5343 Issue GO Bonds Series P-144i i ORDINANCE NMMM 531.1.3 1948 WILEREAS, the total cost of said improvements has been ascertained and the portion thereof in the amount of $9,615.80 to be paid by general taxes to be levied upon all taxable property within said city for the improvement of squares and areas formed by the crossing of streets and alleys and for the improvement of any of said streets where the same is through or adjacent to property of the city for AN CRDINANCE authorizing and providing for the issuance of Improvement Bonds of the City of Salina, Kansas, in the sum of $32,244.93, to pay the cost of improv- ing certain streets in said City to be designated as Series Number P-144. WHEREASur s uant t o P proceedings duly had according to law, contracts have been let and performed for the construction of the following street improvements in the City of Salina, Kansas, to -writ: Curbing, guttering in g g and grading of Franklin Street from the east line of Custer Street to the west line of Sherman Street, as pro- vided by Resolution Number 943 and Ordinance Numb er 5216. Curbing, guttering and grading of Cedar Street from the west line of College Street to the east line of the right-of-way of the Missouri Pacific Railroad, as provided by Resolution Number 951 and Ordinance Number 8216. i Cvrbing, guttering and grading of Hancock Street from the north line of Venango Street to the north line of Republic Avenue, as pro- vided by Resolution Number 955 and Ordinance Number 5216. Curbing, guttering and grading of Grand Ave- nue from the west line of Eighth Street to the west line of Ninth Street, as provided by Resolution Number 961 and Ordinance Number 5216. Curbing, guttering and grading of Tenth Street from the south line of Hamilton Street to the north line of Antrim Avenue, as provided by j Resolution Number 964 and Ordinance Number 5216. Curbing, guttering and grading of Kirwin Avenue (south side) from the west side of Fourth Street to the west line of Osborne Street and curbing, guttering and grading of Kirwin Avenue from the west line of Osborne Street to a point 125 feet east of the east line of Osborne Street, as pro- vided by Resolution Number 966 and Ordinance Number 5216. Curbing, guttering and grading of Second Street from the south line of Forest Street to the south line of Pacific Street, as provided by Resolution Number 970 and Ordinance Number 5216. Curbing, guttering and grading of Woodland Ave- nue from the east line of Santa Fe Avenue to the center lime of Front Street, as provided by Resolution Number 971 and Ordinance Number 5216. Curbing, guttering and grading of Fourth Street from the center line of Forest Street to the south line of Pacific Avenue, as provided by Resolution Nimber 973 and Ordinance Number 5216. Curbing, guttering and grading of Eleventh Street from the center line of Harsh Avenue to the center line of Hamilton Avenue, as provided by Resolution Number 974 and Ordinance Number 5216. Curbing, guttering and grading of the west side of Front Street from the center line of Pacific Avenue to the center line of Forest Avenue, as pro- vided by Resolution Number 975 and Ordinance Number 5216. Curbing, guttering and grading of Fourth Street from the north line of Pacific Av=.nue to the cen- ter line of Euclid Avenue, as provided by Resolution Number 977 and Ordinance Number 5216. WILEREAS, the total cost of said improvements has been ascertained and the portion thereof in the amount of $9,615.80 to be paid by general taxes to be levied upon all taxable property within said city for the improvement of squares and areas formed by the crossing of streets and alleys and for the improvement of any of said streets where the same is through or adjacent to property of the city for 1 1 1 Which the city is liable, and for which bonds are to be issued; and WHEREAS, the total cost of said curbing,guttering g ng and grading of said streets, which are to be paid by special assessments and to be levied upon lots and pieces of ground liable for the payment of said curbing, guttering and grading ins aid streets has been ascertained and has been found and determined to be the sum of $27,786.99, vh ieh amount has been heretofore duly assessed and apportioned to the several lots and pieces of ground liable therefore according to law provided for in the ordinance of the City of Salina, Kansas, relating thereto, duly pass- ed and approved, of which amount the sum of $5,157.86 has been duly paid by the property owners liable therefore, leaving a balance of $22,629.13, for which bonds are to be issued; and WHEREAS, bonds in the aggregate sum of $32,244.93 are to be issued to pay the actual net cost thereof; BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the foregoing preambles be and they are hereby authorized as a part of this ordinance and that for theur ose of P P providing funds to pay the cost of tae improvements herein above referred to and described in the Ordi- nances and Resolutions hereinbefore referred to, there shall be issued Internal Improvement Bonds of the City of Salina, Kansas, in the total principal sum of $32,244.93, which shall consist of thirty-two bonds numbered 1 to 32, inclusive, OL11 dated October 1, 1948, which shall bear interest at the nate of 6%,_q, G4..w,r,Q, p'1n,.1, —per cent per annum from and after said date until the respective maturity of said bonds, payable semi-annually on April 1st and October 1st, of each year, said interest to be evidenced by interest coupons as herein provided for and said bonds shall become due as followsz Bonds Number4d 1 to 8, for $1.,000.00 each except Numbed+ l is for $1,244.93, due October 1, 1949 Bonds Numbered 9 to 16 for $1,000.00 each, due October 1, 1950 Bonds Number 17 to 24, for $1,000.00 each, due October 1, 1951 Bonds Numbered 25 to 32, for $1,000.00 each, due October 1, 1952 Section 2. Said bonds .shall be signed by the Mayor and shall be attested by the signature of the City Clerk and corporate seal of the City shall be affixed thereto and said bonds shall have attached thereto interest coupons representing the interest thereon, which coupons shall be in the form provided by law and shall bear the printed or lithographed facsimile signattwe of the Mayor and City Clerk of said city and said bonds and interest coupons shall be registered, in the office of the City Clerk and in the office of the Auditor of State, as required by law. Section 3. Said bonds shall be designated as Series P-144 and shall be in the form and shall contain recitals substantially as follows: UNITED STATES OF AMERICA STATE OF KANSAS COUNTY OF SALINE CITY OF SALINA � I � Series P-144 N0, INTERNAL IMPROVEMENT BOND KNOW ALL MEN BY THESE PRESENTS, That the City of Salina inthe County of Saline, State of Kansad, acknowledges itself to be indebted and for value received here- by promises to pay to the bearer the sum of DOLLARS Inlawfulmoney of the United States of America, on the first day of October, 1948, with interest thereon from the date hereof at the rate of payable semi-annually on the first day of April and October in each year, on presentation and surrender of the interest coupons hereto annexed as said Boupons severally become due, both principal and interest of this bond being payable at the office of the State Treasurer of the State of Kansas, in the City of Topeka, Kansast And said City of Salina, Kansas, is held and firmly bound by thecae presents and the full faith, credit and resources of said city are hereby irrevocahly pledged for the payment of said principal and interest at maturity. This bond is one of a series of 32 bonds of like date and tenor, excepting denomination and maturity, aggregating the principal sum of $32,244.93, issued by the City of Salina, Kansas, for the purpose of paying the cost of constructing certain curbing, guttering and grading improvements in said city by the authority of and in full compliance with the provisions, restrictions and limitations of the constitution and laws of the State of Kansas „ including Sections 10-101 to 10-115, 12-601 to 12-608 and 13-1011 and 13-101JA4 all in the General Statutes of Kansas, 1935, amd. all amendments thereto,, and all other provisions of the laws of said state applicable thereto, and this bond and all other bonds of this series, and all interest thereon are to be paid by the City of Salina, Kansas. And it is hereby declared and certified that all acts, conditions, and things required to be done and to exist precedent to and in the issuance of this bond have been properly done and performed in due and regular form ' ,d daexist and manner as required b the constituiion/ o t e btate of Kansas, and that the total indebtedness of said city, inc luding this series of bonds, does not exceed any constitutional or statutory limitation. IN WIT14ESS VITU EOF, the said city of Salina, Kansas, has executed this bond by causing it to be signed by its Mayor its and corporate seal to be hereto affixed, attested by its City Clerk and the coupons hereto attached to be signed with the facsimile signatures of said officers, and this bond to e d ed the first day of Octdber, 1948. 04 Attest:` r City Clerk Section 4. The Mayor and City Clerk are hereby authorized and directed to prepare and execute the bonds hereinbefore described and to advertise and sell the same in the manner provided by law, and when duly executed and registered to deliver said bonds to the purchaser or purchasers thereof. Section 5. The full faith, credit and resources of the City of Salina, Kansas, shall be, and the same are hereby irrevocably pledged for the prompt payment of said bonds and all interest thereon. The Board of Commissioners of the City of Salina, Kansas, shall annually make provision for the payment of the princiapal and interst on said bonds as they severally become due by levying taxes and assessments upon the pnoperty t1a.ble therefore as provided by law. Section 6. This ordinance shall take effect and be in force from and after its publication once in the official city paper.
