5416 Street Improvements- - — - �i-snarlhe ----------- A.- 0ADIICkNOE providing for the curbing, guttering and gradin- of Front Street from the north line of Republic Avenue to the center line of Crawford Avenue; for the curbing and guttering of the west aide of Roach Street from the north line of Claflin Avenue to the south line of Kirwin Avenue; for the curbing and guttering of Thirteenth Street from the south line of Grand Avenue to the center line of Broadway Boulevard; for the curbing; and guttering of ThirdStreet, from the soutli line of Prescott Avenue to the center line of Crawford Avenge; for the curbing and guttering of Vanango Street from the east line of Hancock Street to the west line of ivierrill Street; and providing for the payment of the cost there- of, and how the same shall be assessed and the manner of payment thereof* sLE ir&S, by Resolutions _`Dumber 1118, 1130, 11160 11190 1125, duly adopted on lay 23, 1949; June 27, 1949; May 16, 1949; May 23, 1949; June 13, 1949; respect- ively, the Board of Commissioners of the City of Salina have declared that they deem it necessary to curb, gutter,• and grade each; Front Street from the north line of Republic Avenue to the center line of Crawford Avenue .Roach Street from the north line of Claflin Avenue to the south line of Kirwin Avenue; Thirteenth Street from the south line of Grand Avenue to the center line of Broadway Boule- vardl Third Street, from the south line of Prescott Avenue to the center line of Crawford Avenue; Vanango Street from the east line of Hancock Street to the west line of l.lerrill Street. each of said resolutions were duly published for six days in the Salina Journal, a daily newspaper published in said city, and being the official paper of that city, and the majority of the resident property oviners owning a majority in square feet of the lots or real estate liable to taxation for the cost of said improvements did not within twenty days from the date of the 'last publication thereof file with the City Clerk a sufficient protest, in writing, against the making of said improvements, no protests of any kind having been filed; NOW THEREFORE: BE IT O1RDAINED BY THE Board of Coma ssioners of the City of Salina, Kansas; Section 1. That it is necessary and it is hereby ordered that Front Street from the north line of Republic Avenue to the center line of Crawford Avenue, in said city be curbed and guttered with emmvation necessary therefore and graded and to the established paving grade to each side thereof, as may be necessary for the completion of said work. Section 2. That it is necessary and it is hereU t Side of y ordered that/Roach Street from the north line of Claflin Avenue to the south line of Kinvin Avenue, in said city be curbed and guttered with the excavation necessary therefor and graded to the established paving grade to each side thereof, as may be necessary for the completion of said work. Section 3. That it is necessary and it is hereby ordered that Thirteenth Street from the south line of Grand Avenue to the center line of Broadway Boule- vard in said city be curbed and guttered with the excavation necessary therefor, and graded to the established paving grade to each side thereof, as may be neces- sary for the completion of said work. Section 4. That it is necessary and it is hereby ordered that Third Street from the south line of Prescott Avenue to the center line of Crawford Avenue, in said city, be curbed and guttered with the excavation necessar=y therefor, and graded to the established paving grade to each side thereof, as may be necessary for the completion of said work. i i Section 5. That it is necessary and it is hereby ordered that Vanango Street from east line of Hancock Street to the west line of Lerrill Street, in said city be curbed and guttered with excavation necessary therefor, and graded -to the established paving grade to each side thereof, as may be necessary for the comple- tion of said work. Section 6. Concrete combined curb and Sutter on each side thereof 30 inches wide from, b5,ck of curbing to paving line, curb 12 inches deep at back, gutter 6 inches deep; and the necessary grading of �rs_s to the established Paving grade between the curb and gutter lines on each side thereof and within the limits ol. said streets hereinbefore described. and said Engineer shall on or before the same date, submit to the Board of Cormn- issioners under oath, detailed estimates of the cost of such work for such imp- rovements. Section 7. That after such plans and specifications shall have been made and prepared by the City Engineer and filed with the City Clerk as aforesaid the .Board of Co_iriissioners may advertise by advertisement published in the official city paper of the City of SRlina, Kansas, for -three conseettive days for -the re- ceipt of sealed proposals for the improving of said streets with the kind of �at- erial named and specified in the preceeding sections hereof, and for the excavat- ion and grading necessary for the completion of such work, and after the receipt of such 'Proposals the said Board of Corraissioners may and are hereby authorized to let contracts for the improving of said streets with the material selected by them to the lowest responsible bidder or bidders thereof, as deter.,ined by said Board of Com?_=issioners and for such excavation and grading. Said Board of Comm- issioners reserve the right to reject any and all bids. $lection 8. That for the improving of the above rzentioned streets such ass- essments shall be made for the full costs thereof according to ]saw, on all lots and pieces ofland to the center of the block o3R either or both sides of the streets to be improved according to the appraisers' valuation thereof without re- gard to the buildings or improvements thereon for the distance to be improved. Section 9. After the passage of and publication of this ordinance, the Board of Corgi.issioners shall appoint three disinterested appraisers, householders, who after having taken an oath to make a true and impartial appraisement for all i lots and pieces of land liable to assessments and taxation for the cost of the improvements herein provided for, shall within five days from having been notified of their appointment, proceed to appraise said lots and pieces of land liable to assessment and taxation as aforesaid, as may be designated by the Board of Comm- issioners of said city and said 3oard of Commissioners shall designate a time and place for the hearing of any complaints that may be made as to the value of any lots or pieces of land appraised as a`or®said, ofuhich due notice shall be given in the of icial city paper, at which hearing the Board of Cormaissioners _aay alter any valuation of any lot or piece of land, if, in thier opinion, the City Clerk Same bee,-1 an )raised too - 111gh or too low. i Section 10• That for the purpose of �_A ying the cost of the work and i:m_pro ads -nts in this ordinance provided for, the Hoard of Commissioners are hereby authorized and directed to issue internal improvement P t bonds ofthe Cit � y of Salina in an amount not to exceed the contract pri-oo� nr cost of such improve- mprove- ments: menta and to run for a period of four years and be payable in four our equal instalr ments, together with interest not to exceed five per cent annum, which bonds stall be made payable at the Fiscal Agency of the State of Kansas, and for the purpose ofray' g ina I pri-rcipal and interest on said bonds as they severally become i due and payable, the Board of Co71inissioners shall apportion and assess against the lots and pieces of land within the taxing; district of sue, A improvements, special assessments covering the cost of such ! improvements and theapportionment Herein contained shall hold Cood for all the installments that are t o be collected from the specific property chargeable with said improvements. Section 11. That this ordinance shall take effect and be in force from and after its publication once in the official city paper.
