5372 Utility Improvements Grounds of Kansas Wesleyan Universityr - - - ORDINANCE 1]TTIB'ili 5372 (Published in the Salina Journal PIT fi D , 1949 AN ORDIIANCE creating and defining a certain lateral sanitary sewer district in the City of Salina, Kansas, designated as Lateral Sanitary Sewer District Number 239, and providing for the construction of a Lateral Sanitary Sewer in said Lateral Sanitary Sewer District Number 239, so created, and providing for the payment of the cost thereof and for the levying of special assessments against the property in said district for the payment of the cost of such construction and for the issuing of bonds to pay the ccs t thereof. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. Lateral Sanitary Sewer District 239. That there be and there is hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer District Number 239 and which district shall include all the follow- ing described property in the City of Salina, Kansas, to -wit: Lots 22, 24, 26, 28, 30, 32, 34, 36, 38 and 40 on Kirwin Avenue and Lots 21, 23, 25, 27,29, 31, 33, 35, 37, and 39 on Jewell Avenue, all in the Addition to the Grounds of Kansas Wesleyan University,. an Addition to the City of Salina, Saline County, Kansas. Section 2. It is necessary and it is hereby ordered that an eiht inch V.C.P. lateral sanitary sewer with all necessary connections, manholes, flushing tanks and other appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District Number 239 as created by Section 1 of this ordi- nance along the following; course, to -wit: Beginning at an existing manhole on the center line of alley, extended east, next north of Kirwin Avenue and thirty feet west of the east line of Quincy Street, thence west in the center line of said alley 500 feet to a manhole to be constructed which will be the termi- nus of said sewer. Section 3. That the City Engineer shall on or before April 25, 1949 1,949 prepare and file in the office of the City Clerk, plans and specifications for the construction of the lateral sanitary sewer provided for in the preceding sections of this ordinance which shall be of proper character to serve the prop - arty lying within the district within which such sewer is to be constructed and shall on or before the same date prepare and submit to the Board of Commissioners a detailed estimate under oath of the cost thereof. That thereafter the City Clerk shall advertise for three consecutive days in the official city paper for sealed proposals for the building and construction of such sewer according to such plans and specifications, which proposals shall be filed with the City Clerk on or before the time fixed in such notice, at which time the Board of Commissioners may let a contract for the building; and construction of such sewer to the lowest and best responsible bidder or bidders therefor, if there be any whose bids do not exceed the estimated cost thereof, but said Board shall reserve the right to reject any or all such proposals, and if no bid shall be received within such estimate, the Board of Commissioners shall have the power to do s wh work and make such improve- ments within the estimated cost thereof as provided by law. Section 4. That for the cost of building and constructing such sewer, special assessments shall be made for the full cost thereof on all lots and pieces of land within and for which such sewer shall be built, according to the appraised value thereof, without regard to the improvements or buildings thereon. Section 5. After the passage and publication of this ordinance, the Board of Commissioners shall appoint three disinterested appraisers, who after having apportioned to each tract,, piece or parcel of land within the taxing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the City Clerk shall annually, at the same time other taxes are certified, certify to the County Clerk of Salina County, Kansas, a full list of all property liable or such work and improvements,, together with the respective amounts due on each of said tracts, pieces of land, which amounts shall include the annual installments and interest on all unpaid balances for one year at the rate of not to exceed five per cent per annum, on such amouhts so certified, which taken an oath to make a true and impartial appraisement of all lots and pieces o f land to taxation for the cost of such improvements, shall within five days after having been notified of their appointments proceed to appraise all of the lots and pieces of land within such district liable to assessment and taxation as aforesaid, without regard to the buildings or improve.nents thereon, and after making such appraise-ment shall return to the Board of Commissioners of said city and said Board r shall designate a time for holding a special meeting of said Board for the purpose of hearing any complaints that may be made as to the value of any lot or piece of land appraised as aforesaid, of which special session due notice shall be given in the official city paper, and at which special session said Board may alter any valuation of any lot or piece of land if, in their opinion, the same has been appraised too high or too low. Section 6. The special assessment herein provided for may be paid by the person liable therefor in four approximately equal annual installments by the owner of any property liable to such assessment may within thirty days from the date of determining the amount assessed against the property pay the same in full and his property shall not be liable for any assessments for the cost of such improvements, and bonds as hereinafter provided for shall be issued in the amount of the cost of such improvements remaining; unpaid at the end of the thirty days from the time such assessment is fixed. Section 7. For the purpose of paying for the work and improvements in this ordinance provided for, the Board of Commissioners may hereby and are authorized and directed to issue improvement bonds of the City of Salina in an amount not to exceed the cost of such improvement, and to run for a period of four years and be payable in four approximately equal installments, together with interest not to exceed five per cent per annum, which bonds shall be issued and payable according to law; and for the purpose of paging the principal and interest on said bonds as they severally become due and payable, the Board of Commissioners shall apportion and assess against the lots or pieces of land within the taxing district for such improvements, special assessments covering the cost of such improvement and appor- tionment therein contained shall hold good for all of the installments that are to be collected from the specific property chargeable with such improvements, such assessment and apportionment ordinance shall contain the total amount of tax apportioned to each tract,, piece or parcel of land within the taxing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the City Clerk shall annually, at the same time other taxes are certified, certify to the County Clerk of Salina County, Kansas, a full list of all property liable or such work and improvements,, together with the respective amounts due on each of said tracts, pieces of land, which amounts shall include the annual installments and interest on all unpaid balances for one year at the rate of not to exceed five per cent per annum, on such amouhts so certified, which shall be collected as other taxes are collected. Section 8.
