5597 Utility Improvements Morningside AdditionORDINANCE N0. 5597 (Published in the Salina Journal 1951) AN ORDINANCE creating and defining a certain lateral sanitary sewer district in the City of Salina, Kansas, designated as Lateral Sanitary Sewer District Number 267 and providing for the constructi n of a lateral sanitary sewer in said Lateral Sanitary Sewer District Number 267, so created, and providing for the payment of the cost thereof and for the levying of special assessments against the property in said district for the payment of the cost of such construction and for the issuing of bonds to pay the cost thereof* BE IT ORDAINED by the Board of Coriunissioners of the City of Salina, Kansas: Section 1. Lateral Sanitary Sewer District 267. That there be and there is hereby created Lateral Sanitary Sewer District in the City of Salina, Kansas, which shall be and it is hereby designated as Lateral Sanitary Sewer District Number 267 and which district shall include all the following described property in the City of Salina, Kansas, to -wits Benefit District: Lateral 267. Block 3s Morningside Addition Section 2. It is necessary and it is hereby ordered that an eight inch V. C. F. lateral sanitary sewer with all necessary connections, manholes, flushing tanks, and other appurtenances be constructed and built in and to serve said Lateral Sanitary Sewer District Number 267 as created by Section 1 of this ordinance along with the following course, to -wit: Beginning at an existing manhole in Sunrise Drive and west and opposite Lot Line 2 and 17, Block 3, Morningside Addition, thence east on center line of right--of-way, 633 feet more or less to the center line of Roadh Street at which point a manhole will be constructed which will be the terminus of Lateral 257. Section 3. That the City Engineer shall on or before prepare and file in the office of the City Clerk, plans and specifications for the con- struction. of the lateral sanitary sewer provided for in the preceding sections of this ordinance which shall be of proper character to serve the property lying within the dis- trict which such sewer is to be constructed and shall on or before the same date prepare and submit to the Board of Commissioners a detailed estimate under oath of the cost there- of. That hereafter the City Clerk shall advertise for three consecutive days in the official city paper for sealed proposals for the building and construction of such sewer according to such plans and specifications, which proposals shall be filed with the City Clerk on or before the time fixed in such notice, at which time the Board of Commissioners may let a contract for the building and construction of such sewer to the lowest and best responsible bidder or bidders therefor, if there be any whose bids do not exceed the esti- mated cost thereof, but said Board shall reserve the right to reject any or all such pro- posals, and if no bid shall be received within such estimate, the Board of Commissioners shall have the power to do such work and make such improvements within the estimated cost thereof as provided by law, Section 4* That for the cost of building and constructing such sewer, special assessments shall be made for the full cost thereof on all lots and pieces of land within and for which such sewer shall be builtp according to the appraised value thereof, without regard to the improvements or buildings thereon. Section 5. After the passage and publication of this ordinance, the Board of Commissioners shall appoint three disinterested appraisers., who having taken oath to make a true and impartial appraisement of all lots and pieces of land to taxation for the cost of such improvements' shall within five days after having been notified for their appointments proceed to appraise all of the lots andpieces ofland within such district liable to assessment and taxation as aforesaid, without regard to the buildings or improve- ments thereon, and after making such appraisements, shall return to the Board of Com- missioners of said city and said Board shall designate a time for a special meeting of said Board for the purpose of hearing any complaints that may be made as to the value of any lot or piece of land appraised as aforesaid: of which special session due notice shall be given in the official city paper.. at which special session said Board may alter any valuation of any or lot piece of land if, in their opinions the same has been appraised too high or too low. Sect:ILon 6. The special assessment herein provided for may be paid by the person liable therefor in four approximately equal annaul installments but the owner of any property liable to such assessment may within thirty days from the date of determ*ning the amount assessed against the property, pay the same in full and his property shall not be liable for any assessments for the cost of such improvements, and bonds as herein after provided for shall be issued in the amount of the cost of such improvements remain- ing unpaid at the end of the thirty days from the time such assessment is fixed. Section 7. For the purpose of paying for the work and improvements ih this ordin- ance provided for, theBoard of Commissioners may and are hereby authorized and directed to issue improvement bonds of the City of Salina, Kansas in an amount not to exceed the cost of such imp-•ovement, and to run for a period of four years and be payable in four approximately equal annual installments, together with interest not to exceed five per cent per annum, which bonds shall be issued and payable according to law; and for the Purpose of paying the principal and interest on said bonds as they severally become due and payable the Board of Commissioners shall apportion and assess against the lots and pieces of land within the taxing district of such improvements, special assessments covering the cost of such improvement and apportionment therein contained shall hold good for all of the installments that are to be collected from t he specific property chargeable with such improvements; such assessment and apportionment ordinance shall contain the total amount of tax apportioned to such tract, piece or parcel of land with- in the taxing district and shall state the number of annual installments in which such 1 1 tax is to be collected; and thereafter tge City Clerk shall annually, at the same time that other taxes are certified, certify to the County Clerk of Saline County, Kansas, a full list of all property liable for such work and Liprovements, together with the respective numbered amounts due on each of said tracts, pieces or parcels of 1an4 which amounts shall includd the annual installments and interest on all unpaid balances for one year at the rate of not to exceed five per cent per annum, on such amounts so certified, which shall be collected asother taxes are collected. Section 6.
