BE IT ORDA.I,LD by the Board of Commissioners of the City of Salina, Kansas. Section 1. Lateral Sanitary Sewer District Number 246. That, there be and there is hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, ;i,iich shall be and it is hereby designated as Lateral Sanitary Sewer District Number 246 and 1nrhich district shall include all of the following described property in the City of Salina, Kansas, to-?,rit Benefit District - Lateral Sevrer 246. All of Block 8, Morningside Addition in the City of Salina, Kansas. Section 2. It is necessary and it is hereby ordered that an eight inch V. C. P. lateral sanitary sewer vrith all necessary connections, manholes, flushing, tanks and other appurtenances be constructed and buLlt in and to serve said Lateral Sanitary Severer District 246 as created by Section 1 of this ordinance along the following course, to-vrit: An 8 inch clay pipe sewer beginning at a manhole in Front Street which is 30 feet west of the east line of Front Street and 172 feet north of the north line of Republic Avenue; thence east along center line of 14 foot right-of-way 722.5 feet,more or less,to the center line of Sunrise Drive at which point a manhole 7dll be constructed, which will be terminus of lateral. Section 3. Lateral Sanitary Sewer District Number 247. That there be and there is hereby created Lateral Sanitary Sevti-er District in the City of Salina, Kansas, vrhich shall be and it is hereby designated as Lateral Sanitary Sewer District Number 242 and vinich district shall include all of the followi.n� described property in the City of Salina, Kansas, to -,zit: Benefit District - Lateral Sewer 247. All of Lot 6, Phillips East Salina Addition and all of Lots 23 and 24, Surveyor's Plat No. 8, all in the City of Salina, Kansas. Section 4. It is necessary and it is hereby ordered that an eight inch V. C. P. lateral sanitar;: sewer vrith all necessary connections, manholes, flushing tanks and other appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District 247 as created by Section 3 of this ordinance along the following course, to -wit: An 8 inch clay pipe se -vier beginning at an existing lamp hole in alley first north of Gypsum Avenue and 40 feet west of the west line of Connecticut A,,enue; thence east along center line of said alley to the center .line of Delaware Avenue, there a manhole to be constructed and at vihich point sewer vri.11 branch both north and south. North branch shall continue north on center line of Delaware Avenue 170 feet to the center line of Stapler, Avenue; thence east along center line of Stapler Avenue 410 feet to a manhole to be constructed, vr'zich mill be terminus of north branch of lateral. South branch of lateral will begin at manhole in Delaware Avenue and center line of alley first north of Gypsum extended east, thence south 95 feet; thence east 410 feet to a point -A'�lich is 127.9 feet north of the north line of Gypsum Avenue, there a manhole to be constructed which will be terminus of said lateral. Section 5. That the City En-ineer shall on or before December 12th 1949) prepare and file in the office of the City Clerk, plans and specifications for the con- struction of the lateral sanitary sewers pr ovided for in the preceding sections of this ordinance mhich shall be of prover character to serve the property lying Vdthin the dis- trict within ,,rich such sewers are to be constructed and shall on or before the same date !prepare and submit to the Board of Commissioners a detailed estimate under oath of the cost thereof. That thereafter the City Clerk shall advertise for three consecutive days in the official city paper for sealed proposals for the building and construction of such se?^yers according to such plans and specifications, vrhich proposals shall be filed fdth the City Clerk on or before the time fixed in such notice, at which time the Board of Commissioners may let a contract for the building and construction of such sewers to the lowest and best responsible bidder or bidders therefor, if there be; any ,.-vnose bid does root exceed the estimated cost thereof, but said Board shall reserve; the right to reject any or all such proposals, and if no bid shall be received within such estimate, the Board of Commiss _overs shall have t'ae power to do such .work and make such improvements vnthin the estimated cost thereof as provided by law. Section 6. That for the cost of building and constructing such sewers, special assessments shall be made for the full cost thereof on all lots and pieces of land in the sewer districts within and for z�r-,ich such sewers shall be built, according to the appraised value thereof, without regard to the improvements or buildings thereon. Section 7. After the passage and publication of this ordinance, the Board of Com- missioners shall appoint three disinterested appraisers, 1who having taken an oath to make a true and impartial appraisement of all lots and pieces of land to taxation for the cost of such improvements, shall within five days after having been notified of their appoint- ment proceed to appraise all of the lots and pieces of land within such districts liable to assessment and taxation as aforesaid, without regard to the bu'..ldings or improvements thereoni, and after making such appraisements shall return to the Board of CoTw:lissioners of said City and said Board shall designate a time for holding a special meeting of said Board fcr the purpose of hearing any complaints that ma -7 be made as to the value of any lots or pieces of land upraised as aforesaid, of ,rhich special session due notice shall be given in the official city paper, and at -v;hick special session said Board may alter any valuation of any lot or piece of land, if, in their opinion, the same has been appraised too high or too low. Section 8. The special assessment herein provided for may be paid by the person j liable therefor in four approximately equal annual insta.'. Lments but the oti, er of any within thirty days from the date of determining property liable to such assessment may in full and his property shall not the amount assessed against the property pay the sum i 1 be liable for assessment for the cost of such improvements, and bonds as hereinafter provided for shall be issued in the amount of the cost of such improvements remaining unpaid at t}ze end of thirty.days from the time such assessment is fixed. Section 9. For the purpose of paying for * the work and improvements in this ordin- ance provided for, the Board of Commissioners are hereby authorized and directed to issue bonds of the City of Salina in an amount not to exceed the cost of such improvements and to run for a period of four years and be payable in four approximately equal annual in- stallments, together with interest not to exceed five per cent per annum, which bonds shall be issued and payable according to lav, and for the purpose of paving the principal and interest on said bonds as they severally become due and payable, the Board of Com- m_ssioners shall apportion and assess against the lots or pieces of land vaithin the taxing district of such improvements, special assessments covering the cost of such improvement and apportionment therein contained shall hold good for all of the install- ments nstall-ments that are to be collected from the specific property chargeable with such improve- ments, such assessment and apportionment ordinance shall contain the total amount of tax apportioned to each tract, piece or parcel of land within the taxing district and shall state the number of annual installments in vrhich such tax is toe collected; and th2re- after the City Clerk s_zall annually, at the same time other taxes are certified,.certify to the County Clerk of Saline County, Kansas, a full list of all property liable to such work and improvements, together with the respective amounts due an each of said tracts, d, which amounts sciall include the annual installments and in - pieces or parcels of lan terest on all unpaid balances for one year at the rate of not to exceed five per cent per annum, on such amount so certified, which shall be collected another taxes are collected. Section 10. This ordinance shall take effect and be in force from and after its adoption and publication once in the official city paper.
