AN ORDINANCE ratifying and confirming a contract with the H. J. Taylor Construction
Company for the construction of certain curbing, guttering, paving and grading
improvements on certain streets in the City of Salina, and providing for the issuance
of temporary notes to pay the cost thereof pending the issuance and sale of bonds.
BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas:
Section 1. That the acceptance by the City of Salina, Kansas, of the proposal of the
H. J. Taylor Construction Company, hereinafter referred to as the "contractor" as submitted
to the Board of Commissioners on September 10, 1951, which is hereby found to be the lowest
and best bid for such work, and the contract awarded by the Board of Commissioners of said
city to said contract and signed on behalf of the City by its Mayor on September 17, 1051
for the construction of certain public improvements in the City of Salina, Kansas, to -wits
Curbing, guttering, paving and grading for a width of Twenty
Feet (20 feet) east side of Fourth Street from the north line
of Crawford Avenue to the south line of Prescott Avenue, as
provided by Ordinance Number 557..
Curbing, guttering, paving and grading of Grand Avenue from
the west line of Eleventh Street to the west line of Twelfth
Street, as provided by Ordinance Number 5574.
Curbing, guttering, paving and grading of Grand Avenue from
the west line of Twelfth Street to the east line of Thirteenth
Street, as provided by Ordinance Number 557..
Uurbing, guttering, paving and grading of Tenth Street from
the north line of Grand Avenue to the south line of Woodland
Avenue, as provided by Ordinance Number 5574•
Curbing, guttering, paving and grading of University Street
from the Missouri Pacific Railroad tracks to the east line of
Clark Street, as provided by Ordinance Number 5574,
at and for the unit price of said work contained in said proposal, which proposal and con-
tract are hereby referred to and made a part of this ordinance, be and the same is hereby
ratified and confirmed, said proposal being within the estimated cost of said improvements as
shown by the sworn estimates of the City Engineer on file in the office of the City Clerk,
which estimates are hereby referred to and made a part of this ordinance.
Section 2. Said improvements shall be built and constructed in accordance with the plans
and specifications therefor prepared by the City Engineer on file in the office of the City
Clerk and in accordance with the proposal of said contractor and under the terms of said
contract, all of which are hereby referred to and made parts of this ordinance.
Section 3. That temporary notes signed by the Mayor and attested by the City Clerk be
issued from time to time as the work progressed in the manner and form provided and required
by law, the total amount thereof not to exceed the contract price for such work, such notes
to bear interest not to exceed 42 per cent per annum and to mature not later than June 1,
1953, and to be issued in such amounts and at such times as money for the payment of the cost
of such notes be issued to said contractor and to be redeemed and cancelled at the time that
permanent bonds are issued in lieu thereof.
Section 4. This ordinance shall take effect and be in force from and after its publiea-
tion once in the official city paper.
