ORDINANCE NUMBER 91-9431
AN ORDINANCE EXCLUDING CERTAIN LAND IN NORTH PARK
ADDITION FROM THE CITY LIMITS IN CONFORMITY WITH K.S.A. 12-504.
WHEREAS, a petition has been filed with the City Clerk by David Wells
and Homer Wells, requesting the exclusion of certain lots in Block 1, North Park
Addition to the City of Salina, Saline County, Kansas, and
WHEREAS, a notice of a public hearing was published in The Salina
Journal, the official city newspaper, on March 8 and 15, 1991, and
WHEREAS, a public hearing was held on March 18, 1991, SO NOW,
THEREFORE
Kansas:
BE IT ORDAINED by the Governing Body of the City of Salina,
Section 1. The Governing Body determines from the proofs and
evidence presented at the public hearing conducted March 18, 1991 that:
a) That due and legal notice of the public hearing was given by
publication,
b) No private rights will be injured or endangered by the
exclusion,
c) The public will suffer no loss or inconvenience by the
exclusion, and
d) In justice to the petitioners, the prayer of the petitioners
ought to be granted.
Section 2. That Lots One (1), Three (3), Five (5), Seven (7), Nine
(9), Eleven (11), Thirteen (13), Fifteen (15), Seventeen (17), Nineteen (19),
Block One (1), North Park Addition to the City of Salina, Saline County,
Kansas, are hereby excluded from the city limits of the City of Salina, Kansas.
Section 3. That this ordinance shall be in full force and effect from
and after its adoption and publication once in the official city newspaper.
