AN ORDINANCE ratifying and confirming a contract with the H. J. Taylor Construction
Company for the construction of certain lateral sanitary sewers in the City of Salina
heretofore designated as Lateral Sanitary Sewer Districts 236, 237, 238 and 239, and
providing for the issuance of temporary notes to pay the cost thereof, pending issuance
and sale of bonds.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas.-
Section
ansas:Section 1. That the acceptance by the City of Salina of the proposal of the
H. J. Taylor Construction Company, hereinafter referred to as the "contractor" as
submitted to the Board of Commissioners on May 16, 1949, which is hereby found to be
the lowest and best bid for such work, and the contract awarded by the Board of
Commissioners of said city to said contractor and signed on behalf of the City by its
Mayor on May 23, 1949 for the construction of certain public improvements in the City
of Salina, Kansas, to -wit:
(1) A lateral sanitary sewer in a certain benefit district,
being Lateral Sanitary Sewer Number 236, as heretofore
provided by Ordinance Number 5368, as follows: Construc-
tion of an 8" V.C.P. Lateral Sanitary Sewer, with all
necessary connections, manholes, flush tanks and other
appurtenances, beginning at an existing manhole 30 feet
west of the east line of Quincy Street and 1.28 feet north
of the north line of Minneapolis Avenue, thence east along
the dedicated easement Right -of -Way for utilities in Block
3 of Sunrise Addition to said city, 565 feet to a manhole
to be constructed at a point approximately 40 feet south-
westerly from the west line of Sunrise Drive; thence
northeasterly approximately 180 feet, in the dedicated
easement right-of-vvay for utilities in Blocks 3 and 5 of
said addition, including traversinm said Sunrise Drive,
to a manhole to be constructed, thence southeasterly in
said dedicated easement ih said Block 5, 260 feet to a
manhole to be constructed, bein` the terminus thereof;
and a branch line on the aforesaid sewer commencing at
said manhole to be constructed approximately 40 feet
southwesterly from the west line of said Sunrise Drive,
thence southeasterly 115 feet in said dedicated easement
in said Block 3 to a manhole to be constructed being the
terminus of said branch.
(2) A Lateral sanitary sewer in a certain benefit district,
being Lateral Sanitary Sewer District Number 237, as here-
tofore provided by Ordinance Number 5371, as follovrs:
Construction of an 8" V.C.P. Lateral Sanitary Sewer,
with all necessary connections, manholes, flush tanks
and other appurtenances, in Prescott Avenue, beginning
at an existing manhole which is in the center line of
Prescott Avenue and on the intersecting line with the
center line of an alley next east of Fourth Street;
thence east along the center line of Prescott Avenue
500 feet to a manhole to be constructed which will be
the terminus of said sewer.
(3) A laterolsanitary sewer in a certain benefit district,
being Lateral Sanitanr Sewer District Number 238, as
heretofore provided by Ordinance Number 5371, as follows:
Construction of an 8" V.C.p, Lateral Sanitary Sewer,
with all necessary connections, manholes, flush tanks
and other appurtenances, beginning at an existing man-
hole at the intersection of the center line of Pacific
Avenue and the center line of the alley next eaeb of
Twelfth Street; thence north along center line of said
alley 960 feet more or less to the center line of
Hamilton Avenue at which location a manhole will be
constructed which will be the terminus of said sewer.

(4) A lateral sanitary sewer in a certain benefit district,
which is Later�.l Sanitary Sewer District Number 239,
as heretofore provided by Ordinance Number 5372, as
follows: Construction of an 8" V.C.P. Lateral Sanitary
Sewer, with all necessary connections, manholes, flush
tanks and other appurtenances, being at an existing
manhole on the center fine of an alley, extended east,
next north of Kirwin Avenue and 30 feet went of the
east line of Quincy Street, thence west in the center
line of said alley 500 feet iso a manhole to be con-
structed which will be the terminus of said sewer.
at and for the unit price for said work contained in said proposal, which proposal and
contract are hereby referred to and made parts of this ordinance, be and the same is
hereby ratified and confirmed, said proposal being within the estimated cost of said
improvements as shown by the sworn estimates of the City Engineer on file in the office
of the Citi, Clerk, which estimates are hereby referred to and made a part of this ord-
inance.

Section 2. Said improvements shall be built and constructed in accordance
with the plans and specifications therefore prepared by the City Engineer on file in
the office of the City Clerk and in accordance with the proposal of said contractor
and under the terms of said contractl all of which are hereby referred to and made
parts of this ordinance.
Section 3. That temporary notes signed by the Mayor and attested by the
City Clerk be issued from time to time as the work progresses in the manner and form
as required by law, the total amount thereof not to exceed the contract price for such
work, such notes to bear interest at not to exceed 42 pet cent per annum and to mature
not later than December 30, 1950 and to be issued in such amounts and at such timeas
megey for the payment of the cost of such work may be required, such notes to be issued
to said contractor and to be redeemed and cancelled at the time that permanent bonds
are issued in lieu thereof.
Section 4. That ordinance shall take effect and be in force from and after
its public rtion once in the official city paper.
