5581 Construct / Moving Buildings Into Fire Limits1 1 ORDINANCE NO. 5581 (Published in the Salina Journal 1951) AN ORDINANCE prescribing limitations as to construction or the moving of buildings into the fire limits of the City of Salina., Kansas, amending Section 6-212, Revised Ordinances of the City of Salina, 1948, and repealing the said section. BE IT ORDAINED by the Board of Commissioners of the City of Salina, Kansas: Section 1. Amendment. That the original of Section 6-212, Revised Ordinances of the City of Salina, 1948s be and it is hereby amended to read as follows: "6-212. LIMITATIONS WITHIN FIRE LI14ITS. Within the fire limits no building or structure of frame construction or of unprotected metal construction shall be hereafter extended on any side unless the construction of such extension conforms to the require- ments of this article for new construction; and provided that the area of the building as extended shallnot exceed the allowable area for frame constructi`-n. No bui;;-ding of frame construction or unprotected metal construction shall hereafter be moved from without to within the fire limits, except as specifically herein provided for dwellings. Frame buildings within the fire limits which have been damaged by fire, decay or otherwise to an extent not greater than 50 per cent of their value may be repaireds pro- vided there is no increase in the sine of such buildings over their original dimensions. Whenever any frame building within the fire limits shall be remodeled, altered or changed for the purpose of using the same for flats or apartments, or whenever such frame building shall be occupied for flat or apartment purposes of more than three suites each suite of apartments in such building shall be separated from the other by a wall of in- combustible material of such dimensions and thickness as required herein. No building or structure of frame construction, or of unprotected metal construction or which has a wooden cornice, shall be erected hereafter in or moved into the fire limits, except the following: Frame dwellings not exceeding two stories in height and separated by at least five feet from the line of adjoining property. A building of frame construction or of unprotected metal construction occupied ex- clusively as a private garage or stable, not more than one story in height nor more than seven hundred and fifty square feet in area, located on the same lot with a dwelling; provided that such building shall be placed at least three feet from the lot line. Sheds open on the long side, not more than fifteen feet in height nor more than five hundred square feet in area. Builder's shanties for use only in connection with a duly authorized building operation and located on the same lot with such building operation, or on a lot immediately adjoining, or on an upper floor of the building under construction, or hnn a sidewalk shed, and which builders' shanties are promptly removed when the building operation is completed. Piazzas or balconies on dwellings, not exceeding ten feet in width not extending more than three feet above the second story floor beams; provided that no such structure shall extend beyond a point within five feet of a lot line or bejoined to a similar struc- ture of another building. i1 n 1 Metal cooling towers not in excess of two hundred and fifty square feet in base area and fifteen feet in heighth. That in the modified congested area of the fire limits a porcelain covered metal walled structure with a four inch wall, or more, insulated with fibre glass or some equivalent fire proof material is authorized only in the event that a six foot, or more., side yard is provided." Section 2. REPEAL. That the original Section 6-212 Revised Ordinances of the City of Salina 1948, be and it is hereby repealed. Section 3. EFFECTIVE. That this ordinance shall be in full force and effect from and after its adoption and publication once in the official city paper. (SEAL) Attest: i i Introduced..
