of this ordinance which shall be of proper character to serve the property lying
within the district within which such sewers are to be constructed and shall on or
before the same date prepare and submit to the Board. of Commissioners a detailed
estimate under oath of the cost thereof. That thereafter the City Clerk shall
advertise for three consectutive days in the official city paper for sealed proposals
for the building and construction of such sewers according to such plans and
specifications, which proposals shall be filed with the City Clerk on or before
the time fixed in such notice, at which time the Board of Commissioners may let a

AN ORDINANCE creating and defining a certain lateral sanitary sewer districts in
the
City of Salina, Kansas, designated as Lateral Sanitary Sewer Districts Num-
bered 241 and 242, and providing for the construction of Lateral Sanitary Sewers
in
said Lateral Sanitary Sewer Districts Numbered 241 and 242, so created, and pro-
viding for the
payment of the cost thereof and for the levying of special assess-
ments against the property in said districts for the
payment of the cost of such
construction and for the issuing of bonds to pay the cost thereof.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1« Lateral Sanitary Sewer District Number 241.
That there he and there is hereby created Lateral Sanitary Sewer District in
the City Salina,
of Kansas, which shall be and it is hereby designated as Lateral
Sanitary Sewer District Number 241
and which district shall include all of the
following described property in the City of Salina, Kansas, to -wit
West 74 feet of Lots 1 and 2 and all of Lots 3,4,
5,6,7,8 and 9 in Block 2, West Evergreen Park
Addition to the City of Salina, Saline County,
Kansas.
Section 2. It is necessary and it is hereby ordered that an eight inch V.C.P.
lateral sanitary sewer
with all necessary connections, manholes, flushing tanks
and other appurtenances be constructed and built in
and to serve said lateral
Sanitary* Sewer District 241 as created by Section 1 of this ordinance along the
following course, to -wit:
Beginning at an existing manhole in Eleventh
Street on center line of first alley north of
Cloud Street; thence west in center line of
said alley 353 feet to the center line of
Pershing Street to a manhole to be constructed
which will be the terminus of said sewer.
Section 3. Lateral Sanitary Sewer District Number 242.
That there be and there is hereby created Lateral Sanitary Sewer District in the
City of Salina, Kansas,
which shall be and it is hereby designated as Lateral
Sanitary Sewer District Number 242 and which district
shall include all of the
following described property in the City of Salina, Kansas, to -wit:
Lots 1,2,304,5,6 and West 74 feet of Lots 7
and 8 in Block 1, West Evergreen Park Addition
to the City of Salina, Saline County, Kansas.
Section 4. It is necessary and it is hereby ordered that an eight inch V.C.P.

Section 5. That the City Engineer shall on or before June 6th

construction of the lateral sanitary sewers provided far in the preceding sections

before the same date prepare and submit to the Board. of Commissioners a detailed
estimate under oath of the cost thereof. That thereafter the City Clerk shall
advertise for three consectutive days in the official city paper for sealed proposals
for the building and construction of such sewers according to such plans and
specifications, which proposals shall be filed with the City Clerk on or before
the time fixed in such notice, at which time the Board of Commissioners may let a
contract for the building and construction of such sewers to the lowest and best
responsible bidder or bidders therefor, if there be any whose bid does not exceed
the estimated cost thereof, but said Board shall reserve the right to reject any
or all such proposals, and if no bid shall be received within such estimate, the
Board of Commissioners shall have the power to do such work and make such improve-
ments within the estimated cost thereof as provided by law.
Section 6. That for the cost of building and constructing such sewers, special
assessments shall be made for the full cost thereof on all lots and pieces of land
within the sewer districts within and for which such sewers shall be built, accord-
ing to the appraised value thereof, without regard to the improvements or buildings
thereon.
Section 7. After the passage and publication of this ordinance, the Board of
Commissioners shall appoint three disinterested appraisers, who having taken an
oath to make a true and impartial appraisement of all lots and pieces of land to
taxation for the cost of such improvements, shall within five days after having
been notified of their appointment proceed to appraise all of the lots and pieces
of land within such districts liable to assessment and taxation as aforesaid,
without regard to the buildings or improvements thereon, and after making such
appraisements shall return to the Board of Commissioners of said City and said
Board shall designate a time for holding a special meeting of said Board of the
purpose of hearing any complaints that may be made as to the value of any lots or
pieces of lend appraised as aforesaid, of which special aession due notice shall
be given in the official city paper, and at which special session said Board may
altdr any valuation of any lot or piece of land, if, in their opinion, the same has
been appraised too high or too low.
Section 8. The special assessment her Ain provided for may be paid by the
person liable therefor in four approximately equal annual installments but the
owner of any property liable to such assessment may within thirty days From the
date of determining the amount assessed against the property pay the sum in full
and his property shall not be liable for assessment for the cost of such improve-
ments, and bonds as hereinafter provided for shall be issued in the amount of the
cost of such improvements remaining unpaid at the end of thirty days from the time
such assessment is fixed.
Section 9. For the purpose of paying for the work and improvements in this
ordinance provided for, the Board of Commissioners are hereby authorized and directed
to issue improvements bonds of the City of Salina in an amount not to exceed the
post of such improvement and to run for a period of four years and be payable in
four approximately equal annual installments, together with interest not to exceed
five per cent per annum, which bonds shall be issued and payable according to law;
and for the purpose of paying the principal and interest on said bonds as they

y ome ue and payable, the Board of Commissioners shall apportion and assess
against the lots or pieces of land within the taxing district of such improvements
special assessments covering the cost of such improvement and apportionment therein
contained shall hold good for all of the installments that are to be collected from
the specific property chargeable with such improvements, such assessment and
apportionment ordinance shall contain the total amount of tax apportioned to each
tract, piece or parcel of land within the taxing district and shall state the number
of annual installments in which such tax is to be collected; and thereafter the
City Clerk shall annually, at the same time other taxes are certified, certify to
the County Clerk of Saline County, Kansas, a full list of all property liable to
such work and improvements, together with the respective amounts due on each of
said tracts, pieces or parcels of land, which amounts shall include the annual
installments and interest on all unpaid balances for one year at the rate of not
to exceed five per cent per annum, on such amount so certified, which shall be
collected as other taxes are collected.
Section ]l0. This ordinance shall take effect and be in force from and after
its adoption and publication once in the official city paper.
