City of Salina, Kansas, designated as Lateral Sanitary Sevier District Number
250 and providing for the construction of a lateralsanitarh ?- se;Rrer in said
Lateral SanitaryJScluer District Plumber 2.50, so created, and providing, for the
pa ,ment of the cost thereof and for the levying of special assessments against
the property in said district for the payment of the cost of such construction
of and for the issuing of bonds to pay the cost triereof.
BE 1T O DAPIM by the lioard of Commissioners of the City of Salina, Kansas:
Section 1. Lateral Sanitary Sewer District Number 250. That there be and there is
hereby created lateral sanitary sewer district in the City of Salina, iiansas, which
shall be and it is hereby desianated as Lateral Sa.nit ry Server District NIumber 250 and
vrnich district shall include all the follov,7ing described property in the City of Salina,
Kansas, to-7vit :
Benefit District: Lots 1, 2, 3, 4 and 5, Block 3, and
Lots 6. 7, 8, 9 and 10, Block 4, all in Hutchinson's
Addition, City of Salina, Kansas.
Section 2. It is neceesary and it is hereby ordered that an ei^;ht inch V. C. P.
lateral, :anitary se,7(-r �,ith all necessary connections, manholes, flushing tanks, and
other appurtenances be constructed and built in and to serve said Lateral Sanitary
Sewer District Nui}ber 250 as created by Section 1 of this ordinance orlon, the folloti,_ng
course, to -mit:
An 8 inch clay pipe serer beginning at an existing manhole
in the intersection of r'ou.rth Street and Lamar Street; thence
east alonthe center line of Third Street 310

manhole ti°Jill be constructed tivhich will be the terminus thereof .
Section 3. That the City Engineer shall on or before iviay 8th
prepare and file in the office of the City Clerk, plans and sp,cifications for the
construction of the lateral sanitary sewer provided for in the precedin sections of
this ordinance i'.,iiich shall be of proper character to serve the property lying within

the district ,,jhich such se,,,rer is to ';e const:_-ucted and shall on or before the same date
prepare and st<br,ut to the Board of Commissioners a detailed estirate under oath of the
cost thereof. That hereafter the Citir C1-rk shall advertise for three consecutive days
in the official city paper for sealed proposals for the building and construction of
such sevier according to such plans and spec-'."ications, -.-ihich proposals shall be filed
;,ith the City Clerk on or before the time fixed in such notice, at ,which time the Board
of Commissioners ma -1- let a contract for the building and construction of such se:,:er to
the to -:;est and best res_,onsible bidder or bidders threefor, if there be any ;,.-hose bids
do not exceed the estimated cost thereof, but said Board shall reserve the right to re-
ject any or all such proposals, and if no bid shall_ be received Trvithin such estimate, the
Hoard of Cormissi.oners shall have the )omer to do such -cork and make such improvements
ti:.'ithin the estimated cost thereof as provided b, law.
Section 4. That for tele cost of buildinc, and constrtuctinh such seg^,er, special
assessments shall be made for the full_ cost thereof on alllots and pieces of land :;ithin
and for uhi.ch suclh sez^rer sh_ll Oe built, according; to tl_e appraised value thereof, �,vithout
retard to the improvements or buil-dings thereon.
Section 5. After the passage and publication of this ordinance, the Board of
which such tax is to be collected; and thereafter the City Clerk shall annually, at the
sa7;e time other taxes are certified, certify to the County clerk of Saline County,
Kansas, a full list of all property liable for such work and improvements, together
licith the respective numbered amounts due on each of said tracts, piece or parcel of
land, 1.ihich amounts shall i.rcl.ude the annual installments and interest on all unpaid
balances for one year at the rate of not to exceed five percent per annum, on such
amounts so certified, y:rhich shall be collr:cted as other taxes are collected.
Commissioners shall appoint three disinterested appraisers, tiiho after having taken

oath to make a true and impartial appraisement of all lots and pieces of land to
taxation for the cost of such improvements, shallvithin Five days after having been
notified of -their appointments proceed to appraise all of the lots and pieces of land
within such district liable to assessment and taxation as aforesaid, i^iithout regard to
the buildings or improvements thereon, and after nakirg such a,_praiseraent, shall return
to the Board of Commissioners of said city and said Board shall designate a time for
a special meeting of said Board for the purpose of hearin7 any complaints that may be
made as the value of any lot or piece of land anpraised as aforesaid, or 4^.Bich special
session due notice shall be ,given in the official city paper, and at filich special
session said Board may alter any valuation of any lot or piece of land if, in their
opinion, the same has been ar)praised too high or too low.
Section 6. The special assessment herein provided for may be paid by the person
liable therefor in four approximately equal annual installments but the owner of any
property liable to such assessment may tidthin thirty days from Vle day of determining
the amount assessed against the property, pay the same in full and his property shall
not be liable for any assessments for the cost of such improvements, and bonds as here-
inafter provided for shall be issued in the amount of the cost of such improvements
remaining unpaid at the end of the thirty datis from the time such assessment is fixed.
Section 7. For the purpose ofpaging for the work and improvements in this
ordinance provided for, the Board of Commissioners may hereby and are authorized and
directed to issue improvement bonds of the City of Salina, Kansas, in an amount not to
exceed the cost of such improvement, and to run for a period of four years and be pay-
able in four approximately equal annual installments, together with interest not to
exceed five percent per annum, iRrhich bonds shall be issued and payable according to lair;
and for the purpose of paying the principal and interest on said bonds as they severally
become due and payable the Board of Commissioners shall apportion and assess against
the lots and pieces of land v^,ithin the taxing district of such improvements, special
assessments covering the cost of such improvement and apportio::ment therein contained
shall hold ..00d for all of the installments that are to be toll-cted from the specific

property chargeable with such improvements; such assessment and apportionment ordinance

shall contain the total amount of tax apportioned to each tract, -)iece or parcel of
land tivithin the taxing district and shall state the number of annual installments in
which such tax is to be collected; and thereafter the City Clerk shall annually, at the
sa7;e time other taxes are certified, certify to the County clerk of Saline County,
