5362 Confirm Utility ImprovementsORDIN1U! CE NUTIL IR 5362 (Published in the Salina Journal 9 AN ORDINANCE ratifying and confirming a contract with the H. J. Taylor Construction j Company for the construction of certain lateral sanitary sewers in the City of Salina heretofore designated as Lateral Sanitary Sewer Districts 234 and 235, and providing for the issuance of temporary notes'to pay the cost thereof pending issuance and sale of bonds. BE IT ORDAINED by the Board of Commissioners of the City of Salir._a, Kansas: Section 1. That the acceptance by the City of Salina of the proposal of the H. J. Taylor Construction Company, hereinafter referred to as the "contractor", as submitted to the Board of Commissioners on January 10, 1949, which is hereby found to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of said city to said contractor and signed on behalf of the City by its Iayor on 20th day of January , 1949 for the construction of certain public improvements in the City of Salina, to -wit e (1) A lateral sanitary sewer in a certain benefit district, being Lateral Sanitary Sewer Number 234, as heretofore provided by Ordinance Number 53583, as follows: Construct- ion of an 8" V.C.P. Lateral Sanitary Sewer, with all necessary connections, manholes, flush tanks and other appurtenances, beginning at a manhole to be constructed at the present 10 inch sewer in Park Street which is 40 feet north of the south line of said Park Street; thence south as an 8" V.C.P. sewer in the west parking of Phillips Street 290 feet, being the terminus of said sewer (2) A Lateral sanitary sewer in a certain benefit district, being Lateml Sanitary Sewer District Number 235, as hereto- fore provided by Ordinance Number 5358, as follows: Con- struction of an 8" V.C.P. Lateral Sanitary Sewer, with all necessary connections, manholes, flush tanks and other appurt- enances,, being the beginning at a manhole to be constructed in the center of an east and west alley connecting Eleventh Street and Twelfth Street, due north of the boundary line between Lots 25 and 26 in Block 10 in Pacific Addition to the City of Salina, thence north in an alley 840 feet, more or less, to an existing manhole on the south line of Lot 10, extendaawest, in said Block 2 in said Pacific Addition to the City of Salina, Saline County, Kansas. at and for the unit prices for said work contained in said proposal, which proposal and contract are hereby referred to and made parts of this ordinance, be and the same is here- by ratifyied and confirmed, said proposal being within the estimated cost of said improve- ments as shown by the sworn estimates of the City Engineer on file in the office of the City Clerk, which estimates are hereby referred to and made a part of this ordinance. Section 2. Said improvements shall be built and conttructed in accordance with the plans and specifi cations therefore prepared by the City hn.gineer on file in the office of the City Clerk and in accordance with the proposal of said contractor and under the terms of said contract, all of which are hereby referred to and made parts of this ordi- nance. Section 3. That Temporary Notes signed by the I4ayor and attested by the City Clerk be issued from time to time as thw work progresses in the manner and form as required by law, the total amount thereof not to exceed the contract price for such work, such notes to bear interest at not to exceed 43 -2 -per cent per annum and to mature not later than December 30th, 1949 and to be issued in such amounts and at such time as money for the payment of the cost of such work may be required, such notes to be issued to said contractor and to be redeemed and cancelled at tilt time that permanent bonds are issued in lieu thereof. Section 4. This ordinance shall take effect and be in force from and after its publication once in the official city paper.
