5499 Confirm Utility Improvements Beverly Manor AdditionORDINANCE NUM 5499 -- (Published in the Salina Journal y, 1984 AN ORDINANCE ratifying and confirming a contract with H. J. Taylor Construction Company for the construction of certain Lateral Sanitary Sewers in the City of Salina heretofore designated as Lateral Sanitary Sewer Districts 253 and 254, and providing for the issuance of temporary notes to pay the cost thereof, pending issuance and sale of bonds. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the acceptance by the City of Salina of the proposal of the H. J. Taylor Construction Company, hereinafter referred to as the "contractor" as submitted to the Board of Commissioners on August 7, 1950, which is hereby found to be the lowest and best bid for such work, and the contract awarded by the Board of Commissioners of said City to said contractor and signed on behalf of the City by its Mayor on August 11, 1950, for the construction certain public improvements in the City of Salina, to -wit; An 8 inch vitrified clay pipe sewer, beginning at a manhole to be construct- ed over existing sewer at the intersection of Pershing Street and Claflin Avenue, thence in a northwesterly direction on lot line of Lots 4 and 5 Block 50 Beverly Manor Addition 124 feet, more or less to a line which is 134 feet north of the north line of Claflin Avenue; thence west along a line which parallels and is 134 feet north of Claflin Avenue 251.7 feet more or less to the center line of Funston Avenue, where a manhole will be constructed which will be the terminus thereof. An 8 inch clay pipe sewer beginning at an existing manhole at the inter- section of Wilson Street and Kenison Road; thence north along the center line of Kenison Road 370 feet and there a manhole to be constructed. An 8 inch clay pipe sewer beginning at existing manhole at the intersection of Wilson Street and Kenison Road, thence east along center line of Wilson Street 384.5 feet, there a manhole to be constructed; thence north along the canter line of Sunrise Drive 304 feet, there a manhole to be constructed; thence north 66 feet which will be the terminus thereof* at and for the unit price for said work contained in said proposal, which proposal an d contract are hereby referred to and made parts of this ordinance, be and the same is hereby ratified and confirmed, said proposal being within the estimated cost of said improvements as shown by the sworn estimate of the City Engineer on file in the office of the City Clerk, which estimates are hereby referred to and made a part of this ord- inance* Section 2. Said improvements shall be built and constructed in accordance with the plans and specifications therefore prepared by the City Engineer on file in the office of the City Clerk and in accordance with the proposal of said contractor and under the terms of said contract, all of which are hereby referred to and made a part of this ordinance. Section 3. That temporary notes signed by the Mayor and attested by the City Clerk be issued from time to time as the work progresses in the manner and form as required by law, the total amount thereof not to exceed the contract price for such work, such notes to bear interest at not to exceed 42 per cent per annum and to mature not later than December 1, 1951, and to be issued in such amounts and at such times as may the money for the payment of the cost of such work may be required, such notes to be issued to said contractor and to be redeemed and cancelled at the time that Internal Improvement Bonds are issued in lieu thereof. Section 4. That this ordinance shall take effect and be in full force from and after its publication once in the official city paper.
