AN ORDINANCE ratifying and confirming a contract with H. J. Taylor Construction Company
for the construction of certain Lateral Sanitary sewers in the City of Salina here-
tofore designated as Lateral SanitarySewerDistrict 267, and providing for the
issuance of temporary notes to pay the cost thereof, pending issuance and sale of
bonds.
BE IT ORDAINED by the -board of Commissioners of the City of Salina, Kansas:
Section 1. That the acceptance by the City of Salina of the proposal of H. J. Taylor
Construction Company, hereinafter referred to as the "contractor" as submitted to the
. Board of Commissioners December 3, 1951, which is hereby found to be the lowest and best
bid for such work, and the contract awarded by the Board of Commissioners of said city
to said contractor and signed on behalf of the city by its Mayor on December 7, 1951,
for the construction of certain public improvements in the City of Salina, to -wit:
Beginning at an existing manhole in Sunrise Drive
and west and opposite Lot Line 2 and 17, Block 3,
Morningside Addition, thence east on center line
of right-of-way, 633 feet more or less to the center
line of Roach Street at which point a manhole will
be constructed which will be the terminus of Lateral
267,
at and for the unit price for said work contained in said proposal, which proposal and
contract are hereby referred to and made parts of this ordinance, be and the same is
hereby ratified and confirmed, said proposal being within the estimated cost of said
improvements as shown by the swc-rn estimate of the City Engineer on file in the office
of the City Clerk, which estimates are hereby referred to and made a part of this ordinance.
Section 2. Said improvements shall be built and constructed in accordance with the
plans and specifications therefore prepared by the City Engineer on file in the office
of the City Clerk and in accordance with the proposal of said contractor and under the
terms of said contract, all of which are hereby referred to and made a part of this
ordinance.
Section 3. That temporary notes signed by the Mayor and attested by the City Clerk
be issued from time to time as the work progresses in the manner and form as required
by law, the total amount thereof not to exceed the contract price for such work, such
notes to bear interest at not to exceed 42 per cent per annum and to mature not later
than December 1, 1953, and to Ue issued in such amounts and at such ti_-,ies as may the
money for the pa3mtlent of the cost of such work be required, sucbt notes to be issued to
said contractor and to be redeemed and cancelled at the time that Internal Improvement
Bonds are issued in lieu thereof.
Section 4. That this ordinance shall take effect and be in full force from and
after its publication once in the official city paper.
