BE IT ORDAIYED by the Board of Commissioners of the Cita% of Salina, Kansas; Section 1. Lateral Sanitary Sewer District 234. That there be and there is hereby created Lateral Sanitary Sevier District in the City of Salina, Kansas, which shall be and it is hereb7r designo.-,ed as Lateral San- itary Sewer District I,'umber 234 and which district shall include all of the follow- ing described property in the City of Salina., Kansas, to -wit: Lot 45 and the East a of Lot 47 on Park Street in WilsonIsAddition, also the North 50 feet of Lot 46 on Ash Street and the North 5u feet of the East 2 of Lot 48 on Ash Street, all in Wilson's Addition to the Cit,r of Salina, Saline County, Kansas. Section 2. It is nece sorry and it is hereby ordered that an eight inch V. C. ?. lateral sanitary sewer with all necessary connections, manholes, flush- ing tanks and other appurtenances be constructed and built in and to serve said Lateral Sanitar'r Sewer District 234 as created by Section 1 of this Ordinance along the folloviing course, to -wit: Beginning at a manhole to be constructed at the present 10 inch sewer in Park Street which is 40 foot north of the south line of said Park Street; thence south as an 8" V. C. P. sewer in the v=est parking of Phillips Street 290 feet, bein£- ia•:e terminus of said sewer. Section 3. That there be and there is hereby created Lateral Sanitary Sewer District in the Citsr of Salina, Kansas, which shall be and it is hereby designated as Lateral Sanitar- of District Number 235 and which district shall include all of the follovwin'e described property in the City of Salina, Kansas, to -writ: Lots 11 to 20, inclusive, in Block 2, Lots 1 and Lots 10 to 20, inclusive, in Block 10 and fractional lots 3, 5, 7, 8 and 9 in said Block 10, all in Pacific Addition to the City of Salina, Saline County, Kansas. Section 4. It is necessar-, and it is hereby ordered that an eight inch V. C. P. lateral sanitary sewer with all necessary connections, manholes, flush- ing tanks and other ap ;urtenances be constructed and built in and to serve said Lateral Sanitary Sewer District 235 as created by Section 1 of this ordinance along the follalling course, to -wit: Beginning at a manhole to be constructed in the center of an east and west alley connect=ing Eleventh Street and Twelfth Street, due north of the boundary line between Lots 25 and 26 in Block 10 in Pacific Addition to said city, thence north in an alley 84U feet, more or less, to an existing manhole on the south line of Lot 10, extended west, in said Block 2 in said Pacific Addition to the City of Salina, Saline County, Kansas. Section 5. That the City Engineer shall on or before December 20th , 198prepare and file in the of-fice of the City Clerk, plans and specifications for the construction of the lateral sanitary sewers provided for in the preceding sections of this ordinance -which shall be of proper character to serve the property lying within the district within which such sewers are to be constructed and shall on or before the same date prepare and submit -to the Board of Commis:;ioners a detailed estimate under oath of the cost thereof. That thereafter the Cit,r Clerk shall advertise for three consecutive days in the official city paper for sealed proposal for the buildin;z and construction of such sewer according to such plans and specifications, which proposals shall be filed with the City Clerk on or before the time fixed in such notice, et which time the Board of Commissioners may let a contract for the building and construction of such sewers to the lowest and best responsible bidder or bidders therefor, if there be any whose bid does not exceed the estimated cost thereof, but said Board shall reserve the right to reject any or all such proposals, and if no bid shall be received within such estimate, the Board of Commissioners shall have the power to do such work and make such improvements within the estimated cost thereof as provided by law. Section 6. Tliat for the cost of building; and construction of such sewers, special assessments shall be made for the full cost thereof on all lots and pieces of land within the se:,,rer district within and for which such sewer shall be built, according to the appraised value thereof, without regard to the im_,roverlents or buildings thereon. Section 7. After the passage and publication of this ordinance, the Board of Commissioners shall appoint three disinterested arpraisers, who after having taken an oath to make a true and impartial appraisement of all lots and pieces of land to taxation for the cost of such i.mprovemehts, shall within five days after havinm been notified of their appointment proceed to appraise all of the lots and pieces of land within such district liable to assessment and taxation as aforesaid, without regard to the buildings or improvements thereon, and after haking such appraisements shall return to the Board of Commissioners of said city and said Board shall designate a time for holding a special meetin-, of said Board of the purpos , of hearing any complaints that may be made as to the value of any lot or pieces of land appraised as aforesaid, of which special session d!_te notice shall be given in the official city paper, and at which special session said Board mai alter any valuation of any lot or piece of land, if, in their opinion, the sal -2e has been appraised too high or too low. Section 8. The special assessment herein provided for maw be paid by the person liable therefor in four approximately equal annual installments but the owner of any property liable to such assessment may wit'Lin thirty days from the date of determining the amount assessed against the property pay the same in full end his property shall not be liable for any assessments for the cost of such improve— ments, and bonds as hereinafter provided for shall be issued in the amount of the cost of such improvements remaining unpaid at the end of thirty days from the time such assessment is fixed. Section 9. For the purpose of paviW,, for the h�ork and improvements in this ordinance provided for, the Board of Commissioners are hereby aut,.orized and directed to issue imy)rovernent bonds of the City of Salina in an amount not to exceed the cost of such ims>rovenent, and to run for a period of four years and be payable in four approxim-telt' equal installm-Ints, together with interest not to exceed five per cent 1 1 per annum, which bonds shall be issued and payable according; to law; and for the purpose of paying the principal and interest on said bonds as they severally become due and payable, the Board of Commissioners shall apportion and assess against the lots or pieces of land within the taxing district of such improvements, special assessments covering the cost of such improvement and apportionment therein con— tained shall hold good for all of the installments that are to bo collected from the specific property chargeable with slzch im �rovements, such assessment and apportionment ordinance shall contain the total amount of tax apportioned to each tract, piece or parcel of land within the taxing, district and shall state the num— ber of annual installments in which such tax is to be collected; and thereafter the City Clcrk shall annually, at the same time other taxes are cartified, certify to the County Clerk of Saline County, Kansas, a full list of all property liable for si.zch v ork and improverients, to -ether with the respective amounts due on each of said tracts, pieces or parcels of land, whicli amounts shall include the annual installments and interest on all un-IDaid balances for one year at the rate of not to exceed five per cent per , nnum, on such amount so certified, which shall be collected as other taxes are collected. Section 10. This ordinance shall take effect and be in force f_•om and after its adoption and public��tion once in the official city pacer.
