AN OROIiANCE providing and establishing the rates to be charged consumers of -nater
sold by the Water :corks Department of the City of Salina and )roviding for a
refund of certain amounts heretofore charged consumers of lyater and providing
certain penalties for the violation of the terms hereof and providing for the
repeal of Section 28-114, Revised Ordinances of the City of Salina, 1948.
117=2AS, the Board of Commissioners of the Cit -IT of Salina did on June 27, 1949 adopt
that certain Ordinance No. 5396, which said ordinance was thereafter duly published as
provided by lavr, whereby the rates to be charged to the consumers of water were therein
specified effective July 1, 1949, in words and fiC res as follows, to -wit:
}tSection 1. Rates. The following are hereby established as the meter rates which
consumers of water shall pay for 15ater furnished them by the <Jater 'corks Department of
the City of Salina from and after July 1, 1949.
First 3000 cubic feet @ $.168 per 100 cubic feet X5.225 per 1600 gallons
Next 6000 cubic feet @ .135 per 100 cubic feet . 18 per 1000 gallons
Next 6000 cubic feet @ .106 per 100 cubic feet . 14 per 1000 gallons
Over 15000 cubic feet @ .056 per 100 cubic feet .075 per 1000 gallons
Users and consumers of water are hereby granted the privilege of purchasing .ater
by contract on a monthly or annual basis at their option, provided that users of grater
on an annual basis shall be charged at the uniform rate of $.163 per 100 cubic feet for
use of water over the annual minimum as hereinafter prescribed.
The following are hereby established as the minimum charges for regular users of
water using the prescribed size of meter and the maximum volume of 1.uter for each mini-
mum charge on a monthly and annual basis; from and after July 1, 1949

"REAS, at the time of the adoption of said Ordinance No. 5396 the rates therein made
and provided were increased over the prior existing rates for the purpose of providing
increased reserves to assist in the financing of the construction and equipping of a
water softening plant; and
.:%UREAS, the majority of the qualified voters of the City of Salina did at an elect_on
called for such purposes vote against authorizing the i.suance of bonds of the City
for the purpose of constructing and equipping such a plant; and
amREAS, the increased reserves established and created in the Vater Works Department
of said City resulting from increased rates, aforesaid, are not noi-r needed as a conse-
quence of such failure to authorize and so now it is a legislative intent of said
Board of Commissioners to provide for the reduction of rates to a level hereinafter
specifically established and to further effectively provide for the refund unto each
consumer of the additional charges made for such eater under the provisions of Ordinance
No. 5396 as compared with the rates established by this ordinance for the period from
July 1, 1949 to August 31, 1959; and SO NOVT T1EREFOI-E,
BE IT ORDAINED BY TI: BOARD OF CO1 4ISSTONERS OF THt, CITY OF SALIHA, KANSAS:
Section 1. Rates. The follovring are hereby established as the meter rates

Consumers shall have the option of entering into contract for water for a period of
one year. The minimum charge to be based on the above shhedule payable in advance,
and any jmater used in excess of the annual allowance to be paid for at the rate of
11.25¢ per hundred cubic feet or 15¢ per thousand gallons.
Section 2. Refund That the City IManager be and he is hereby directed to cause
each consumer of i^.,ater to be refunded substantially all additional sums paid by each such
consumer unto the Vatein=rks Department of said city as a consequence of said Ordinance
No. 5396 -khen compared with the rates established by this ordinance, as aforesaid, all
with reasonable dispatch consistent with substantial accuracy and proper accounting.
Section 3. Payment That pending ascertainment and payment of the amount due
each consumer, every consumer shall regularly and timely pay amounts due the '1'atenzTorks
Department for current service in default of which the city manager shall have the
right to discontinue service. This requirement is made in order to insure orderly and
accurate accounting within the -�aterntfrorks Department and to facilitate the computation
of refunds and the preparations of vouchers therefor.
Sectioh;4- 'Prohibit Qn'It shall be unla�ful for any person to accept any chec4,
draft, or refund from the '7aterworks Department of the City of Salina unless such
person so accepting was an actual bona fide consumer of water furnished by said de-
partment of said city and is actually entitled to such refund under the provisions
hereof,
Section 5' P4rsons Entitled. That the City Manager shall cause to be determined the
amount due each consumer as a refund from records of the 7 a.tenivorks Department and such
determination therefrom, in each instance, shall be firial; however, it is hereby de-
clared to be the policy that any consumer ir�rho -vas reimbursed for such vrater or any
part thereof, by tenants, sub -tenants, lessees or other occupants or users of premises,
should prorate such refund, or the proportionate part thereof, with each person
equitably entitled thereto.

Section 6. Penalty Any person violating any provision: of this ordinance
a<
shall be deemed guilty oV n?blic offense and upon conviction thereof shall be fined
a sum not to exceed $100.00.
Section 7. Take Effect This ordinance to take effect and be in force from
and after its passage and publication once in the official city paper.
