5601 Confirm Utility Improvements1 s ORDINANCE NO. 5601 (Published in the Salina Journal 1951 AN ORLINANCE ratifying and confirming a contract with H. J. Taylor Construction Company for the construction of certain Lateral Sanitary sewers in the City of Salina hereto- fore designated as Lateral Sanitary Sewer District 266, and providing for the issuance of temporary notes to pay the cost thereof, pending issuance and sale of bonds. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas. Section 1. That tbre acceptance by the City of Salina of the proposal of H. J. Taylor Construction Company, hereinafter referred to as the "contractor" as submitted to the Board of Commissioners November 26, 1951, which iO, hereby found to be the lowest and best bid for such work, and the contract awarded by t Board of Commissioners of said city to said contractor and signed on behalf of the city by its Mayor on November 30, 1951, for the construction of certain public improvements in the City of Salina, to -wit: An 8 inch clay pipe sewer beginning at an existing manhole in Front Street 290 feet north of the north line of Crawford, thence southeasterly 60 feet to the center line of alley first north of Crawford; thence east along ester line of alley 543 feet; thence south 119 feet on center. -'Ane of right -of -sway; thence east along center line of rigs of -way to the center line of Elmore Street; 1I there a Awnhole to be constructed which will be terminus of Lateral 266,a at and for the unit price for said work contained in said proposal, which proposal and contract are hereby referred to and made parts of this ordinance, be and the same is hereby ratified and confirmed, said proposal being within the estimated cost of said improvements as shown by the sworn estimate of the City Engineer on file in the office of the City Clerk, which estimates are hereby referred to and made a part of this ordinance* Section 2. Said improvements shall be built and constructed in accordance with the plans and specifications therefore prepared by the City Engineer on file in the office of the City Clerk and in accordance with the proposal of said contractor and under the terms of said contract, all of which are hereby referred to and made a part of this ordinance. Section 3. That temporary notes signed by the Mayor and attested by the City Clerk be issued from time to time as the work progresses in the manner and form as required by law, the total amount thereof not to exceed the contract price for such work, such notes to bear interest at not to exceed 4- per cent per annum and to mature not later than Decem::,er 1, 1953, and to be issued in such amounts and at such times as may the money for the payment of the cost of such work be required, such notes to be issued to said contractor and to be redeemed and cancelled at the time that Internal Improvement Bonds are issued in lieu thereof. Section 4. That this ordinance shall take effect and be in full force from a.nd after ita publication once in the official city paper.
