AN ORZ)I_:ANCE relating to and apportioning and levying special assessments on certain
lots and pieces of ground in the City of Salina, Kansas, to pay the cost of con-
structing lateral sanitary seviers in Lateral Sanitary Sever Districts numbered
240, 241, 212, 243 and 244, relating to and providing for the collection and pay-
ment of such assessments.
BE IT ORD11ITULZ by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That for the purpose of paying for the cost of building and constructing
lateral sanitar-y sewers in Lateral Sanitary Seti,,er Districts numbered 240, 241, 242,
24.3 and 244, as authorized by the provisions of Ordinances Number 5376, 5378, 5387
and 5.00, the cost of which has been duly ascertained as shown bzT the City Engineer's
Final Estimate of Cost, which has been duly approved by the Board of Commissioners,
there are hereby levied and assessed on the property liable therefor, being all of the
lots and pieces of around lying in the sevier districts mentioned above as created by
Ordinances Number 5376, 5378, 5387 and 5400, according to the appraised value of such
lots and pieces of ground without regard to the buildings or improvements thereon,
special assessments covering the cost of such improvements constructed in said sever
districts, said special assessment being based on the special valuation and appraise-
ment made by three disinterested appraisers appointed by the Hoard of Commissioners of
the City of Salina, Kansas, yhich said appraisement is hereby referred to and made a
part of this ordinance, and the several amounts levied and apportioned against the lots
and pieces of .ground in said sewer districts for the purpose of paying the cost of the
improvements constructed in such district being he.reblT found and determined to be as
set forth in the following sections of this ordinance.
Section 2. That for the payment of the cost of construction of Lateral Sanitary
Setter Tdumber 240, beginning at an existing manhole in Front Street °ehich is 29 feet
east of the viest line of front Street and 22 feet north of the south line of "i Voodland
Avenue; thence vest 159 feet on a line 22 feet north of the south line of :7oodland
Avenue to the center line of an alley, next east of Second Street, extended north, to
a manhole to be constructed; thence south in center line of said alley 532 feet to a
manhole to be constructed being the south terminus of said sever; and further beginning
at said manhole to be constructed in 17oodland Avenue thence due north 303 feet, the
amount levied, apportioned and assessed against the lots and pieces of ground in said
district are found and determined to be as follows:

Section 7. Said amounts levied, apportioned and assessed as aforesaia shall be
due and collectible in four equal installments, the first becoming due with the taxes
levied for the year 1950, and one of said installments falling due each and every year.
thereafter until all are paid, all to be collected :^.pith interest as in this ordinance
provided, PROV"IDEDD I1070iER, that tie ov,ner of any piece of property liable for any such
assessment may redeem his property from such liability by payin- into the City Treasury,
the entire amount chargeable against the same as in this ordinance designated, at any
time vdthin thirty days after the publication of this ordinance, and before the issuance
of the bonds of said city in payment of the cost of said improvements, and his property
so paid on shall not thereafter be liable for any further assessment for the cost of
said improvements nor for any part of said bonds.
Section 8. There is hereby further levied and assessed against the lots and pieces
of ground described in this ordinance interest at such rate per annum as shall be borne
by the bonds hereaf Ler to i)e issued for the payment of the remaining unpaid cost of such
improvements, such rate to be hereafter determined and fixed by ordinance whe ouch

bonds are issued, on all of said installments mentioned and provided for in this ordin-
ance,, from the date of the bonds which may be issued at the end of thirty days as speci-
fied in the preceding section hereof as by law, provided, to the time of collection of
the last installment as provided by law, which said interest shall be collected annually
at the same time and in the same manner as said installments are collected, and after
taking effect of this ordinance and t -ie fixing of the interest rate 7ahen such bonds are
authorized and issued, it shall %>e the duty of the City Clerk of said city to annually
at the same time other taxes are certified, and until all of said installments as
apportioned and levied herein have been certified, to certify to the County Cleric of
Saline County, Kansas, a full list of all property liable to assessment and taxation for
such work and improvements except such property on which the special assessments afore-
said have been paid in full as hereinbefore provided, together tiiith the respective
amounts due on each of such lots and pieces of ground, vrhich amounts shall include the
annual installments of such special assessments together with the interest for one year

at the rate to be fixed as p-ovided, in this ordinance, being#the rate borne by the bonds
to be issued on all unpaid balances of such assessments, and such amounts so certified
as herein provided shall be placed upon the tax roll by the County Clerk of Saline
County, Kansas, and collected as all other taxes are collected.
Section 9. This ordinance shall take effect and be in foe from and after its
publication once in the official city paper.
