AN ORD: NANCE relating to and apportioning and levying special assessments on
certain lots and pieces of ground in the City of Salina, Kansas, to pay the
cost of constructing lateral sanitary sewer in Lateral Sanitary Sewer District
Number 248, and relating to and providing for the collection and payment of
such assessments.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas;
Section 1. That for the purpose of paying for the cost of building and con-
structing a lateral sanitary sewer in Lateral Sanitary Sewer District Number
248, as authorized by the provisions of Ordinance number 5452, the cost of which
has been duly ascertained as shown by the City Engineer's Final Estimate of
Cost, which has been duly approved by the Board of Commissioners, there are
hereby levied and assessed on the property liable therefor, being all the lots
and pieces of ground lying in the sewer district mentioned above as created by
Ordinance Number 5452, according to the apprais6d value of such lots and pieces
of ground without regard to the buildings or improvements thereon, special

assessments covering the cost of such improvements constructed in said sewer
district, said special assessments being based on the special valuation and
appraisement made by three disinterested appraisers appointed by the Board of
Commissioners of the City of Salina, Kansas, which said appraisement is hereby
referred to and made a part of this ordinance, and the several amounts levied
and apportioned against the lots and pieces of ground in said sewer district for
the purpose of paying the cost of the improvements constructed in such district
being found and determined to be as set forth in the folloAng section of this
ordinance.
Section 2. That for the payment of the cost of construction of Lateral
Sanitary Surer Number 243, an eight inch clay pipe sewer beginning at a manhole
at the intersection of that certain easterly and westerly alley next south of
Gypsum Avenue and that certain north and south alley between Ohio Street and
Connecticut Avenue;, thence south in said alley to a point directly west of
the south line of Lot 26, Block 11 Stack Place, an Addition to the City of
Salina, Kansas, the amount levied, apportioned and assessed against the lots
and pieces of ground in said district are found and determined to be as follows;

Section 3. Said amounts levied, apportioned and assessed as aforesaid shall
be due and collectible in four equal installments, the first becoming due Vdth
the taxes levied for the year 19503and one of said installments falling due
each and every year thereafter until all are paid, all to be collected with
interest as in this,ordinance provided, PROVIDED, HOT R, that the miner of
any piece of property liable for any such assessment may redeem his property
from such liability by paying into the City Treasury the entire amount charge-
able against the same as in this ordinance designated, at any time within thirty
days after the publication of this ordinance, and before the issuance of bonds
of said city in payment of the cost of said improvements, and his property so
ter be liable for any further assessment for the cost
paid on shall not thereaf
of said improvements nor for any part of said bonds.
Section 4. There is hereby further levied and assessed against such lots
and pieces of ground described in this ordinance interest at such rate per annum
as shall be borne by the bonds hereafter to be issued for the payment of the
remaining unpaid cost of such improvements, such rate to be hereafter determined
and fixed by ordinance vffhen such bonds are issued, on all of said installments
mentioned and provided for in this ordinance, from the date of the bonds which
may be issued at the end of thirty days as specified ib:the preceding sections
hereof as by law provided, to the time of the collection of the last installment
as provided by law, which said interest shall be collected annually at the same
time and in the same manner as said installments are collected, and after the
taking effect of this ordinance and the fixing of the interest rate when such
bonds are authorized and issued, it shall be the duty of the City Clerk of said
city to annually at the same time other taxes are certified, and until all of
said installments so apportioned and levied herein have b:en certified, to cer-
tify to the County Clerk of Saline County, Kansas, a full list of all property
liable to assessment and taxation for such -mrk and jai,rovei,tents, except such
property on vyhi.ch the special assessments aforesaid have been paid in full as
hereinbefore provided, together vrith the respective amounts due on each of such
lots and pieces of ground, which amounts shall include the annual installments

of such special assessments together with the interest for one year at the rate
to be fixed as provided for in this ordinance, being the rate borne by the bonds
to be issued and on all unpaid balances of such assessments, and such amount so
certified as herein provided shall be placed upon the tax roll by the County
Clerk of Saline County, Km sas, and collected as other taxes are collected.
Section 5. This ordinance shall take effect and be in force from and
after its adoption and publication once in the official city paper.
