5335 Confirm Street ImprovementsORDINANCE N Tm9ER 5335 (Published in the Salina. Journal -�� .; , 1948) AN ORDI1,U.,XCE ratifying and confirming a contract with the H. J. Taylor Con- struction Company for the construction of certain curbing, guttering and grading imprpvements on certain streets in the City of Salina, and providing for the issuance of temporary notes to pay the cost thereof pending the issuance and sale of bonds. BE IT ORDAINED by the Board of Commissioners of the City of Salina., Kansas: Section 1. That the acceptance by the City of Salina of the proposal of the H. J. Taylor Construction Company, hereinafter referredto asthe "Con- Con-tractor" tractor"as submitted to the Board of Commissioners on August 30, 1948, which is hereby found to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of said city to said contractor and signed on behalf of the City of Salina by its Mayor on September 7, 1948 for the construction of certain public improvements in the City of Salina, Kans s, to -wit: Curbing, guttering and grading of Fifth Street from the center line of Hamilton Avenue to the center line of Antrim, as provided by Ordinance Number 5325. Curbing, guttering and grading of Hamilton Avenue from the west line of Ninth Street to the east line of Eleventh Street, as provided by Ordi- nance Number 5325. Curbing, guttering and grading of Harsh Avenue from the center line of Santa Fe Avenue to the center line of Seventh Street, as provided by Ordinance Number 5325. Curbing, guttering and grading of Stapler Ave- nue from the east line of Ohio Street to the east line of Delaware Avenue, as provided by Ordinance Number 5325. at and for the unit pr ices for said work contained in said proposal, which proposal and contract are hereby referred to and made parts of this ordinance be and the same is hereby ratified and confirmed, said proposal being within the estimated cost of said improvements as shown by the sworn estimates of the City Engineer on file in the office of the City Clerk, which estimates are hereby referred to and made a part of this ordinance. Section 2. Said improvements shall be built andconstructed in accordance with the plans and specifications therefor prepared by the City Engineer on file in the office of the City Clerk and in accordance with the proposal of said contractor and under the terms of said contract, all of which. are hereby referred to and made parts of this ordinance. Section 3. That Temperary Notes signed by the I&yor and attested by the City Clerk be issued from time to time as the work progresses in the manner and form as required by law, the total ��mount thereof not to exceed the con- tract price for such work, such notes to bear interest not to exceed P 4W, per cent per annum and to mature not later than December 1, , 1949 and to be issued in such amounts and at such time as money for the payment of the cost of such notes to be issued to said contractor/ and to be r4deemed and cancelled at the time that permanent bonds are issued in lieu thereof.
