5387 Utility Improvements Stack Place Addition- - - — -- - - - - ORDINANCE_ NUMBER -- 587 - __-fit Published in the Salina -Journal 1949 AN ORDINANCE creating and defining a certain lateral sanitary sewer district in the l city of Salina, Kansas, designated as Lateral Sanitary Sewer District Number 243", and providing for the construction of a Lateral Sanitary Sewer in said Lateral Sanitary Sewer in said Lateral Saintary Sewer District Number 243, so created, and providing for the payment of the cost thereof and for the levying of special assessments against the property in said district for the payment of the cost of such construction of and for the issuing of bonds to pay the cost thereof. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Sanaa: Section 1. Lateral Sanitary Sewer District Number 243. That there be and there is hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer District Number 243 and which district shall include all the following described property in the City of Salina, Kansas, to -wit: All of Lots 7 to 28 inclusive in Block 2, Stack Place Addition to the City of Salina, Saline County, Kansas. Section 2. It is necessary and it is hereby ordered that an eir"ht inch V C. P. lateral sanitary sewer with all necessr:ry connections, manholes, flushing tanks, and other appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District Number 243 as created by Section 1 of this ordinance along the following course, to -wit: An eight inch clay pipe sewer, beginning at an existing manhole in alley first south of Gypsum Avenue and between Connecticut Avenue and Delaware Avenue; thence south in north and south alley first east of Connecticut Avenue 5u0 feet to the center line of Stack Avenue to a manhole to be constructed being the termines thereof. Section 3. That the City Engineer shall on or before June 20th ,1949 prepare and file in the office of the City Clerk, plans and specifications for the construction of the ltera.l sanitary sewer provided for in the preceding,sections of this ordinance whish shall be of pmper character to serve the property lying within the dis- tict which such sewer is to be constructed and shall on or before the same date prepare andsubmit to the Board of Commissioners a detailed estimate under oath of the cost there- of. That he eafter the City Clerk shall advertise for three consecutive days in the offiaal city paper for sealed proposals for the building and construction ofsuch sewer according to such plans and specifications, whish proposals shall be filed with the City Clerk on or before the time fixed in such notice, at hich time the Board of Commissioners may let a contract for the building and construction of such sewer to the lowest and best r ewp on s ib l e bidder or bidders therefor, if there be any whose bids do not exceed the estmated cost thereof, but said Board shall reserve the right to reject any ora 11 such proposals, and if not bid shall be received within such estimate, the Board of Commissioners shall have the poz,:er to do such work and make such improvements within the estimated cost thereof as provided by law. Section 4. That for the cost of building and c-n:tructing such sewer,special assessments shall be made for the full cost the,-eof on all1ots and pieces of land within and for which such sewer shall be built, according to the appraised value thereof, whth out regard to the improvemeits or buildings thereon. 1 11 Section 5. After the passage and publication of this ordinance, the Board Commissioners i shall appoint three dis-Interested appraisers, who aftr havin, taken an oath to make a true and impartial appraisement of a lllots and pieces of land to taxation for th:.,cost of such improvements, shall within five dads after having been notified of their appoint- ments proceed to appra.se all of the lots andpieces of land within such district liable to assessment andtaxation as aforesaid, without regard to the buildings or improvements thereon, and aftar making such appraisement shall return to the Board of Commissioners of said eitt= and said Board shall designate a time for a special meeting of said Board for the purpose of hearing any complaints th t may be made as tothe value of any lot or piece of land appraised as aforesaid, or which special session due notice shall be given in the official city paper, and at which special session said Board may alter any valuation of any lot or piece of land if, in their opinion, the same has been appraised too high or too low. i Section 6. The special assessment herein provided for may be paid by the .)erson liable therefor in four approximately equal annual installments but the owner of any property liable to such assessment may within thirty days from the day of detarm'n.ng the amolint assessedagainst theproperty, pay the same in full and his prperty shall not be lia le for any assessment for the cost of such improvements, and bonds as hereind£ter I provided for shall be issued in the amount of the -iost of such improvements remaining umpaid at the end of the thirty days from the time such assessment is fixed. Section 7. For the purpose of paying for the work andimprovements in this ordinance Provided for. the Board of Commissioners may her.jby and are authorized and directed to issue improvements bonds of the City of Salina, Kansas, in an amount not to exceed the cost of such improvement, andoto run for a period of four years and be payable in four approximately equal annual installments, together with interest not to exceed five per cent annum, which bonds shall be issued and payable according to law; and for theurpose of paying the principal and interest on said bonds as they severally become due and payable theBoard of Commissionsrs shall apportion and assess against the lots or pietas of land within the taxing district of such improver-ents, special assessments coverin- the cost of such improvement and apportionment therein contained shall hold !rood for all of the installmeft that are to be collected from the speci is property ch rgeable with such im- provementst such assessment and apportionment ordinance shall contain t e total amount of tax apportioned to each tract, piece or parcel of land within the taxing district and shall state t he number of annual installments in which such tax, is to be collected: raid thereafter the City Qerk shall annually, at the sametime other taxes are certified, certify to the County Clerk of Saline County,Kansas, a full list of all property liable for such work and improvements, together with therespective numbered amounts due on each of said tracts, piece or parcel of land, whichamounts shall include the annual installments and interest on all unpaid balancesfor one year at the rate of not to exceed five per cent per annum, on such amounts so certified, which shall be collected as other taxes are collected.
