5388 Alley Improvements Weaver's Addition- -- --- -- - ORDIIMNCE NJIviBER 5388 - (Published in the Salina Journal , 1949) AN ORDINrME providing for the paving and grading of a certain north and south public alley between Twelfth Street and Thirteenth Street from the south line of Bishop Street south to the south line of Lot 6, extended west, on Twelfth Street, in Weavers Second Addition, and providing for the paving and grading of a certain alley lying between Tenth Street and Eleventh Street, from the south line of Woodland Avenue, thence south 200 feet, and providing for the cost thereof, how the cost thereof shall be assessed and the manner of payment thereof. ifi"MEAS, by Resolution Number 1075, duly adopted on October 11, 1948, the Board of Commissioners of the City of Salina, which deemed it necessary to pave a certain north and south public alley between Twelfth Street and Thirteenth Street from the south line of Bishop Street south to the south line of Lot 6, extended west on Twelfth Street, in Weavers Second Addition, together with such excavation and otherwise improving as may be necessary therefor; and Y'z REAS, by Resolution Number 1099, duly adopted April 4, 1949, the Board of Commissioners of the City of Salina have deemed it necessary to pave a certain public alley lying between Tenth Street and Eleventh Street, from the south line of Woodland Avenue, thence south 200 feet, together with such excavation and other- wise improving as may be necessary therefor; and 01HEREAS, said Resolutions were duly published for six days in the Salina Journal, a daily newspaper published in said city and beim the official city paper, and the majority of the resident property owners owning a majority in square feet of the lots and real estate liable to taxation for the cost of said improvements did not, within twenty days from the date of the last publication: thereof, file with. the City Cla'k a sufficient protest in writing against the making of such improvements, and no protests of any kind having been filed; NGVT, THEREFORE: BE IT ORDAINED BY THE BO:�.RD OF CM-11ISSIO.TTRS OF THE CITY OF Si LINA, LUISAS: Section 1. That it is necessary and it is hereby ordered that a certain north and south public alley between Twelfth Street and Thirteenth Street from the south line of Bishop Street south to the south line of Lot 6, extended west, on Twelfth Street, in Weavers Second Addition, to the City of Salina, Kansas, be paved and that said alley within such limits be excavated and graded and otherwise improved to such an extent as may be necessary for the completion of said work. Section 2. That it is necessary and it is hereb- ordered that a certain public alley lying between Tenth Street and Eleventh Street, from the south line of I j ffoodland Avenue, thence south 200 feet, be paved and graded and that said allsy within such limits be excavated and graded and otherwise improved as may be necessary for the completion of said work* Section 3. That for the worik and improvements heretofore provided for, the City Engineer shall make and file with the City Clerk on or before the 20th day of June , 1949 complete plans and specifications for the Having of certain public alleys described in the preceding sections of this ordinance, and for such excavation and grading and otherwise improving, as may be necessary there- for, and shall, on or before the same date, submit to the Board of Commissioners of the Cit;, of Salina, Kansas, under oath, detailed estimates of the cost of such work for such improvement. Section 4. That after such plans and specifications shell have been i made and prepared by the City Engineer and filed with the City Clerk as aforesaid. I the Board of Commissioners may advertise by advertisement published in the official city paper of the City of Salina , Kansas, for three consecutive days for the receipt Of sealed proposals for the improving of said public alleys with the kind o f I materials named and specified in the preceding sections hereof, and for the excavating and gradin,, necessary for the completion of said work; and after tele receipt of such proposals the said Board of Commissioners may and are hereby authorized to let contracts for the improving of said public alleys with the material selectid by them to the low- est butler or bidders therefor, as determined by said Bo,rard of "ommi-sioners, and for r7 tio!� and grading. That for the improving of the above mentioned public alleys, Fpecial assessments shall be made for the full cocas thereof according tc law, on all lots and pieces of land to the center of the block on -i.ther side of the said public alleys to be improved, according to the appraisers' valuation thereof, without Iregard to the buildings or improvements thereon for the distance to be improved. Section 6. After the passage and publication of this ordinance, the Board of Commissioners shall appoint three disinterested appraisers, householderc, who after havir:b taken an oath to make a tune and impartial a.ppraisezrent of all lots and i pieces of land liable to assessment and taxation for the cost of the improvement j herein provided for r1all, within five days after having been .notified of their appointment, proceed to appraise said lots andpieces of land liable to assessment and ta.xa.tion as aforesaid, as may be desiEnated by the Board of Col-ard.s icners 0 said City, without regard to the buildings or improvem,;ents thereon; and, after making said appraise;ment, shall return the same to the Board of Commissioners of said City and sbAd Board shall designate a time and place for the hearing of any complaints that may be made as to the value of any lots or pieces of land appraised a.foresiad, of i which due notice shall be given in the official city paper, at which hearing the Board of Cornmissionors may alter any valuation of any lot or piece of land, if, in I their opinion, the same has been appraised too high or too low. Section 7. That for the �purpose of payin„ the cost of the work and i improvements in this Ordinance provided for, the toard of Commissioners are hereby authorized and directed to issue internal improvements bonds of the, City of Salina in an amount not to exceed the contrac?; trice or cost of such improven.ent,s and to run for a period of ten years and be payable in ten equal installments, togchter with interest not to exceede I five per cent per annum, which bon,'s shall be made payable at the Fiscal Agency of the State of Kansas; and i for the purpose of paying principal and interest on said bonds as they severally become due and payabls, the Board of Commissioners shall apportion and assess against i the lots and pieces of land within the tax_nl; district of such improver:en, and i the apportionment therein contained shall hold good for all, the installments that i are to be collected from the specific property chargeable with said improvements. Such assessment., and apportionment ordinance shall contain the total amount of tax apportioned to each tract, piece or parcel of land within the taxing district and i shall state the number of annual installments in which such tax is to be collected; and, thereafter the City Clerk shall annually, at the same time other taxes are coertified, certify to the County Clerk of Saline County, Kansas, a full list of all property liable for such work and improvement, togehter with the respective amounts due on each of said tracts, pieces and parcels of land, which amounts shall include the annual installments and interest on all unpaid balances for one year at the rate of not to exceed five per cent per annu, on such amounts so certified which shall be collected as other taxes axe collected; PROVIDED , that for the purpose of defraying the cost of improvin;- the intersections and areas formed by the crossing of streets and alleys, and for the grad3hng of said public alleys where the improvement i is through or adjacent to property of the City for *hhch the City would be liable, the assessment will be made against all taxable property 66 the City and paid by the City at large.
