5505 Street Improvements_ _ �Journal1950) AIJCE ��O 505 (ly lrst Published in the Salina AN O D !'' 1A dCE providing for the paving and grading and for the curbing, guttering and paving of certain streets in the City of Salina., Kansas described as follows: for the paving and grading of Eleventh Street from the north line of harsh Avenue to the south', lire of Hamilton Street; Second Street from the north line of Elm Street to the ;=ice line of "orth Street; Seventh Street from the &=th line of doodland Avenue to -the north line of Grand Avenue; and for the curbing, guttering, paving and grading of Iron Avenue from the east line of Delaware Avenue to the east line of Iviaryffiount Road; Jewell Avenue from the east line of Osborne Avenue to the east line of Lots 33 and 34 on Jewell Avenue, and prbridingfor the payment of trie cost thereof,ilow the same shell be assessed and the manner of the payment of the cost thereof. %'E.'FEAS, by Resolutions numbered 1133, 1179, 1189, 1134 and 1190, duly adopted July 17, 1950, May 22, 1950, and June 19, 1950, respectively, the Board of Commissioners of the City of Salina, Kansas have declared that they deem it necessar,r to pave and grade Eleventh Street from the north line of Harsh Avenue to the so"h line of Hamilton Street; Second Street from the north line of Elm Street to thesnuthi line of North Street; Seventh Street from thesoathh line of Woodland Avenue to the north line of "Grand Avenue; and to curb, gutter, pave and grade Iron Avenue from the east line of Delavrare Avenue to the east line of fliar mount Road; Jewell Avenue from the east line of Osborne Avenue to the east line of Lots 33 and 34 on Jewell Avenue, all together with such excavation and grading as may be necessary and for the grading of each thereof. IvCT6v 'i'I REii U'tL; BE IT by the Board of Commissioners of the City of Salina, Kansas: Section 1. That it J_s necessary and it is hereby ordered that Eleventh Street from the _=th line of Harsh Avenue to the south line of Iiamilton Street in said city be paved and graded 7rith excavation necessary therefor, and graded to the established pavin rade and paved between the ;guttering lines thereof. Section 2. That it is necessary and it is hereby ordered that Second Street fro# the north line of Elm Street to the south line of north Street in said city be with paved and graded mx�t excavation necessary therefor, and graded -to the established paving grade and paved between the guttering lines thereof. Section 3. That it is necessary and it is hereby ordered that Seventh Street from the south line of Woodland Avenue to tie north line of Grand Avenue in said city be paved and graded with excavation necessartr therefor, and graded to the established paving -rade and paved between t'ne �utterin,- lints thereof. Section 4. That it is necessary and it is hereby ordered that Iron Avenue from the east line of Delaware Avenue to the east line of I.'arymount Road in said city be curbed, buttered and paved with excavation necessary therefor, and graded to the es- tablished paving -rade and paved between the ;uttering lines thereof. Section 5. That it is necessary and it is hereby ordered that Jewell Avenue from the east line of Osborne Avenue to the east line of Lots 33 and 34 on Jewell Avenue in said city be curbed, guttered and paved with excavation necessary therefor, and graded to the established paving grade an6 paved between the ;uttering( lines thereof. Section 6. That for the work and improvements herein D7ovided .for tine City Engineer shall ma' -,e and file with the City Clerk on or before the 23th Cay of August, 1950, car,iplete plans and specifications for the curbin--, uttering pavin;- and grading with excavation necessary therefor, of each of the streets or portions tiepeof des- cribed in Section 4 and 5 inclusive, of this ordinance, vrith the follov�ring type of improvement: 1 1 h7 Conc et b' r e com fined curb and gutter on each side thereof, 30 inches ;zde from back to curb to paving line, curb 12 inches deep at hhck, gutter 6 inches deep, and the necessary radin`, of each to the established paving Trade, mithin the limits of said streets hereinbefore prescribed. Section 7. That for the work and improvements herein provided for the City Engineer shall make and file with the City Clerk on or before the 2 th day of Au:;ust, i 1950, complete plans and specifications for the curbing, -uttering, navinr_r and grading Ydth excavation necessary therefor, of each of the streets or portions tt"iereof des- cribed in Section 1 to 3 of this ordinance, ti,,ith the f olloti.rdng tz�yDe of improvement: The pavinz thereof with six inch reinforced concrete between the curb and butter lines on each side thereof ana within the limits of said street hereinbefore prescribed, and said Engineer shall on or before the same date, submit to the Board of Commissioners under oath, detailed estimates of the cost of such -work and improvements. Section 3. That after such plans and specifications have been made and pre- pared by the City Engineer and filed Taith the City Clerk as aforesaid, the Board of Commissioners may advertise by advertisement published in the official city ;)aper of the City of Salina, Kansas, for three consecutive dayys for the receipts of sealed proposals for the improving of said streets with the kind of material named and specified in the preceding sections hereof, and for the excavations and grading necessary for the completion of such pork, and after the receipt of ::such proposals, the said Board of Com- missioners may and are hereby authorized and directed to let contracts for the improving of said streets idth the materials selected by them to the lowest responsible bidder or bidders therefor, as determined by said Board of Commissioners, and for such ex- cavations and grading. Said Board reserves tree right to reject any and all bids. Section 9. That for the improving of the above mentioned streets, such assess- ments shall be .jade for the full costs thereof according to law, on all lots and pieces of land to the center of the block on either side of the streets to be improved according to the appraisers valuation thereof, without regard to the buy-ldings or improvements thereon for the distance to be improved. Section 10. After passage and ;publication of this ordinance, the Board of Commissioners shall appoint three disinterested appraisers, householders, who after having- taken oath to make a true and impartial appraisement of all lots and pieces of land liable to assessment and taxation as aforesaid, as may be designated by the Board of Commissioners of said city, without regard to the bui-lding or improvements thereon and after making such appraisement shall return the same to the Board of Commissioners of said city and said Board of Commissioners shall designate a time and place for the hearing of any complaints that may be made as to the value of any lots or pieces of land a praised as aforesaid, of :rhich due notice shall be :_riven in the official city paper, at which hearing the Board of Commiss oners may alter any valuation of any lot or piece of land, if, in their opinion, the same has been ap-oraised too high or too low. defraying the cost of improving the intersections and areas formed bir the crossing of streets and alleys, and for the grading of said streets chere the same is provided for in this ordinance as well as tir-iere the improvement is through or adjacent to property of the City for which the city liable, the assessments -,rill be made against all taxable ;property of the city and paid by the city at large. Section 12. This ordinance shall take effect and be in force from and after its publication once in the official city paper. That for the purpose of paying the cost of the ;,cork and improve- ments in this ordinance provided for, the board of Commiss_oners are hereby authorized and directed to issue internal improvement bonds of the City of Salina in an amount not to exceed the contract price or cost of such improvements and to run for a period of ten years and be payable in ten equal installments, together with interest not to exceed five per cent per annum, t^rhich bonds shall be made payable at the Fiscal Anent* of the State of Kansas, and "or the purpose of paying; principal and interest on said bonds as i they severally beco e due and payable, the Board of Commissioners shall apportion and assess against the lots and pieces of land within the taxing district of such improve- ments special assessments covering the cost of such improvin- and the apportionment here- in contained shall hold rood for all the installments that are to be collected from the specific property chargeable with said improvements. Such assessment and apportionment ordinance shall contain the total amounts of tax apportioned to each tract, niece or parcel of land -within the taxin,-, district and shall state the number of annual install- ments in iTrnich such tax is to be collected; and therefor the City Clerk shall annually, at the same time other taxes are certified, certify to the County Clerk of Saltine County, Salina, Kansas, a full list of all property liable for such work and improvements, to- gether i%-ith the respective amounts due on each of said tracts, nieces of land, which amounts shall include the annual installments and interest on all unpaid balances for one ;,rear at the rate of not to exceed .Five per cent per annum on such amounts so certified i.--iich shall be collected as other taxes are collected; Provided, that, the purpose of defraying the cost of improving the intersections and areas formed bir the crossing of streets and alleys, and for the grading of said streets chere the same is provided for in this ordinance as well as tir-iere the improvement is through or adjacent to property of the City for which the city liable, the assessments -,rill be made against all taxable ;property of the city and paid by the city at large.
