ORDINANCE IMMER 5464 - (Published in the Salina Journal , 1950 AiT ORDINANCE relating to and apportioning and levying special assessments j on certain streets and lots and pieces of ground in the City of Salina, A d' of Front Street appraisers appointed by the Board of Commissioners of the City of Salina, Kansas, with respect to each such improvement, which said appraisements are hereby referred to and made parts of this ordinance, and the several amounts levied, apportioned, and assessed against the lots and pieces of ground for each of such improveents, respectively, for the ,purpose aforesaid as hereby found and determined to bethe amounts set forth in the follo­ring sections of this ordinance with respect to each of such improvements. Section 2. For that part of the cost of curbing and guttering of Front Street from the north line of Republic Avenue to the center line of Cra-w ford Avenue, which is chargeable to the private property within the district chargeable therefor, and which cost is hereby determined to be 07,761.70, there is hereby levied,, apportioned and assessed against the folloiving described lots and pieces of land as provided for in Section 1 of this ordinance the folloi,�,.ng amounts: i East side of Front Street from Crawford to McAdams Road COLLEGE VIE -C.- ADDITION A tract along the east side of Front Street from Crawford toYcAdams Road - - - - - - - - - - - - - - - - - 2,041.o4 Kansas, to pay the cost of curbing, guttering an grab to the center line of Crawford from the north line of Republic Avenue for the curbing, guttering and grading of the west side of Roach Avenue; Street from the north line of Claflin Avenue to the south line of Ka.r yin Avenue;- MUMEOff011 for the curbing, guttering and grading of Third Street from the south line of Prescott Avenue to the center line of Cra�rrford Avenue; for the curbing guttering and grading of Venango Street from the east line of Hancock Street to the zrest line oT erri 1 Street; and relating to nd providing for the collection and payment of such assessments. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That for the purpose of paying for that part of the cost of improving certain portions of certain streets as hereinafter set fort in the folIovring sections of this ordinance ti-rhich is chargeable to the privat e property in the assessment districts for each of such improvements, respect- ively, as set forth in the following sections of this ordinance -with respect I to each of such improvements, there are hereby levied and assessed on the property liable therefor, being all of the lots and pieces of ground lying on either side of said streets so improved, respectively, to the middle of the block for the distance improved, with respect to the improvements men- tioned in Sections 2, 3, 4, 5, XBOdK of this ordinance, according to the appraised value of such lots and pieces of ground -w-ith respect to each of such improvements, -vrithout regard to the buildings or improvements thereon, special assessments covering the cost of such work and improvements, and special assessments being based on the special valuation and appraisement of said lots and pieces of ;ground heretofore made by three disinterested appraisers appointed by the Board of Commissioners of the City of Salina, Kansas, with respect to each such improvement, which said appraisements are hereby referred to and made parts of this ordinance, and the several amounts levied, apportioned, and assessed against the lots and pieces of ground for each of such improveents, respectively, for the ,purpose aforesaid as hereby found and determined to bethe amounts set forth in the follo­ring sections of this ordinance with respect to each of such improvements. Said amounts levied, ap_iortioned and assessed aforesaid will be due and collectible in four equal installments, the first becoming due with the taxes for the gear 1950 and one of said installments falling, due each and every year thereafter until all are paid, and all to be collected t�rith interest as inthis ordinance provided, PROVIBEB, IICUM ER, that the oiner of any piece of property liable for any such assessment may redeem his property from such liability by pa7&ing into the City Treasury the entire amount chargeable against the same, as in this ordinance desig- nated, at any time -;,Zthin thirty days after the yC)ublic: tion of this ordinance and before the issuance of bonds of said city in pa�-ment of the balance of the cost of said improvements, and the property so paid on shall not there- after be liable for any further assessments for the cost of said improve- ments nor for any part of said bonds. Section 7. There is hereby further levied and assessed against each lot and piece of ground described inthis ordinance, interest at such rate per annum as shall be borne by the bonds hereafter to be issued for the pay- ment ayment of the remaining unpaid cost of such improvements, to be hereafter determined and fixed by ordinance when such bonds are issued, on all of said installments mentioned and provided for in this ordinancei from the date of the bonds -which may be issued at the end of thirty days as specified in the preceding sections hereof, as by law provided, to the time of the collection of the last installment as provided by laz-r, --;hich said interest shall be collected annually at the same time and in the same manner as said installments are collected, and after the taking effect of this ordinLince and the fixing of said interest rate rahen such bonds are authorized and issued,it shall be the duty of the City Clea: of said city to annually at the same time other taxes are certified and until all of said assessments so apportioned and levied herein have been certified, to the County Clerk of Saline County, Kansas, a full list of all property liable to assessment and taxation for such .,rork and improvement, except such property on pddch the special assessments aforesaid have been paid in full as hereinbefore provided, together tivi.th the respective amounts due on each of such lots and pieces of ground, Yvhich amounts shill include the annual installments of each special assessment together rriith the interest for one year at the rate to be fixed as provided for in this ordinance, on all unpaid balances of such assessments, and such amounts so certified as herein provided for 1 shall be placed upon the tax roll by the County Clerk of Saline County, Kansas, and collected as other taxes are collected. Section 8. This ordinance shall take effect and be in force from and after its :publication once in the official city paper.
