5347 Utility Improvement Surveyor's Plat #31u ORDINANCE Nmm 5347 blished in the -Salina Journal 1948 I AN ORDINANCE creating and defining a certain lateral Sanitary Sewer District in the City of Salina, Kansas, designated as Lateral Sanitary Sewer District Number 233, and providing for the construction of a Lateral Sanitary Sewer in said Lateral Sanitary Sewer District Dumber 233, so created, and providing for the payment of the cost thereof and for the levying of special assessments against the property in said district for the payment of the cost of such construction and for the issuing of bonds to pair the cost thereof. BE IT ORDAIA;ED by the Board of Commissioners of the City of Salina, Kansas: I Section 1. Lateral Sanitary Sewer Number 233. That there be and there is hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer District Number 233, and which district shall include all of the following described property in the City of Salina, Kansas, to -wit: Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11 and 12 Surveyorts Plat # 31, City of Salina, Saline County, Kansas. Section 2. It is necessary and it is hereby ordered that an eight inch V.C.P. lateral sanitary sewer with all necessary connections, manholes, flushing tanks and other appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District Number 233 as created by Section 1 of this ord- inance along the following course, to -wit: Beginning at an existing 10 inch sanitary sewer in Chicago Street and on center line of an east and west public alley north of Ash Street; thence east along center line of said alley wJth an 811' clay pipe sewer 430 feet to a manhole to be con- structed in said alley being^ the terminus of said sewer. Section 3. That the City Engineer shall on or before _Jctober 18th, , 1948, prepare and file in the office of the City Clerk, plans and specificet ions for the construction of the lateral sanitaryprovided sewer p for in the preceding sections of this ordinance which shall be of proper character to serve the prop- erty ikying within the district within which such sewer is to be constructed and shall on or before the same date prepare and submit to the Board of Commissioners a detailed estimate under oath oi' the cost thereof. That thereafter the City I Clerk shall advertise for three consecutive days in the official city paper for i sealed proposals for the building and construction of such sewer according to such plans and specifications, vhich proposals shall be filed with the City Clerk on or before the time fixed in such notice, at which time the Board of Commissioners may let a contract for the building and construction of such sewer to the lowest and best responsible bidder or bidders therefor, if there be any whose bid does not exceed the estimated cost thereof, but said Board shall reserve the right to reject an or all such proposals, Y p p and If no bid shall be received with suchestimate the Board of Commissioners shall have the power to do such work and make such improvements within the estimated cost thereof as provided by law. Section 4. That far the cost of building and construction of such sewer,, special assessments shall be made for the full cost thereof on all lots and pieces of land within the sewer district within and for which such sewer shall be built, a000rding to the appraised value thereof, without regard to the improvements or buildings thereon. Section 5. After the passage and publication of this ordinance, the Board of Commissioners shall appoint three disinteredted appraisers, who after having takes an oath to make a true and impartial appraisement of all lots and pieces of land to taxation for the cost of such improvements, shall within five days after i having been notified of their appointment proceed to appraise all of the lots and and pieces of land within such district liable to assessment and taxation as afore- said, without regard to the buildings or improvements thereon, and after having i made such appraisement shall return to the ?)oard of Commissioners of said city and said Board shall designate a time for holding a special meeting of said Board for the purpose of hearing any complaints that may be made as to the value of any lot or piece of land appraised as aforesaid, of which special session due notice shall be given in the official city paper, and at which speoial session said Board may alter any valuation of any lot cr piece of land if, in their opinion, the same has been appraised too high or too low. Section 6. The special assessment herein provided for may be paid by the person liable therefor in four approximately equal annual installments by the owner of any property liable to such assessment may within thirty days from the date of determining the amount assessed against the property pay the same in full and his property shall not be liable for any assessments for the cost of such improvement§, and bonds as hereinafter provided for shall be issued in the amount of the cost of such improvements remaining unpaid at the end of th$aty days from the time such assessment is fixed. Section 7. For the purpose of paying for the work and improv.ments in this ordinance provided, for the Board of Commissioners are hereby authorized and direct6d to issue improvements bonds of the City of Salina in an amount no to exceed the cost of such improvement, and to run for a period of four years and be payable in four approximately equal installments, together with the interest not to exceed five per cent per annum, which bonds shall be issiB d and payable according to law; and for the purpose of paying the principal and interest on such bonds as they severally become due and payable, and the Board of Commissioners shall apportion and assess against the lots or pieces of land within. the taxing district of such improvements, special assessments covering the cost of such improvement and apportionment therein contained shall hold good for all of the installments that are to be collected' from the specific property chargeable with such improvements, such assessment and apportionment ordinance shall contain the total amount of tax apportioned to each tract, piece or parcel of land within the taxing district and shall state the number of annual installments in which such tax is to be collected; and thereafter the City Clerk shall annually, at the same time other taxes are certified, certify to the County Clerk of Salina Bounty, Kansas, a full list of all property liable for such work and improvements, together with the respective amountsdue on each of said tracts, pieces or parcels of land, which amounts shall include the annual install- ments and interest on all unpaid balances for one ,year at the rate of not to exceed I five per cent per annum, on such amounts so certified, which shall be collected as I other taxes are collected.
