AN ORDIMOCE creating and defining a certain lateral sanitary sewer district in the
City of Salina, Kansas- designated as Lateral Sanitary Se-wer District Number 253
and providing for the construction of a lateral sanitary sewer in said Lateral San-
itary Sewer District Number 253, so created, and providing for the payment of the
cost thereof and for the levying of special assessments a�-rainst the property in
said district for the payment of the cost of such construction of and for the
issuing of bonds to pay the cost thereof.

BE IT ORDAIITED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. Lateral Sanitary Sewer District Number 253. That there be and
there is hereby created lateral sanitary sewer district in the City of Salina,
Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer Dis-
trict Number 253 and which district shall include all the following described prop-
erty in the City of Salina, Kansas, to wits
jLots 5 to 15, inclusive, Block 5,
Beverly 1anor Addition to the
City of Salina, Kansas
Section 2. It is necessary and it is hereby ordered that an eight inch
V. C. P. lateral sanitary sewer with all necessary connections, manholes, flushing
tanks and other appurtenances be constructed and built in and to serve said Lateral

Sanitary Sewer District Number 253 as created by Section 1 of this ordinance along
the following course, to -wit:
An 8 inch vitrified cla,T pipe sewer,
beginning at a manhole to be constr-
ucted over existing sewer at the
intersection of Pershing Street and
Claflin Avenue, thence in a northwesterly
direction on lot line of Lots 4 and 5
Block 5, Beverly Manor Addition 124
feet, more or less to a line which is
134 feet north of the north line of
Claflin Avenue; thence west along a
line which parallels and is 134 feet
north of Claflin Avenue 251.7 feet more
or less to the center line of Funstoh
Avenue, where a manhole will be con-
structed which will be the terminus
thereof.
Section 3. That the City Engineer shall on or before _July.lQth_
1950 prepare and file at the office of the City Clerk, plans and specifications
for the construction of the lateral sanitary sewer provided for in the preedding
sections of this ordinance which shall be of proper character to serve the property
lying within the district Which such sewer is to be constructed and shall on or
before the same date prepare and submit to the Board of Commissioners a detailed
estimate under oath of the cost thereof. That hereafter the City Clerk shall
advertise for three consecutive days in the official city paper for sealed proposab
for the building and construction of such sewer according to such plans and specifi-
cations, which proposals shall be filed with the City Clerk on or before the time
fixed in such notice, at which time the BoaH of Commissioners may let a contract
for the building and construction of such sewer to the lowest and best resronsib]e
bidder or bidders therefor, if there be any whose bids do not exceed the estimated

cost thereof, but said Board shall reserve the right to reject any or all such
proposals, and if no bid shall be received within such estimate, the Board of
Commissioners shall have the power to do such work and make such improvements

within the estimated cost thereof as provided by law.
Section 4. That for the cost of building and constructing such sewer, special
assessments shall be made for the full cost thereof on all lots and pieces of land
within and for which such sewer shall be built, according to the appraised value

thereof without regard to the buildings mr improvements thereon.
Section 5. After the passage and publication of this ordinance, the Board of
Commissioners shall appoint three disinterest api,raisers, who after having taken
oath to make a true and impartial a -oraisement of all lots and pieces of land to
taxation for the cost of such improvements, shall within five dad's after having
been notified of their appointments proceed to appraise all of the lots and pieces
of land Trithin such district liable to assessment and taxation as aforesaid, with-
out regard to the buildings or inrprovernents thereon, and after making such appriase-
ment, shall return to the Board of Commissioners of said city nd said Board shall
designate a time for a special meeting of said Board for the prupose of hearing
any complaints that may be made as to the value of any lot or piece of land
appraised as aforesaid, oil which special session due notice shall be give in the
official city paper, at which such special session said Board may alter any valu-
ation of any lot or piece of land if, in their opinion, the same has been appraised
too high or too low.
Section 6. The special assessment herein provided for may be paid by the
person liable therefor in four appro_-ximately equal annual installments butthe
owner of any property liable to such assessment may within thirty days from the
date of determing the amount assessed against the property, pay the same in full
and his property shall not be liable for any assessments for the cost of such
improvements, and bonds as hereinafter provided for shall be issued in the amount
of the cost of such improvements remaining unpaid_ at the end of thirty days from
the time such assessment is fixed.
Section 7. For the purpose of paying for the ;^pork and improvements in this
ordinance provided for, the Board of Commissioners may and are hereby authorized
and directed to issue improvements bonds of the City of Salina, Kansas, in an
amount not to exceed to the cost of such improverent, and to run for a period of
four years and be payable in four approxivAtely equal annual installments, together
with interest not to exceed five per cent per.:annum, which bonds shall be issued
and payable according to law;; and for the purpose of raring_ the principal and
interest on said bonds as they severally become due and payhble the Board of
Commissioners shall apportion and assess against the lots and pieces of land .-dth-
in the taxing district of such improvements, special assessments covering the
cost of such improvement and apportionment therein contained shall hold good for

all of the installments that are to be collected from the specific property charge—
able with such improvements, such assessment and apportionment ordinance shall con—
tain the total amount of tax apportioned to each tract, piece or parcel of land vriti—
in the taxing district and shall state the number of annual installments in iNhich
such tax is to be collected; and thereafter the city Clerk shall annually, at the
sane time that other taxes are certified, certify to the County Clerk of Saline
County, Kansas, a full list of all property liable for such vfork and improvements ,
together with the respective numbered amounts due on each of slid tracts, pieces or
parcels of land, which amounts shall include the annual installments and interest
on all unpaid balances for one year at the rate of not to exceed five per cent per
annum, on such amounts so certified,-,:hich shall be collected as other taxes are
collected.
Section 8. This ordinance shall take effect and be in force from and after
its publication once in the official city paper.
