5467 Street ImprovementsORM r,ANCE iiU BER 5467_- -- first Published in the Salina Journal 1950) AN ORDNANCE providing for the curbing, �utterin,g and grading of Beloit Avenue from the wrest line of Quincy Street west approximately 300 feet; Connecticut 1,,,enue from the north line of Gypsum Avenue to the south line of Stapler Avenue; Delawrare Avenue from the north line of Gypsum Avenue to the south line of Stapler Avenue; South side of Hamilton Avenue from the center line of Eleventh Street to the center line of Wrelfth Street; Harsh Avenue from the center line of Eleventh Street to the center line of Twelfth Street; Indiana Avenue from the center line of Gy;ipsum Avenue to the south line of Stapler Avenue; Pacific Avenue from the center line of Elevenh Street to the center line of Twelfth Street; Stapler Ave nuE; from the center line of Delaware Avenue to the east line of Indiana Avenue; Twelfth Street from the center line of Pacific Avenue to the center line of Harsh Street; East side of Twelfth Street from the center line of Harsh Avenue to the center line of Hamilton Avenue and the north side of Filson Street from the wrest line of Front Street to the east line of Third Street and on the south side of 1,7ilson Street from the west line of Front Street to a point 125 feet west of the west line of Second Street; and pro- viding for the pa�,ment of the cost thereof, and ha;; the same shall be assessed and the manner of payment thereof. 1THEREAS, by Resolutions Numbered 1155, 1167, 1168, 11-48, 1151, 1169, 1152, 11.70, 1150, 1119 and 1116, duly adopted November 7, 1949, March 6, 1950 and September 19, 1949, respectively, the Board of Commissioners of the City of Salina have declared that they deem it necessary to curb, gutter and grade each: Beloit Avenue from the west line of Quincy Street wrest approximately 300 feet; Connecticut Avenue from the north line of Gypsum Avenue to the south line of Stapler Avenue; Delaware Avenue from the north line of Gypsum Avenue to the south line of Stapler A7,enue, South side of Hamilton Avenue from the center line of Eleventh Street to the center line of TwreL th Street; Harsh Avenue from the center line of Eleventh Street to the center line of Twelfth Street; Indiana Avenue from the center line of Gypsum Avenue to the south :Line of Stapler Avenue; Pacific Avenue from the center line of Eleventh Street to the center line of Twyelfth Street; Stapler Avenue from the center line of Delaware Avenue to the east line of Indiana Avenue; Twelfth Street from the center line of Pacific Avenue to the center line of Harsh Street; East side of Twelfth Street from the center line of Harsh Avenue to the center line of Hamilton Avenue; and the north side of Wilson Street from the west lire of Front Street to the east line of Third Street and on the south side of ?ri'il_son Street from the west line of Front Street to a point 125 feet west of tine west line of Second Street. 7y,,HEREAS, each of said resolutions were duly published for six days in the Salina Journal, a daily newspaper published in said city, and being the official paper of that city, and the majority of the resident property owners owninga majority in square feet of the lots or real estate liable to taxation for the cost of said improvements did not wy'ithin twenty days from the date of the last publication thereof file writh the City Glerk a sufficient protest, in waiting, against the making of said improvements, no protests of any kind having; been filed: NOT THEREFORE BE IT OR.DAI1ED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That it is necessary- and it is hereby ordered that Beloit Avenue from the nest line of Nincy Street viest approximately 300 feet in said city be curbed, and guttered with excavation necessarir therefore and graded and to the established paving Prade to each side thereof, as may be necessary for the completion of said work. Section 2. That it is necessary and it is hereby ordered that Connecticut jvenue from the north line of Gypsum Avenue to the south 1_ne of Stapler ATrenue in said city be curbed and guttered with excavation necessary therefore and graded and to the establish ed paving grade to each side thereof, as may be necessary for the completion of said work. Section 3. For -the ti,rork improvements herein provided for the City Engineer shall make and file with the City Clerk on or before the 15th day of May , 19501 complete plans and specifications for the curbinn, guttering and grading (vrith excavation necessary therefore) of each of the streets or portions thereof described in Sections 1 to 11 inclusive of this ordinance, �riith the folloiring type of i,:�p­ove- ments: Concrete combined curb and gutteon each side thereof 30 inches wide.f rom back of curbing to paving line, curb 12 inches deep at back, gutter 6 inches deep, and the neeessary grading of each to the established paving grade between the curb and gutter lines on each side thereof and within the limits of said streets herein- before described, and said engineer shall on or before the same date, submit to the Board of Commissioners under oath, detailed estimates of the cost of such work for such improvements. Section 13. That after such plans and specifications sha11 have been made and prepared by the City Engineer and _filed ti,rith the City Clerk as aforesaid, the Board of Commissioners may advertise by advertisement published in the official city paper of the City of Salina, Kansas, for three consecutive days for the receipt of sealed proposals for the improving; of said streets Trith the kind of material named and speci- fied in the preceding sections hereof, and for the excavation a.nd grading necessary for the completion of such work, and after the receipt of such proposals the said Board of Commissioners may and are hereby authorized to let contracts for the improving of said streets with materials selected by them to the lowest responsible bidder or bidders thereof, as determined by said Board of CortiRdssioners and for such excavation and grading. Said Board of Commiss_oners reserve the right to reject any and all bids. Section 14. That for the improving of the above mentioned streets such assess- ments shall be made for the full costs thereof according to law, on all lots and pieces i of land to the center of the block on either side or both sides of the streets to be improved according to the appraiser's valuation thereof without regard to the buildings or improvements thereon for the distance to be improved. Section 15. After the passage of publication of this ordinance, the Board of Commissioners shall appoint three disinterested appraisers, householders, who after having taken an oath to make a true and impartial appra.isement for all lots and Pieces of land liable to assessments and taxation for the cost of the improvements herein pro- vided for, shall vdthin five �.ays from having been notified of their appointment, pro- ceed to appraise said lots and pieces of land liable to assessment and taxation as afore- , j said, as may be designated by the Board of Commissioners of said city and said board of Commissioners shall designate a time and place for the hearing of any complaints that may be made as to the value of any lots or pieces of land appraised as aforesaid, of which due notice shall be ,riven in the official city paper, at which hearing, the Board of Commissioners may alter any valuation of any lot or piece of land, if, in their 1 opinion, the same has been appraised too high or too low. Section 15. That for the purpose of paying the cost of the work and improvements I in this ordinance, provided for, the Board of Commissioners are hereby authorized and directed to issue internal improvement bonds oil the City of Salina in an amount not to i exceed the contract price or cost of such improvements and to run for a period of four years and be payable in four equal installments, together with interest not to exceed five per cent ?ger annum, -,lhich bonds shall be made payable at the fiscal agency of the State of Kansas, and for the purpose of paying principal and interest on said bonds as they severally become due and payable, the Board of Commissioners shall apportion and assess against the lots and pieces of land tirithin the taxin7 district of such im- provements, special assessments covering the cost of such improvements and the apportion- ment herein contained shall hold rood for all the installments that are to be collected from the specific property chargeable urith said improvements. Such assessment and apportionment ordinance s-riall contain the total amount of tax apportioned to each tract, piece and parcel of land within the taxing district and shall state the number of annual installments in Which such tax is to be collected; and therefore, the City Clerk shall annually at the same time other taxes are certified, certify to the County Clerk of Saline County Kansas, a full list of,? all property liable to such rrork and impvwement, together o,ith respective amounts due on each of said tracts, pieces of land, which amounts shall include the annual installments and interest on all balances for one year at the rate of not to exceed five per cent per annum, on such amounts so certified v�,hich shall be collect- ed, P='QUILLD, that for the purpose of defraying the cost of improving the intersections and areas formed by the crossing streets and alleys, and for the grading of said street where the same is provided for in this ordinance as well as where the same is provided for in this ordinance as well as where the improvement is through or adjacent to which the City is liable, the assessment will be made against property of the city for all taxable property of tlhe city and paid by the city at large. Section 17. That this ordinance shall take effect and be in force from and after its publication once in the official_ city paper.
