AN ORDINANCE relating to and apportioning and levying special assessments oncertain
lots and pieces of ground in the City of Salina, Kansas, to pay the cost of curbing,
guttering and grading of Fifth Street from the north line of Antrim Avenue to the
center line of Otis Avenue; for the curbing, guttering and grading of Grand Avenue
from the west line of Tenth Street to the west line of Eleventh Street; for the curb-
ing, guttering and grading of Illinois Street from the west line of Sheridan Street
to the east line of Merrill Street and I1=ois Street from the west line of Merrill
Street to the east line of Hancock Street; for the curbing, mattering and grading of
Kirrjin Avenue from the west line of Pershing Street to the center line of Funston
Street; for the curbi_nr, guttering and grading of Reynolds Street from the center line
of Lincoln Street to the center line of Broadway Boulevard; and for the curbing, ,;utter
ing; and grading of Third Street from the north line of Republic Avenue to the south
line of Lot 13, projected west, Block 5 in Hutchinson's Addition to the City of
Salina, being approximately 453 feet north and south; and relating to and providing
for the collection and payment of such assessments.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas;
Section 1. That for the purpose of paying for that part of the cost of improv-
ing certain portions of certain streets as hereinafter set forth in the following
sections of this ordinance which is chargeable to the private property in the assess-
ment districts for each of such improvements, respectively, as set forth in the
following sections of this ordinance with respect to each of sudh improvements,
there are hereby levied and assessed on the property liable therefor, being all of
the lots and pieces of ground lying on either side of said streets so improved,
respectively, to the middle of the block for the distance improved, with respect to
the improvements mentioned in Sections 2, 3, 4, 5, 6, 7, of this ordinance, according
to the appraised value of such lots and pieces of ground with respect to each such
improvement, without regard to the buildings or improvements thereon, special assess-
ments covering the cost of such work and improvements, and special assessments being
based on the special valuation and appraisement of said lots and pieces of ground
heretofore made by three disinterested appraisers appointed by the Board of Conuni-
ssioners of the City of Salina, Kansas, vrith respect to each such improvement,
which said appraisements are hereby referred to and made parts of this ordinance,
and the several amounts levied, apportioned and assessed against the lots and pieces
of ground for each of such improvements, respectively, for the purpose aforesaid as
hereby found and determined to be the amounts set Forth in the following sections of y
this ordinance with respect to each of such improvements.
Section 2. For that part of the cost of curbing and guttering of Fifth Street
from the north line of Antrim Avenue to the center line of Otis Avenue, which is
chargeable against the private property within the district chargeable therefor,
and which cost is hereby determined to be $1,323.21 there is hereby levied, apport-
ioned and assessed against the following described lots and pieces of land as pro-
vided for in Section 1 of this ordinance the follovring amountss

Section 8. Said amounts levied, apportioned and assessed aforesaid will be due
and collectible in four equal installments, the first becoming due with the taxes for
the year 1950 and one of said installments falling due each and every year thereafter
until all are paid, and all to be collected with interest as in this ordinance pro-
vided, PROVIDED, HOWEVER, that the owner of any piece of property liable for any such
assessment may redeem his property from such liability by paying into the City Treasury
the entire amount chargeable against the same, as in this ordinance designated, at
any time within thirty days after the publication of this ordinance and before the
issuance of bonds of said city in payment of the balance of the cost of said improve-
ments, and the property so paid on shall not thereafter be liable for any further
assessments for the cost of said improvements nor for any part of said bonds.
Section 9. There is hereby further levied and assessed against each lot and
piece of ground described in this ordinance, interest at such rate per annum as shall
be borne by the bonds hereafter to be issued for the payment of the remainin- unpaid
cost of such improvements, to be hereafter determined and fixed by ordinance when
such bonds are issued, on all of said installments mentioned and provided for in this
ordinance, from the date of the bonds which may be issued at the end of thirty days
as specified in the preceding sections hereof, as by law provided, to the time of the
collection of the last installment as provided by law, which , -aid interest shall be
collected annually at the same time and in the same manner as said installments are
collected, and after the taking effect of this ordinance and the fixing of said
interest rate ivhen such bonds are authorized and issued, it shall be the duty of the
City Clerk of said city to annually at the same time other taxes are certified and
until all of said assessments so apportioned and levied herein have been certified, to
the County Clerk of Saline County, Kansas, a full list of all property on which the
special assessment and taxation for such work and improvements is chargeable, except
such property on which the special assessments aforesaid have been paid in full as
hereinbefore provided, together with the respective amounts due on each of such lots
and pieces of ground, which amounts shall include the annual installments of such
special assessments together with the interest for one year at the rate to be fixed
as provided for in this ordinance, on all unpaid balances of such assessments, and
such amounts so certified as herein provi4d for shall be placed upon the ta:: roll

by the County Clerk of Saline County, Kansas, and collected as other taxes are
collected.
Section 9. This ordinance shall take effect and be in force from and after
its publication in the official city* paper.
