AN ORDINANCE ratifying and confirming a contract with 0. D. Wilmoth for the construction
of certain Lateral Sanitary sewers in the City of Salina heretofore designated as
Lateral Sanitary Sewer District 265, and providing for the issuance of temporary
notes to pay the cost thereof, pending issuance and sale of bonds,
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas!
Section 1. That the acceptance by the City of Salina of the proposal of O. D.
Wilmoth, hereinafter referred to as the "contractor" as submitted to theBoard of Com-
missioners November 5, 1951, which is hereby found to be the lowest and best bid for
such work, and the contract awarded by the Board of Commissioners of said city to said
contractor and signed on behalf of the city by its Mayor on November 7, 1951, for the
construction of certain public improvements in the City of Salina, to -wit:
An 8 inch clay pipe sewer beginning at an existing manhole
at the southwest corner of Lot 8, Block 7, Sunrise Addition;
thence north along right-of-way for utilities 340 feet more
or less to the south corner of Lot 2, Block 7, Sunrise Addi-
tion, there a manhole to be constructed which will be terminus
of Lateral 265,
at and for the unit price for said work contained in said proposal, which proposal and
contract are hereby referred to and made parts of this ordinance, be and the same is
hereby ratified and confirmed, said proposal being within the estimated cost of said
improvements as shoran by the sworn estimate of the City Engineer on file in the office
of the City Clerk, which estimates are hereby referred to and made a part of this
ordinance.
Section 2. Said improvements shall be built and constructed in accordance with
the plans and specifications therefore prepared by the City Engineer on file in the
office of the City Clerk and in accordance with the propo-al of said contractor and
under the terms of said contract, all of which are hereby referred to and made a part
of this ordinal ce.
Section 3. That temporary notes signed by the Mayor and attested by the City Clerk
be issued from time to time as the work progresses in the manner and form as required
by law, the total amount thereof hot to exceed the contract price for such work, such
notes to bear interest at not to exceed 4j per cent per annum and to mature not later
than December 1, 1953, and to be issued in such amounts and at such times as may the
money for the payment of the cost of such work be required, such notes to be issued to
said contractor and to be redeemed and cancelled at the time that Internal Improvement
Bonds are issued in lieu thereof.
Section 4* That this ordinance shall take effect and be in full force from and
after its publication once in the official city paper.
