5422 Levy Assessments.4 . 1 1 QRDINANCE MOER 5422-1 - —.---- -- (Published in the Salina Journal AN ORDI',TATTCE relating to and apportioning and levying special assessments on certain lots and pieces of ground in the City of Salina, Kansas, to pay the cost of grading and paving Eighth Street from the north line of Pacific Avenue to the north line of Hans Avenue; for the grading and Paving Avenue from the west line of Ninth Street to the east l negoffgll anrthircle; or e grading and paving of Highland Circle from the south line of Ellsworth Avenue to the south line of Jewellvenue; or the grading and paving of Jewell Avenue from the west line of Eleventh Street to the west line of Pershing Mreetp and relating to and providing for the collection and payment of such assessments. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. For the purpose of paying for that part of the cost improve- of ments of certain portions of certain streets as hereinafter set forth in the following sections of this ordinance which is chargeable to the private property in the assessment districts for each of such improvements, respectively, as set forth in the following sections of this ordinance vlith respect to each of such improvements there are hereby levied and assessed on the property liable therefor, being all the lots and pieces of ground lying on either side of said streets so improved, respectively, to the middle of the block for the distance improved, with respect to the improvements mentioned in Sections 2, 3, 4 and 5 of this ordinance, according to the appraised value of such lots and nieces of ground with respect to each such improvement,without regard to the build- ings or improvements thereon, special assessments covering the cost of such work and improvements, said special assessments being based on the special valuation and appraise- went of said lots and pieces of ground her tofore made by three disinterested appraisers appointed by the Board of Cormdssioners of the City of Salina, Kzsas, with respect to each such improvement, which said appraisements are hereby referred to and made parts of this ordinance, and the several amounts so levied, apportioned and assessed against the lots and pieces of ground for each such improvements, respectively, for the purpose a- foresaid., are hereby found and determined to be the amounts set forth in the following sections of this ordinance vrith respect to each of said improvements. Said amounts so levied, apportioned and assessed aforesaid will be due and collectible in ten equal installments, the first becoming due with the taxes levied for the year 1950 and one of said installments falling due each and every year thereafter until all are paid, and all to be collected with interest as is in this ordinance provided, PROVIDED, HOYTEVER, that the owner of any piece of property liable for any such assessment may redeem his property from such liability by pariTjg into the City Treasury the entire amount chargeable against the same, as in this ordin- ance designated, at any time yvi thin thirty days after the publication of this ordinance and before the issuance of bonds of said City in payment of the balance of the cost of said improvements and the property so paid on shall not thereafter be liable for any further assessments for the cost of said improvements nor any part of said bonds. Section 7. There is hereby further levied and assessed against each lot and piece of ground described in this ordinance, interest at such rate per annum as shall be borne by the bonds hereafter to be issued for the payment of the remaining unpaid cost of such improvements, to be hereafter determined and fixed by ordinance when such bonds are issued, on all of said installments mentioned and provided for in this ordinance,' L1 (SLAT,) Introduced, August 8 19 49 Passed, August 29, 1949 Attest: O City ler Mayor i i from the date of the bonds which may be issued at the end of thirty days aseci ' sP fled in the preceding sections hereof, as by law provided, to the tide of the collection of the installment as provided by law, which said interest shall be collected annually at the same time and in the same manner as said installments are collected, and after the taking effect of this ordinance and the fixing of said interest rate when such bonds are authorized and issued it shall be the � duty of the City Clerk of said City to annually at the same time other taxes are certified and until all of said assess— ments so apportioned and levied have been certified tified to the County Clerk of Saline County, j Kansas, a full list of all property liable to assessment and taxation for such work and improvement, except such property on which the special assessments aforesaid have been paid in full as hereinbefore' provided, together with the respective amounts due on each of such lots and pieces of ground, which amounts shall include the annual install— ' ments ments of such special assessments together with the interest for one year at the rate to be fixed as provided for in this ordinance, on all unpaid balances of such assess— ments, and such amounts so certified as herein provided for shall be placed upon the tax roll by the County Clerk of Saline County, Kansas, and collected as other taxes are Collected. Section 8. This ordinance shall take effect and be in force from and after its publication once in the officialcity paper.
