5466 Street Improvements--- --- --- ORDI.IATICL T�iJh`T3ER - - 5466 (First Published in the Salina Journal 1V 1950) AN ORDIiTANCE providing for the paving and grading and for the curbing, guttering and paving of certain streets in the. City of Salina, Kansas described as follows: for the paving and grading of Front Street from the south line of Crawford Avenue to the north line of Re- public Avenue; and for the curbing, guttering, paving and grading of Claflin Avenue from the west line of Eleventh Street to the east line of Pershing Street, and for the curbing, guttering, paving and grading of Twelfth Street from the south line of Broadway Boulevard to the south line of Grand Avenue, and providing for the payment of the cost thereof, .pow the same shall be assessed, and the manner of the pavment of the cost thereof. ?IM''iL S, by Resolutions numbered 1160,1173 and 1158, duly adopted December 5, 1949, 1,arch 27, 1950 and November 28, 1919, respectively, the Board of Commissioners of the City of Salina, Kansas have declared that they deem it necessary to pave and grade Front Street from the south line of Crawford Avenue to the north line of Republic Avenue, and to curb, gutter,pave and grade Claflih Avenue from the west line of Eleventh Street to the east line of Pershing Street, and to curb, gutter, pave and grade Twelfth Street from the south line of T3roadvray Boulevard to the south line of grand Avenue, all together ri_th such excavation and grading as may be necessary and for the grading of each thereof. OTEREAS, each of the said resolutions were published for six days in the Salina. Journal, a daily newspaper published in said city, and being the official city paper, and the majority of the resident property o,mers owning a majority of square _feet of the lots or real estate liable to taxation for the cost of said improvement did not -within tuaenty days from the date of the last ;publication thereof file ,^ith theCity Clerk a sufficient protest in irriting against the making of said improvements, no protests of any kind 'having been filed. 1110171 BE IT ORDAInTED BY the Board of Commissioners of the City of Salina., ,ansas : Section 1. That it is necessary and it is hereby ordered that 1,ront Street from the south line of Crawford Avenue to the north line of Republic Avenue in _,aid city be paved and graded vidth excavation necessary therefor, and graded to the established pavinc, grade and paved between the guttering lines thereof. Section 2. That it is necessary and it is hereby ordered that Cla."lin Avenue frog. the west line of Eleventh Street to the east line of Pershing Street in said city be curbed, guttered and paved with excavation necessary therefor, and graded to the established paving grade and paved between the guttering lines thereof. Section 3. That it is necessary and it is hereby ordered that Twelfth Street from the south line of Broad,vay Boulevard to the south line of Grand Avenue in said city be curbed, guttered and paved, ,rith excavation necessary therefor, a.nd graded to the established paving grade and paved between the guttering lines thereof. Section 4. 'That for the Tr;ork and improvements herein provided for the City Engineer shall make and file ,+rith the City Clerk on or before the 15th day of May 1950, complete pi ns and specifications for the curbing, ;uttering, paving -and ;raging ,^rith excavation necessary therefor, of each of the streets or portions thereof described in Section 2 to 3 inclusive, of this ordinance, with the following type of improvement: Concrete combined curb and �tter on each side thereof, 30 inches ,verde from back to curb to paving line, curb 12 inches deep at back, gutter 6 inches deep, and the necessary nrading of each to the es- tablished paving tirade, vdthin the limits of said streets hereinbe- fore priescribed. Section 5. That for the work and is ,provements herein provided for the City Enri_neer shall make and file with the City Clerk on or before the 15th day of Iay ' 1950, comvlete plans and specifications for the curbing;, gutterin� pavinc; and grading vn. excavation necessary therefor, of each of the streets or portions thereof described -in Sect ; on 1 of this ordinance, „+rith the follond-ng type of improvement : The naving thereof rrith six inch reinforced concrete between the curb and glitter lines on each side thereof and ,.;Zthin the 15 --nits of said street hereinbefore prescribed and said En`rineer shall on or before the same ,ia.te, submit to the Board of Commissioners under oath, detailed estimates of the cost or: such work and improvements. Section That after such plans and specifications have been rude and prepared by the City Engineer and filed with the City Clerk as aforesaid, the Board of Com- missioners may advertise by advertisement published in the official city paper of the City of Salina, Kansas, for three consecutive days for the receipts of sealed proposals for the improving of said streets with the kind of material named and specified in the preceding sections hereof, and for the excavations and grading necessary for the comple- tion of such work, and after the receipt of such proposals, the said Board of Commissioners may and are hereby authorized and directed to let contracts for the improving of said streets with the materials selected by them to the lowest resoonsi.ble bidder of bidders therefor, as determined by said Board of Commissioners, and for such excavations and grading. Said Board reserves the richt to reject any and all bids. Section 3. That for the improving of the above mentioned streets, such assessments shall be made for the full costs thereof according to lavr, on all lots and pieces of land to the center of the block on either side of the streets to be improved according to the appraisers valuation thereof, without regard to the buildings or improvements thereon for the distance to be improved. Section ye. After passage and publication of this ordinance, the Board of Oommissiones shall appoint three disinterested appraisers, householders, who after having taken oath to make a true and impartial appraisement of alllots and pieces of land liable to assess- ment and taxation as a"oresaid, as may be designated by the Board of Commissioners of said city, without regard to the building or improvements thereon and after making such appraisement shall return the same to the Board of Commissioners of said city and said Board of Commissioners shall designate a time and place for the hearing of any comb► plaints that may be made as to the value of any lots or pieces of land appraised as af ore - said, of ,..ihich due notice shall be given in the official city paper, at ;which hearing the Board of Commissioners may alter any valuation of any lot or piece of land, if, in thdAr opinion, the same has been appraised too high or too law. Section . That for the purpose of paying the cost of the work and improvements in this ordinance provided for, the Board of Commissioners are hereby authorized and directed to issue internal improvement bonds of the City of Salina in an amount not to exceed the contract price or cost of such improvements and to run for a period of ten years and be payable in ten equal installments, together with :interest not to ex- ceed five per cent per annum, which bonds shall be made payable at the Fiscal Agency of the State of Kansas, and for the purpose of paying principal and interest on said bonds as they severally become due and payable, the Board of Commissioners shall apportion and assess against the lots and pieces of land vdthin the taxing district of such improvements special assessments covering the cost of such improving and the apportionment herein contained shall hold Mood for ,11.11 the installments that are to be collected from the specific property chargeable with said improvements. Such assess- ment and apportionment ordinance shall contain the total amounts of tax apportioned i 1 to each tract, piece or parcel of land within the taxing district and shall statt the number of annual installments in which si:ch tax is to be collected; and therefor the City Clerk shall annually, at the same time other taxes are certified, certif7r to the County Clerk of Saline Counter, Salina, Kansas, a full list of all property liable for such work and improvements, together i-:rith the respective amounts due on each of said tracts, pieces of land, hich amounts shall include the annual installments and interest on all unpaid balances for one y.:ar at the rate of not to exceed five per cent per annum on such amounts so certified which shall be collected as other taxes are collected; Provided, that the purpose of defraying the cost of improving the intersections and areas formed by the crossing of streets and alleys, and for the grading of said streets there the same is provided for in this ordinance as well as ivhere the improvement is through or adjacent to property of the City for which the city liable, the assessments will be made against all taxable property of the city and paid by the city at large. Section/®. This ordinance shall take effect and be in force from and after its publication once in. the official city paper.
