Taylor Construction Company for the construction of certain curbing, guttering, paving and grading improvements of certain streets in the City of Salina, and providing for the issuance of temporary notes to pay the cost thereof pending the issuance and sale of bonds. BE IT ORDAINED by the Board of Commissioners of the City of 'Salina, Kansas: Section 1. That the acceptance by the City of Galina, Kansas, of the proposal of the H. J. Taylor Construction Company, here -in -after referred to as the "Contractor" as submitted to the Board of Commissioners on November 28, 1949, which is hereby found to be the lowest bid for such work, and the contract awarded by the Board of Commissioners of said city to said contract and signed on behalf of the City by its Mayor on December 5, 1949 for the construction of certain public improvements in the City of Salina, Kansas, to -wit: Curbing, guttering, paving and grading of Lincoln Avenue from the west line of Twelfth Street to the east line of Eleventh dtreet, as provided for by Ordinance Number 5430. Curbing, Guttering, paving and grading of McAdams Road from the center line of Roach to the east line of Front atreet, as provided by Ordinaace Number 5430, Paving and grading of Claflin -&venue from the west line of Fourth Street to the west line of Osborne Street, as provided by Ordinance Number 5430, Paving and grading of Pershing Street from the south line of Kirwin Avenue to the north line of Claflin Avenue, as provided for in Ordinance Number 5430, at and for the unit prices for said work contained in said proposal, which proposal and contract are hereby referred to and made parts of this ordinance, be the same is hereby ratified and confirmed, said proposal being within the estimated cost of said improvements as shown by the sworn estimates of the City Engineer on file in the office of the City Clerk, which estimates are hereby referred to and made a part of this ordinance. Section.2. Said improvements- shall be built and constructed in accordance with the plans and specifications therefor prepared by the City Engineer on file in the office of the City Clerk and in accordance with the proposal of said contractor and under the terms of said contract, all of which are hereby referred to and made parts of this ordinance. Section 3. That temporary notes signed by the 4kyor and attested by the City Clerk be issued from time to time as the work progressed in the manner and form provided and requiered by law, the total amount thereof not to exceed the i contract price for such work, such notes to bear interest not to exceed 42 per cent per annum and to mature not later than April 1, 1951 and to be issued in i such amounts and at such times as money for the payment of the cost of such notes be issued to said contractor and to be redeemed and cancelled at the time that permanent bonds are issued in lieu thereof.
