5417 Street ImprovementsORDINANCE NUMBER 5417 - Cdr �al�na-�at�rnal AN ORDINANCE providing for the curbing, guttering and paving and grading of Crawford Avenue from the east line of Fourth Street to the east line of Fifth Street; and for the paving of -Kirwin Avenue from the west line of Fourth Street to the west line of Osborne Street; and for the paving of Kansas Avenue from the north line of Gypsum Avenue to the south line of Iron Avenue; and for the peeving of Quincy Street from the south line of Republic Avenue to the north line of Beloit Street; and for the curbingand guttering g g of Quincy Street from the north line of Republic Avenue to the south line of Beloit Street; and for the curbing, guttering and paving of Quincy Street from the south line of Beloit Street to the south line of Kirwin Street; and for the paving of Third Street from the north line of North Street to the south line of the Union Pacific Right -of -Way; and providing for the payment of the cost thereof, how the same shall be assessed, and the manner of the payment of the cost thereof. WHERFAS, by Resolution Numbers 1124, 1126, 1133, 1094, 1115, 1120,1113, duly adopted June 6, 1949s June 13, 19490 July 18, 1949, March 28, 1949,May 16, 19490 May 23, 1949, and b-ky 16, 1949, respectively, the Board of Commissioners of the City of Salina, Kandas, have declared that they deem it necessary to curb, gutter, pave and grade Crawford Avenue from the east line of Fourth Street to the east line of Fifth Street; necessary to pave Kirwin Avenue from the west line of Fourth Street to the west line of Osborne Street; necessary to paveand grade Kansas Ave. from the north line of Gypsum Avenue to the south line of Iron Avenue; Necessary to pave and grade Quincy Street from the south line of Republic Avenue to the north line of Beloit Street; necessary to curb and gutter Quincy Street from the north line of Republic Avenue to the south line of Beloit Atreet; necessary to curb, gutter and pave Quincy Street from the south line of Beliot Street to the south line of Kirwin Street; necessary to pave Third Street from the north line of North Street to the south line of the Union -Pacific Right -of Way, all to- gether with such excavation and grading as may be necessary and for the grading i of each thereof. WHEREAS, each of the said resolutions were published for six days in the Salina Journal, a daily newspaper published in said city, and being the official city paper, and the majority of the resident property owners owning a majority of square feet of the lots or real estate liable to taxation for the cost of said improvement did not within twenty days from the date of the last publication thereof file with the City Clerk a sufficient protest in writing against the making of said improve- ments, no protests of any kind having been filed; NOW THEREFROM: BE IT ORDAINED by the Board of Commissioners of the City of Sglina,Kansas: Section 1. That it is necessary and it hereby ordered that Crawford Avenue from the east line of Fourth Street to the east line of Fift h,Streets in said city be curbed, guttered and paved with excavation necessary therefor, and graded to the established paving grade and paved between the the guttering lines thereof. Section 2. That it is necessary and it is hereby ordered that Kirwin Avenue from the west line of Fourth Street to the west line of Osborne Street, in said city be paved ,with excavation necessary therefor, and graded to the established paving grade and paved between the guttering lines thereof. Section 3. That it is necessary and it is hereby ordered that Kansas Avenue from the north line of Gypsum Avenue to the south line of Iron Avenue, in said city be paved, with excavation necessary therefor, and graded to the established paving grade and paved between the guttering lines thereof. Section 4. That it is necessary and it is hereby ordered that quincy Street from the south line of Republic Avenue to the north line of Belmit Street, in said city be paved with excavation necessary therefor, and graded to the established paving grade and paved between the guttering lines thereof. i Section 5. That it is necessary and it is hereby ordered that Quincy Street from the north line of Republic Avenue to the south line of Belmit Street, in said city be curbed and guttered with the excavation necessary thereof, and graded to the established paving grade to each side thereof, as may be necessary for the for the completion of said work. Section 6. That it is necessary and it is hereby ordered that 14uincy Street from the south line of Beloit Street to the south line of Kirwin Street, in said city be curbed, guttered and paved with excavation necessary therefor, and graded to the establidhed paving grade and paved between the guttering lines thereof. Section 7. That it is necessary and it is hereby ordered that Third Street from the north line of North Street to the south line of the Union pacific i Right -of Way, in said cit be y paved with excavation necessary therefor, and graded to the establishedavin grade and P g gr paved between the guttering thereof. Section Be That for the work and improvements herein provided for, the City Engineer shall mkke and file with the City Clerk on or before the 12th day of `September , 1949, complete pk ns and specifications for the curb- ing, guttering, paving and grading with excavation necessary therefor, of each of the streets or portions thereof described in Sections 1 to 7, both inclusive, of this ordinance, with the following type of improvement: Concrete combined curb and gutter on each side thereof, 30 inches wide from back of curb to paving line, curb 12 inches deep at back, gutter 6 inches deep; and the nee - j essary grading of each to the established paving grade, and theavin p g thereof with six-inch reinforced concrete between the curb and gutter lines on each side thereof and within the limits of said streets hereinbefore pres- cribed; I and said Engineer shall on or before the same date, submit to the Board of Commissioners under oath, detailed estimates of the cost of such work and imp- 1 rovements. Section 9. That after such plans and specifications have been made and prepared by the city Engineer and filed with the City Clerk as aforesaid, the Board of Commissioners may advertise by advertisement published in the official city paper of the City of Salina, Kansas, for three consecutive days for the receipts of sealed proposals for the improving of said streets with the kind of Material named and specified in the preceeding sections hereof, and for the exc- avations and grading necessary for the completion of such work, and after the i receipt of such proposals, the said Board of Commissioners may and are hereby authorized and directed to let contracts for the improving of said streets with ' I the materials selected by them to the lowest responsible bidder or bidders there- for, as determined by said Board of Com;iissioners, and for such excavations and grading. Said Board reserves the right to reject any and all bids. Section 10s That for the improving of the above mentioned streets, such assessments shall be made for the full costs thereof according to law, on all lets I and pieces of land to the center of the block on either side of the streets to be improved according to the appraiser's valuation thereof, without regar d to the buildings or improvements thereon for the distance bo be improved. Section 11. After the passage and publication of this ordinance, the Board 1 of Commissioners shall appoint three disinterested appraiserd, householders, arho after having taken oath to make a true and impartial appraisement of all lots and pieces of land liable to assessment and taxation as aforesaid, as may be designated i by the Board of Commissioners of said city, without regard to the buildings or improvements thereon and after making such appraisement shall return the same to the Board of Commissioners of said city and said Board of Commissioners shall designate a time and place for th-v hearing of any complaints that may be mate as to the value of any lots or pieces of land appraised as aforesaid, of which due notice shall be given in the official city paper, at which hearing the Board Of Commissioners may alter any valueation of any lot or piece of land, if, in their opinion, the same has been appraised too high or too lour. Section 12. That for the purpose of paying the cost of the work and improve- ments in this ordinance provided for, the Board of Commissioners are hereby auth- orized and directed to issue internal improvement bonds of the City of Salina in an amount not to exceede the contract price or cost of such improvements and to run for a period of ten years and be payable in ten equal installments, together with interest not to exceed five per cent annum, which bonds shall be malt payable at the Fiscal Agency of the State of Kansas, and for the purpose of paying prin- cipal and interest on said bonds as they severally become due and payable, the Board of Commissioners shall apportion and assess against the lots and pieces of land within the taxing district of such improvements special assessments covering the cost of such improving and the apportionment herein contained shall hold good for all the installments that are to be collected from the specific property chargeable with said improvements. Such assessment and apportionment ordinance shall contain the total amognts of tax apportioned to each tract, piece or parcee of land within the t xi:ng district and shall state the number of annual install- ments in which such tax is to be collected; and therefor the City Clerk shall annually, at the same time other taxes are certified, certify to the County Clerk of Salina, County, Kansas, a full list of all property liable for such work and improvements, together with the respective amounts due on each of said tracts, pieces of ]ean.d, which amounts shall include the annual installments and interest on all unpaid balances for one year at the rate of not to exceed five per cent annum on such amounts so certified which shall be collected as other taxes are collected: Provided, that the purpose of defraying the cost of improving the intersections and areas formed by the crossing of streets and alleys, and for the grading of said streets where the same is provided for in this ordinance as well as where the improvement is through or adjacent to property of the City for which the city is liable, the assessments will be made against all taxable property of the city and paid by the city at large. Section 13.
