lots and pieces of ground in the City of Salina, Kansas, to pay the cost of con-
structing lateral sanitary sewers in Lateral Sanitary Sewer Districts numbered
236, 237, 238 and 239, relating to and providing for the collection and payment
of such assessments.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas.
Section 1. That for the purpose of paying for the cost of building and construc-
ting lateral sanitary sewers in Lateral Sanitary Sewer Districts numbered 236, 237, 238
and 239, as authorized by the provisions of Ordinances Number 5368, 5371 and 5372, the
cost of which has been duly ascertained as shown by the City Engineer's Final Estimate
of Cost, which has been duly approved by the Board of Commissioners, there are hereby
levied and assessed on the property liable therefor, being all of the lots and pieces of
ground lying in the sewer districts mentioned above as created by Ordinances Number 5368,
5371 and 5372, according to the appraised value of such lots and pieces of ground iL thout
regard to the buildings or improvements thereon, special assessments covering the cost of
such improvements constructed in said sewer districts, said special assessment being based
on the special valuation and appraisement made by three disinterested appraisers appointed
by the Board of Commissioners of the City of Salina, Kansas, which said appraisement is
hereby referred to and made a part of this ordinance, and the several amounts levied and
apportioned against the lots and pieces of ground in said seTimr districts for the purpose
of paying the cost of the improvements constructed in such district being hereby found and
determined to be as set forth in the following sections of this ordinance.
Section 2. That for the payment of the cost of construction of Lateral Sanitary
Sewer Number 236, beginning at an existing manhole 30 feet viest of the east line of Quincy
Street and 128 feet north of the north line of 1.4inneapolis Avenue, thence east along the
dedicated easement right-of-way for utilities in Block 3 of Sunrise Addition to said city,
565 feet to a manhole to be constructed at a point approximately 1140 feet southwesterly
from the west line of Sunrise Drive; thence northeasterly approximately 180 feet, in the
dedicated easement right-of-way for utilities in Block 3 and 5 of said addition including
traversing said Sunrise Drive, to a manhole to be constructed; thence southeasterly in
said dedicated easement in said Block 5, 260 feet to a man:riole to be constructed, being
the terminus thereof; and a branch line on the aforesaid sewer commencing at said manhole
to be constructed approximately 40 feet southwesterly from the :vest line of said Sunrise
Drive, thence southeasterly 115 feet in said dedicated easement in said Block 3, to a man-
hole to be constructed, being the terminus of said branch, the amount levied, apporticn-�d

are issued, on all of said installments mentioned and provided for in this ordinance,
from the date of the bonds -diich may be issued at the end of thirty days as specified in
the preceding section hereof as by law, provided, to the time of collection of the last

installment as provided by law, which said interest shall be collected annually at the
same time and in the same manner as said installments are collected, and after taking
effect of this ordinance and the fixing of the interest rate when such bonds are author-
iped and issued, it shall be the duty of the City Clerk of said city to annually at the
same time other taxes are certified, and until all of slid installments as apportioned
Iand levied herein have been certified, to certify to the County 'clerk of Saline County,
Kansas, a full list of all property liable to assessment and taxation for such work and

improvements, except such property on mhich the special assessments aforesaid have been
paid in full as hereinbefore provided, together tivth the respective amounts due on each

Section 6. Said amounts levied, apportioned and assessed as aforesaid shall be
due and collectible in four equal installments, the first becoming due vd th the taxes
I' levied for the year 1950, and one of said installments falling due each and every year
thereafter until all are paid, all to be collected with interest as in this ordinance
provided, P;OVIDED H0I7EVER, that the oamer of any piece of property liable for any such
assessment may redeem his property from such liability by paying into the City Treasury,

the entire amount chargeable against the same as in this ordinance designated, at any
time within thirty days after the publication of this ordinance, and before the issuance
of the bonds of said city in payment of the cost of said improvements, and his property
so on shall not thereafter be liable for any further assessment for the cost of said
paid

improvements nor for any part of said bonds.

Section 7. There is hereby further levied and assessed against the lots an pieces
of ground described in this ordinance interest at such rate per annum as shall be borne
by the bonds hereafter to be issued for the payment of the remaining unpaid cost of such
improvements, such rate to be hereafter determined and fixed by ordinance when such bonds

are issued, on all of said installments mentioned and provided for in this ordinance,
from the date of the bonds -diich may be issued at the end of thirty days as specified in
