5377 Sidewalk Improvement Original Town- -- -- --- -_ -._ ORDINANCE NUNBER 5-177 Pub 1 is had in the Sal ina J ournal 1949 AN ORDINANCE providing for the construction of certain sidewalks, for the payment of the cost thereof and how the same shall be assessed and the manner of payment therefor. '+SEAS, as provided by Resolution Number 1086, duly published in the official city paper on the 23rd day of March, 1949, the Board of Commissioners deter- mined the necessity of and directed the owner or owners of certain lots to construct certain sidewalks immediately adjacent to their respective lots within 45 days from said date of publication thereof; and WHEREAS, the said owner or owners, or a part of them failed to cause said sidewalks to be so constructed; and NOW', BE IT ORDAINED BY THE BOARD OF COMMISSIONERS OF THE CITY OF SALINA, KANSAS Section 1. That it is necessary and it is hereby ordered that certain sidewalks be constructed along the following course, to -wit:. The west side of Fourth Street between Walnut Street and Mulberry Street, abutt- ing upon Lots 158, 1160 and 166 on Fourth Street in the Original Town (now City) of Salina, Kansas Section 2. That the City Engineer shall and on or before the 6th day of June , 19 49 , prepare and file in the office of the City Clerk standard plans and specifications for the construction of each fif said sidewalks which shall be at a proper grade, and shall on or before said date, prepare and submit to the Board of Cominissioners detailed estimates, under oath„ of the cost thereof. Thereafter the City Clerk shall advertise for three consecutive days in the official city paper for sealed proposals, for the building and construction of said sidewalks according to said standard plans and specifications, which proposals shall be filed with the City Clerk on or before the time fixed in said notice, at which time the Board of Commissioners may let a contract for the construction of said sidewalks to the lowest responsible bidder or bidders therefor; provided that the cost thereof shall not exceed the estimated cost thereof and provided further that the Board shall reserve the right to refuse any or all such proposals; and that if no bids shall be received within said estimated cost, said Board may proceed and build such sidewalks with such estimated cost. Section 3. That when said sidewalk or sidewalks have been constructed then special assessments shall be levied against said lot, lots or parts of lots for the full cost or pro rata abutting footage cost thereof and the Board Of Commission ers shall levy an assessment against each lot or piece of land abutting said sidewalk, by ordinance, and the property owners or owner shall have 30 days after the publication thereof inwhich to make full payment of the assessment. The City Clerk shall mail a notice not less than 15 days prior to the end of said 30 days period to the owner or owners of the property and parts thereof as shown on the records of the Office of the Register of Deeds, but failure of the owner or owners to receive the notice shall not affect the validity of the assessment.. Section 4. That the special assessment provided fcr in Section 3 hereof shall be paid in one installment and if not paid the City Cleric shall certify to the County Clerk of Saline County, Kansas, at the same time other taxes are certified, a full list of all property liable to the payment of the cost of such work and improvement„ together with the respective amounts due on each of said tracts, piece or parcels of land with interest thereon at 4% per annum from the date of the publication of the special assessment ordinance, as aforesaid. Section 5.
