WMREAS, pursuant to proceedings duly had according to law, contracts have been let and performed for the construction of the following street improvements in the City of Salina, Kansas, to -bait: Paving and grading of Beloit Street from the west line of Fourth Str et to the west line of Osborne Street, as provided by Resolution Number 1019 and Ordinance Number 5294. Paving and grading of Chicago Street from the north line of Ash Street to the north line of Park Street, as provided by Resolution Number 1008 and Ordinance Number 5294. Paving and grading of Fifth Street from the south line of Grand Avenue to the north line of Woodland Avenue, as provided by Resolution Number 1017 and Ordinance Number 5294. Paving and grading of Fourth Street from the south line of Pacific Avenue to the south line of Forest Avenue, as provided by Resolution Number 1018 and Ordinance Number 5294. Paving, grading and excavating of Front Street from the north line of Ash Street to the south line of Elm Street, as provided by Resolution Number 987 and Ordinance Number 5294. Curbing, guttering, paving and grading of Republic Avenue from the east line of Osborne Street to the east line of Quincy Street, as provided by Resolution Number 1065 and Ordinance Number 5340. Curbing, guttering, paving and grading of Sunrise Drive from the north line of Beloit Street to the south line of Republic Avenue, as provided by Resolution Number 1063 and Ordinance Number 5340. WHEREAS, the total cost of said improvements has been ascertained and the portion there- of in the amount of $74,750.67 to be paid by general taxes to be levied upon all taxable property within said city for the improvement of squares and areas formed by the cross- ing of streets and alleys and for the improvement of any of said streets where the same is through or adjacent to property of the city for which the city is liable, and for zrnich bonds are to be issued; and me -MAS, the total cost of said curbing, guttering, paving and grading of said streets, which are to be paid by special assessments and to be levied upon lots and pieces of ground liable for the payment of said curbing, guttering, grading and paving in said streets has been ascertained and has been hereby found and determined to be the sum of $181,158.33, which amount has been heretofore duly assessed and apportioned to the several lots and pieces of ground liable therefor according to law provided for in the ordinance of the City of Salina, Kansas, relating thereto, duly passed and approved of which amount the sum of $1.3,211.94 has been paid by the property oi,1ners liable therefor, leaving a balance of $167,946.39 for which bonds are to be issued; and .TIEREAS, bonds in the aggregate sum of $242,697.06 are to be issued to pay the actual cost thereof; BE IT ORDAINED by the Board of Conrnissioners of the City of Salina, Kansas: I Section 1. That the f orego?ng preambles be and they are hereby authorized as a Bart j of this ordinance and that for the purpose of providing fu4ds to pay the cost of the improvements herein above referred to and described in the ordinances and resolutions hereinbefore referred to, there shall be issued Internal Improvement Bonds of the City of Salina, Kansas, in the total principal sum of $242,697.06, which shall consist of I two hundred forty-two bonds, numbered 1 to 242, inclusive, all dated December 1, 1949, 1kkA#_ t1VT_&W..rods/V.Mber6k ope. Bonds numbered 27 to 50 for $1,000.00 each, due December 1, 1951. Bonds numbered 51 to 74 for $1,000.00 each, due December 1, 1952. Bonds numbered 75 to 98 for $1,000.00 each, due December 1, 1953. Bonds numbered 99 to 122 for $1,000.00 each, due December 1, 1954. Bonds numbered 123 to 146 for $1,000.00 each, due December 1, 1955. Bonds numbered 147 to 170 for $1,000.00 each, due December 1, 1956. Bonds numbered 171 to 194 for $1,000.00 each, due December 1, 1957. Bonds numbered 195 to 218 for $1,000.00 each, due December 1, 1958. Bonds numbered 219 to 242 for $1,000.00 each, due December 1, 1959. Section 2. Said bonds shall be signed by the Magor and shall be attested by the signature of the City Clerk and corporate seal of the City shall be affixed Hereto and said bonds shall have attached thereto interest coupons representing the interest thereon, ii ich coupons shall be in the form provided by law and shall bear the printed or lithographed facsimile signature of the Ma -,'or and City Clerk of said city and said bonds and interest coupons shall be registered in the office of the City Clerk and in the office of the Auditor of State, as required by law. Section 3. And it is hereby declared and certified that all acts, conditions, and things required to be done and exist precedent to and in the issuance of this bond have been properly done and performed and do exist in due and regular form and manner as required by laws and the constitution and laws of the State of Kansas, and that the total indebtedness of said city, including this series of bonds, does not ex- ceed any constitutional or statutory limitation.
