ORDINANCE 11MMER 5 88

AN ORDI-1ANCE creating and defining a certain lateral sanitary se -ver district in
the City of Salina, Kansas, designated as Lateral Sanitary Seaver District Number
252 and providing for the construction of a lateral sanitary sewer in said lat-
eral Sanitary Sewer District Number 252, so created, and providing for the pay-
ment of the cost thereof and for the levying of special assessments against
the property in said district for the payment of the cost of such construction
of and for the issuing of bonds to pay the cost thereof.
BE IT ORDAINED BY the Board of Commissioners of the City of Salina, Kansas;
Section 1. Lateral Sanitary Serer District 252. That there be and
there is hereby created Lateral Sanitary Seger District in the City of Salina,
Kansas, -which shall be and it is hereby designated as Lateral Sanitary Sewer
District Number 252 and which district shall include all the folio -,,ring des-
cribed property in the City of Salina, Kansas, to merit r
Lots 9 to 265 inclusive, Block 3,

Section 2. It is necessary and it is hereby ordered that an eight inch
V. C. P. lateral sanitary sewer with all necessary connections, manholes,
flushing tanks, and other appurtenances be constructed and built in and to serve
said Lateral Sanitary Sewer District Number 252 as created b;r Section 1 of this
ordinance along the follordn,g course, to -wit:
Ali 8 inch clay pipe sewer beginning
at an existing manhole,at intersection
of alley first south of Gypsum Avenue
and alley first east of Delaware Ave-
nue; thence south in said alley east
of Delaware Avenue 165 feet more or
less to the center line of Stack Ave-
nue where a manhole is to be con-
structed, which will be the terminus
thereof.
Section 3. That the CityEngineer shall on or before June 26, ,
1950 prepare and file in the office of the City Clerk, plans and specifications
for the construction of the lateral sanitary sewer provided for in the preced-
in- sections of this ordinance which shall be of proper character'to serve the
property lying -within the district which such sewer is to be constructed and
shall on or before the same date prepare and submit to the Board of Commission-
ers a detailed estimate under oath of the cost thereof. That hereafter the
City Clerk shall advertise for three consecutive dyas in the official city paper
for shaled proposals for the building and construction of ."ach smuer according
to such plans and specifications,;hich proposals shall be filed ith the City
Clerk on or before the time fixed in such notice, at which time the Board of
Commissioners may let a contract for the building and construction of such sewer
to the lowest and best responsible bidder or bidders therefor, if there by any
whose bids do not exceed the estimated cost thereof, but said Board shall
reserve the right to reject any or all such proposals, and if no bid shall be
received within such estimate, the Board of Commissioners shall have the power
to do such work and make such improvements within the estimated cost thereof as
provided by law.
Section 4. That {'or the cost of building and constructing such sewer,
special assessments shall be made for the full cost thereof on all lots and
pieces of land within and for which such serer shall be built, according to
the appraised value thereof, without regard to the improvements or build—
ings thereon.
Section 5. After the passage and publication of this ordinance, the
Board of Commission_>rs shall appoint three disinterested appraisers, who
having taken oath to make a true and impartial appraisement of all lots and
pieces of land to taxation for the cost of such improve,nents, shall z�rithin
five days after having been notified of their appointments proceed to appraise
all of the lots and pieces of land within such district liable to assessment
and taxation as aforesaid, without regard to the buildings or improvements

thereon, and after making such appraisement, shall return to the Board of
Commissioners of said city and said Board shall designate a time for a special
meeting of said Board for the purpose of hearing any complaints that may be
made as to the value of any lot or piece of land appraised as aforesaid, of
which special session due notice shall be given in the official city paper,
at which special session said Board may alter any valuation of any lot or
piece of land if, in their opinion, the same has been appraised too high or
too low.
Section 6. The special assessment herein provided for may be paid by the
person liable therefor in four approximately equal annual installments but the
owner of any property liable to such assessment may ti,ithin thirty days from
the date of determining the amount assessed against the property, pay the
same in full and his property shall not be liable for any assessments for
the cost of such improvements, :_;.nd bonds as hereinafter provided for shall be
issued in the amount of the cost of such improvements remaining unpaid at the
end of the thirty days from the time such assessment is fixed.
Section 7. For the purpose of paying for the work and improvements in
this ordinance provided for, the Board of Commissioners may and are hereby
authorized and direct to issue im m ovement bonds of the City of Salina, Kansas
in an amount not to exceed the cost of such improvement, and to run for a
period of four years and be payable in four appro=iimately equal innual install—
ments, together 7,ith interest not to exceed five ,,ger cent ;; r annum, which
bonds shall be issued and payable according to law; and for the -eur_ ose of
paring the principal and interest on said bonds as the,-- severally become due
and payable the Board of Commissioners shall a:-lportion and assessagainst
the lots and pieces of land v,-ithin the taxin-- district of such impm
roveents,
special assessments covering the cost of such imarovement and apportionment
therein contained shall hold good for all of the installments that are to be
collected from the specific property chargeable with such improvements; such
assessment and apportionment ordinance shall contain the total amount of
tax apportioned to each tract, piece or parcel of land ti,;ithin the taxing
district and shall state the number of annual installments in YLich such
tax is to be collected; and thereafter the City Clerk shall annually, at
the sane time that other taxes are certified, certify to the County Clerk
of Saline County, Kansas, a full list of all property liable for such work
and improvements, together with the respective numbered amounts due on each
of said tracts. pieces or parcels of land., which amounts shall include the
annual installments and interest on all unpaid balances for one year at the
rate of not to exceed five per cent per annum, on such amounts so certified,
which shall be collected as other taxes are collected.
Section 3. This ordinance shall take effect and be in force from and
after its publicatio-, once in the official city paper.
