5389 Street ImprovementsORD Y1ANCE OMER - 5389— _- =19OWN=Published in the Salina Journal AN ORDINANCE providing for the curbing, guttering, paving and grading of Reynolds Street from the center line of North Street to the center line of Lincoln Street; and for the curbing, guttering, paving and grading of Seventh Street from the center line of Decatur Street to the center of Grand Avenue; and the curbing, guttering, paving and grading of Tenth Street from the north line of Woodland Avenue to the south line of Broadway Boulevard,' and providing for the payment of the cost thereof, how the same shall be assessed, and the manner of the payment of the cost thereof. WHEREAS, by Resolutions Numbers 1093, 1076, and 1098, duly adopted on earth 28, 1949; October 18, 1948; and April 4,1949, respectively, the Board of Commissioners of the City of Salina, Kansas, have declared that thejr deem it necessary to curb, gutter, pave and grade each: Reynolds Street from the center line of North Street to the center line of i Lincoln Street; Seventh Street from the center line of Decatur Street to the center line of Grand Avenue; Tanth Street from the north lineof V"loodland Avenue to the south line of Broadway Boulevard, all together with such excavation and grading as may be necessary and for the grading of each thereof. WHEREAS: each of the said resolutions were published for six days in the Salina Journal a daily newspaper published in said city, and being the official city piper, and the major - of the resident property owners awning a majority of square feet of the lots or real estate liable to taxation for t -,-,e cost of said improvement did not within twenty days from the date of the last publication thereof file with the City Clerk a suffieient protest in wri.tin� against the making of said improvements, no protests of any kind having been filed; NOW THEREFORE, BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: SECTION 1. That it is necessary and it hereby ordered that Reynolds Street from the center li1:e of North Street to the center line of Lincoln Street, in said city be curbed, guttered, with excavation necessary therefor, and graded to the established paving grade and paved between the guttering lines thereof. SECTION 2. That it is necessary and it is hereby ordered tht Seventh Street from the center line of Decatur Street to the center line of Grand Avenue., in said city be curbed, guttered, with excavation necessary therefor, and graded to the established paving grade and raved between the guttering lines thereof. SECTION 3. That it is necessary and it is hereby ordered that Tenth Street from the north line of Woodland Avenue to the south line of Broadway Boulevard, in said city be curbed and guttered, with excavation necessary therefor, and graded to t dgtablished paving grade and paved between the guttering lines thereof. SECTION 4. That for the work and improvements herein provided for, the City Engineer shall make and file with the City Clerk on or before the 20th day of June , 1949, complete plans and specifications for the curbing and guttering, paving and grading with excavation necessary therefor, of each of the streets or portions thereof described in Sections 1 to 3, both inclusive, of this ordinance, with the following type of improvement: Concrete combined curb and gutter on each side thereof, 30 inches wide from back of curb to paving line, curb 12 inches deep at back, gutter 6 inches deep; and the nec- essary grading of each to the established paving gr<�.de, and the paving thereof with six-inch reinforced concrete between the ourb andutter lines g on each side thereof and within the limits of said streets hereinbefore pres- eribed; 5 , and said Engineer shall on or before the same date, submit to the Board of Commissioners under oath, detailed estimates of the cost of such work and improvements. SECTION 5: That after such plans and specifications have been made and prepared by the Cit Engineer �°• City neer and filed with the City Clerk as aforesaid, the Board of Commissioners may advertise by advertisement published in the official city paper of the"ity of Salina, Kansas, forthree consecutive dad -s for the receipts- of sealed proposals f.or the improving -- of said streets with the kind of material named and specified in the preceding sections hereof, and for the excavating and grading necessary for the completion of such work,and after the receitp of such proposals, the said Board of Commissioners may and are hereby authorized and directed to let contracts for the improving of said streets with the mater- ials seteeted by them to the lowest responsible bidder or bidders therefore, as determined by said Board of Commissioners, and for such excavation and grading. Said Board reserves the right to reject ant and all bids. SECTION6; That for the improving of the above mentioned streets, such assessments shall be made for the full costs V ereof according to law, on all lots and pieces of land to the center of the block on either side of the streets to be improved according to the appraiser's valuation thereof, witho,t regard to the buildings or improvemerts thereon for the distance to be improved. SECTION 7: After the passage and publication of this ordinance, the Board of Com- missioners shall appoint three disinterested appraisers, householders, who after having takenan oath to make a true and impartial a raisement pp of all lots andfeces of land and liable to assemsment and taxation as aforesaid, as ma,,.- be disignated by the Board of Conanissionerg of said city, without regard to the buildings or improvements thereon and after making such appraisment shall return the same to the Board of Commissioners of said city and said Board of Commissioners shall designate a time and place for the hearing of any complaints th t may be made as to the vale of an.r lots or pieces of land appraised as aforesaid, of which due notice shall be giTM in the official city paper, at which hearing the Board of Commissioners may alter anyvalueation of any lot or piece of land, if, in their opinion, the same has been appraised too high or too low. SECTION 8: That for the purpose of paying the cost of the weak and improvements in this ordinance provided for, the Board of Commissioners hre hereby authorized and directed to issue internal improveme:ht bonds of th_� City of Salina in an amount not to exceed the contract price or cost of such improvemeits andto run for a period of ten years and be payable in ten equal installments, toget e-, with interest not to exceed five per cent annum, which bonds shall be madeiayable at the Fiscal Agency of the State of Kansas, and for the purpose of Paying principal and interest on said bondsas they severally become due and payable, the Board of Commissioners shall apportion and assess against the lots and pieces of lnd within the taxing distridt of such improvements special assessments covering the cost of such improving and the apportionment herein contained shall hold good for all the installygents that are to be collected from the specific 1 1 property charLeW le with ..;A ' ai improvements. ouch assessment and apportionment ordinance i shall opatain the total amounts of tax apportioned to each tract, piece or parcel of land within the taxing district and shall state the number of annual installmats in which such tax is to be collected; and thereafter the city clerk shill annually, at the some time other taxez are certified, certify to the County Clerk of Saline County, Kansas, a full list of all property liable for such work and improvements, together with the respective amounts due on each of said tracts, pieces'of]and , which amojnts shall include the annual installments and interest on all unpaid balances for one ,year at the rate of not to ex- ceed five per cent annum on such amounts so certified which shall be collected as other taxes are collected: PROVIDED, that for the purpose of defraying the cost of improving the intereeftions and areas formed by the crossing of streets and alleys, and for the grading of said streets where th same is provided for in this ordinance as well as where I the improvement is throught or adjacent to property of the City"for which the city is liable, the assessments will be made against all taxable property of the city and paid by the city at large.
