5414 Utility Improvements Bond's Addition1 1 - --- — - - - ORDINANCE NM,;BER _ __5414 _ - _— (hiblished in the Salina Jo�:rnal X9 9) AIN OMMMAiWCE t' - 1 crea ing and defining a certain lateral sanitary sewer district in the City of Salina, Kansas, designated as Lateral Sanitary Sewer District Number 245, and providing for the construction of a lateral sanitary sewer in said Lateral j Sanitary Sewer District Number 245, so created, and providing for the payment of the cost thereof and for the levying of special assessments against the property in said district for the payment of the cost of such construction of and for the issuing of bonds to pa,Zr the cost thereof. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas. Section 1. Lateral Sanitary Sewer District Number 245. That there be and there is i hereby created lateral sanitary sewer district in the City of Salina, Kansas, -4i ich shall be and it is hereby designated as Lateral Sanitary Sewer District Number 245 and which district shall include all the following described property in the City of Salina Kansas to -wit: Lots 1 to 28 inclusive, Block 4 of 'Woods Replat of Block 4 and Block 5 in Bondts Addition, City of Salina, Kansas. Section 2. It is necessary and it is hereby ordered that an eight inch V. C. p. lateral sanitary sewer with all necessary connections, manholes, ;flushing tanks, and other appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District Number 245 as created by Section 1 of this ordinance alon the following course, to -wit: An ei;ht inch clay pipe sewer beginning at a manhole which will be constructed on Vain Sewer ffX" at the intersection of the center line of ;rood A enue and the center line of Bond Street; thence north on the center line of Wood A.,renue to a point 60 feet south of the south line of Crawford Avenue to a manhole to be constructed, being the terminus thereof. Section 3. That the City Engineer shall on or before August 22nd 1949, prepare and file in the office of the City Clerk, plans and specifications for the con- struction of the lateral sanitary sewer provided for in the preceding sections of this ordinance which shall be of proper character to serve the property lying within the dis- trict which such sewer is to be constructed and shall on or before the same date prepare and -submit to the Board of Commissioners a detailed estimate under oath of the cost there- of. That hereafter the City Clerk shall advertise for three consecutive days in the official city paper for sealed proposals for the building and construction of such sewer according~ to such plans and specifications, which proposals shall be filed with the City Clerk on or before the time fixed in such notice, at which time the Board of Commissioners may let a contract for the building and construction of such sewer to the lowest and best responsible bidder or bidders therefor, if there be any ,,Those bids do not exceed the estimated cost thereof, but said Board shall reserve the right to reject any or all such proposals, and if noX bid shall be received jithin such estimate, the Board of Commission- ers shall have the power to do such work and :-1,1ake such improvements within the estimated cost thereof as provided by law. Section 4. That for the cost of building and constructing such sewer, #ecial assessments shall be made for the full cost thereof on all lots and pieces of land within and for which such sevrer shall be b.ilt, according to the appraised value thereof, without regard to the improvements or buildings thereon. Section K. After the passage and publication of this ordinance, the Board of Com- missioners shall appoint three disinterested appraisers who v +, of cr having taken oath to make a true and impartial appraisement of all lots andpieces of land to taxation for the cost of such improvements, shall within five days after having been notified of their appointments proceed to appraise all of the lots and pieces of land within such district liable to assessment and taxation as aforesaid, without regard to the buildings or im- provements thereon, and after making such appraisement shall return to the Board of Com- missioners of said city and said Board shall designate a time for a special meeting of said Board for the purpose of hearing any complaints that may be made as the value of any lot or piece of land appraised as aforesaid, or which special session due notice shall be given in the official city paper, and at which special session said Board may alter any valuation of any lot or piece of land if, in their opinion, the sane has been appraised too high or too low. Section 6. The special assessment herein provided for may be y paid by the person liable therefor in four approximately equal annual installments but the ovrner of any Property liable to such assessment may i -,;.thin thirty days from the day of determining the amount assessed against the property, pay the same in full and his property shall not be liable for any assessment for the cost of such improvements, and bonds as hereinafterro- P vided for shall be issued in the amount of the cost of such improvements remaining unpaid at the end of the thirty da -,,s from the time such assessment is s ' lxec.. Section 7. For the purpose of paying for the work and improvements in this ordinance provided for, the Board of Commissioners may hereby and are authorized and directed to issue improvement bonds of the City of Salina, Kansas, in an amount nct to exceed the cost of such improvement, and to run for a period of four years and be payable in four approximately equal annual installments, together vrith interest not to exceed five per- s cent per annum, which bonds shall be issued and payable according to law; and for the purpose of payin; the principal and interest on said bonds as they severally become due and parable the Board of Commissioners shall apportion and assess against the lots or pieces of land within the taxing district of such improvements, special assessments cover- ing the cost of such improvement and apportionment therein contained shall hold rood for all of the installments that are to be collected from the specific property chargeable with such improvements; such assessment and apportionment ordinance shall contain the total amount of tax apportioned to each tract, piece or parcel of land within the taxing dis- trict and shall state the number of annual installments in vfzich such tax is to be :collected; and thereafter the Citi- Clerk shallannually, at the same time other taxes are certified, certify to tie County Cle:mak of Saline County, Kansas, a full list of all 'property liable for such .work and improvements, together with the respective numbered iamounts due on each of said tracts, piece or parcel of land, vrhich amounts shall include the annual installments and interest on all unpaid balances for one year at the rate of not to exceed five percent per anniun on such amounts so terrified, which shall be collected as other taxes are collected.
