at which hearing the Board
of Commissioners may alter any valuation of any lot or piece of land, if, ir. their opin'on,

Section &I. That for the purpose of paying the cost of the work and improvements
in this ordinance, provided for, the Board of commission-rs are hereby authorized and
directed to issue internal improvement bonds of the City of Salina in an amolmt not to
exceed the contract price or cost of such improvements and to rn fora period of four years

and be payable in four equal installments, together withinterest to not exceed five
per cent annum, which bonds shallbe made payable at the Fiscal Agency of the State of
Kansas, and for the purpose of crying principal andinterest on said bonds as they severally
become due and payable, the board of Commissioners shall apportion and assessagainst the
lots and pieces of land within thetaxing district of such improvements, special assessments

covering the cost of such improvements and the apportionment herein contained shall hold
good for all the installments that are to be collected from the specific property charge-
able withsaid improvement. Such assessment and apportionrient ordinance shall contain the
total amount of tax apportioned toeach tract, piece and parcel of land within the taxing
district and shallstate the number of annual installments in which such tax is to be col-
lected; and thereafter, the City Clerk shall annually, at the same time other taxes are
certified, certify to the County Clerk of Saline County, Kansas, a full list of all
property liarle to such work and improvement, together with the respective amounts due on
j each of said tracts, pieces of land, which amounts shall include the annual installments

and interest on all unpaid balances for one year at the rate of not to exceed five per
cent per annum, on such amounts so certified whichshall be collecte as others taxes are
collected; PHOV IDLD. that for th purpose of defraying the cost of improving the
intersections and areas fromed by the cross*I.r.g of streets and alleys, and for the grading
of said street where the same is rrovided for in this ordinance as well a s where the im-
provement is through or adjacent to property of the city for which the City is liable,

the assessment will be made against all taxable property of the cit« and paid by the
city at large.
Section 12. That this ordinance shall take effect and be in force from and after
its p blication on e in the officail ci,y paper.
