Aid ORDIUkNICE relating to and apportioning and lev,--ing special assessments
on certain lotsand pieces of ground in the City of Salina, Kansas, to pay
the cost of curbing, guttering, paving and grading of Lincoln Avenue from
the crest line of Twelfth Street to the east line of Eleventh Street;; for
the curbing, guttering and paving of McAdams Road from the center line of
Roach Street to the east line of Front Street; for the paving and grading
of Claflin ,avenue from the west line of Fourth Street to the -rest line of
Osborne Street; and for the paving and grading of Pershing Street from
the south line of Kirva_n Avenue to the north line of C aflin Avenue; and
relating to and providing for the collection and payment of such assess-
ments.

BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That for the purpose of paying for that Dart of the cost
of improgements of certain portions of certain streets as hereinafter set
forth in the following sections of this ordinance which is chargeable to
the private property in the assessments districts for each of such improve-
ments, respectively, as set forth in the following sections of this ordinance
with respect to each of such improvements there are hereby- levied and assessed
on the property liable therefor, being all the lots and pieces of ground
lying on each or either side o2 -said streets so improved, respectively, to
the middle of the distrance improved, with respect to the improvements men-
tioned in Sections 2, 3, 4, and 5 of this ordinance, according to the appraised
value of such lots and pieces of ground with respect to each such improvement,
without regard to the buildings or improvements thereon„ special assess-
ments covering the cost of such iwork and improvements and said special assess-
ments being based on the special valuation and appriasement of said lots and
pieces of ground heretofore made by three disinterest appraisers a, -.pointed by
the Board of Commissioners of the City of Salina, K4nsas, with respect to each
such improvement, which said appraisements are hereby referred to and made
parts of this ordinance, and the several amounts levied, apportioned and
assessed against the lots and pieces of ground for each of such improvements,
respectively, for the purpose aforesai-., are hereby found and determined to
be the amounts set forth in the follm,;ing sections of this ordin.:nce -mith
respect to each of said improvements.
Section 2. For that part of the cost of curbing, guttering, paving
and grading of Lincoln Avenue from the west line of T,,relfth Street to the
east line of Eleventh Street, -which is chargeable to the private property
-within the district chargeable therefor, and which cost :is hereby determined
to be $3,620.86, there is hereby levied, apportioned and assessed against
the follo-wing described lots and pieces of land as provided for in Section 1

Section 6. Said amounts levied, apportioned and assessed aforesaid
-ill be due and collectible in ten equal installments, the first becoming
due with the taxes levied for the year 1950 and one of said installments
falling due each and every year thereafter until all are paid, and all to
be collected with interest as in this ordinance provided, PROVITIED, HODMER,
that the owner of any piece of property liable for any assessment may redeem
a
his roperty from such liability by Daying into the City Treasury the entire

amount chargeable against the same, as in this ordinance designated, at any
time znrithin thirty days after the publication of this ordin.nce and before

the issuance of bonds of said city in payment of the balance of the cost of
said improvements, and the property so paid on shall not thereafter be liable

for any further assessments for the cost of said improvements nor for any
part of said bonds.
Section 7.. There is hereby further levied and assessed against each
lot and piece of ground described in this ordinance, interest at such rate
i
per annum as shall be borne by the bonds hereafter to be issued for the
payment of the remaining, unpaid cost of such improvements, to be hereafter
determined and fixed by ordinance When such bonds are issued, on all of said
installments mentioned and provided for in this ordinance, from the date of
the bonds vrhich may be issued at the end of thirty days as specified in the
proceeding sections hereof, as by lav- provided, to the time of collection
of the last installment as provided by la -v, v,hich said interest shall be
collected annually at the same time and in the same manner as said install-
ments are collected, and after the takin effect of this ordinance and the
fixing of said interest rate v hen such bonds are authorized and issued, it
shall be the duty of the City Cleric of said city to annually at the same
time other taxes are certified and until all of said installments and assess-
ments so apportioned and levied herein have been certified, to the County
Cleric of Saline County, Kansas, a full list of all property liable to assess-
ment and taxation for such -cork and i.m-1rovement, except such property on
-which the special assessments aforesaid have been paid in full as hereinbefore
provided, together mrith the respective amounts due on each of such lots and
pieces of ground, vihich amounts shall include the annual installments of such
special assessments together mith the interest for one year at the rate to be
fixed as provided for in this ordinance, on all unpaid balances of such assess-
ments, and such amounts so certified as herein provided shall be placed u pon
the tax roll by the County Clerk of Saline County, Kansas, and collected as
other taxes are collected.
Section 8. This ordinance shall take effect and be in force from and
after its publication once in the official city paper.
