5457 Levy AssessmentsI 0-UIT"UNCE NO. 5457 (Published in the Salina Journal 1950)- AN ORDI';ANCE relating to and apportioning and levying special assessments on certain lots and pieces of ground in the City of Salina, Kansas to pair the cost of grading and paving of a certain north and south alley between Twelfth Street and Thirteenth Street from the south line of Bishop Street south to the south line of Lot 6, ex- tended west, on Twelfth Street, in leavers Second Addition, to the City of Salina, Kansas; and for the paving of the alley lying between Tenth Street and Eleventh Street, from the south line of Noodland Avenue, thence south 200 feet, and relating to and providing for the collection and payment of such assessments. BE IT 010AIl"ED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That for the purpose of paying for the cost of paving and grading of a certain north and south alley between Twelfth Street and Thirteenth Street from the south line of Bishop Street south to the south line of Lot 6, extended west, on Twelfth Street, in l4Yeavers Second Addition, to the City of Salina, Kansas, and the paving of the alley lying between Tenth Street and Eleventh Street, from the sout# line of Woodland Avenue, thence south 200 feet, as hereinafter set forth, being all of the lots and pieces of ground abutting upon the alleys, according to the appraised value of such lots and pieces of ground vrith respect to such improvement, without regard to the buildings or improvements thereon, special assessments covering the cost of such work and improve- ments said special asses=sments being based on the special valuation and appraisement of said lots and pieces of ground heretofore made by three disinterested appraisers appointed by the Board of Commissioners of the City of Salina, Kansas, with respect to such im- provement, ,vhich said appraisement is hereby referred to and made a part of this ordinanoe and the several amounts levied, apportioned and assessed against the lots and pieces of ground for such improvement, respectively for the purpose aforesaid are hereby found and determined to be the amount set forth in the following sectionsof this ordinance with respect to such improvement. Section 2. Said amounts levied, apportioned and assessed aforesaid shall be due and collectible in ten equal ins'allments the first becoming due z,;rith the taxes levied for the year 1950'=lnd one of said installments falling due each and every year there- after until. all are paid, and all to be collected V,d.th interest as in this ordinance provided, P '_OIDED, W.'.EVE:R, that the owner of any piece of property liable for any such assessment may redeem his property from such liability by paving into theCity Treasury the entire amount chargeable against the same, as in this ordinance designated, at any time within thirty days after the puhlication of: this ordinance and before the issuance of the bonds of said city in payment of the balance of the cost of said im- provements, and the property so paid on shall not thereafter be liable for any further assessments for the cost of said improvements nor for any part of said bonds. Section 5. There =_s hereby,- further levied and assessed against each lot and piece of mound described in this ordinance interest at such rate per annum as shall be borne by the bonds thereafter to be issued for the payment of the remaining unpaid �l 1 cost of such improvements, to he determined and fixed by ordinance v,,hen such bonds are issued, on all of said installments mentioned and provided for in this ordinance, from the date of the bonds which may be issued at the end of thirty days as specified in the preceding section hereof, as by law provided, to the time of the collection of the last installment as 1>rovided by lavr, xhich said interest shall be collected annually I at the same time and in the same manner as said installments are collected, and after the taking effect of this ordinance and the fixing of said interest rate vrhen such bonds are authorized and issued, it shall be the duty of the City Clerk of said city to annually at the -same time other taxes are certified and until all of said assessments so apportioned and levied herein have been certified, to certify to the County Clerk of Saline Count. 1 Kansas, a full list of all property liable to assessment and taxation for such ,,rork and improvements, except such property on which the special assessments aforesaid have been paid in full as hereinbefore provided, together with the respective amounts due on each of such lots and pieces of ground, which amounts shall include the annual installments of such special assessments together vcith the interest for one year at the rate to be fixed as provided for in this ordinance, on all unpaid balances of such assessments, and such amounts so certified as herein provided for shall be placed upon the tax roll by the County Clerk of Saline County, Kansas, and collected as other taxes are collected.
